102 | 96 | | E. All applicants seeking licensure or licensure renewal as a |
---|
103 | 97 | | medical marijuana business shall comply with the following general |
---|
104 | 98 | | requirements: |

105 | 99 | | 1. All applications for licenses and re gistrations authorized |
---|
106 | 100 | | pursuant to this section shall be made upon forms prescribed by the |
---|
107 | 101 | | Authority; |
---|
108 | 102 | | 2. Each application shall identify the city or county in which |
---|
109 | 103 | | the applicant seeks to obtain licensure as a m edical marijuana |
---|
110 | 104 | | business; |
---|
111 | 105 | | 3. Applicants shall submit a complete application to the |
---|
112 | 106 | | Department before the application may be accepted or considered; |
---|
113 | 107 | | 4. All applications shall be complete and accurate in every |
---|
114 | 108 | | detail; |
---|

150 | 143 | | a. twenty-five (25) years of age or older, |
---|
151 | 144 | | b. if applying as an individual, proof that the applicant |
---|
152 | 145 | | is an Oklahoma resident purs uant to paragraph 11 of |
---|
153 | 146 | | this subsection, |
---|
154 | 147 | | c. if applying as an entity, proof that seventy-five |
---|
155 | 148 | | percent (75%) of all members, managers, executive |
---|
156 | 149 | | officers, partners, board members or an y other form of |
---|
157 | 150 | | business ownership are Oklahoma residents pursuant to |
---|
158 | 151 | | paragraph 11 of this subsection, |
---|
159 | 152 | | d. if applying as an individual or entity, proof that the |
---|
160 | 153 | | individual or entity is registered to conduct business |
---|
161 | 154 | | in the State of Oklahoma, |
---|
162 | 155 | | e. disclosure of all ownership interests pursuant to the |
---|

202 | 194 | | business licenses or categories that an indi vidual or entity can |

203 | 195 | | apply for or receive, although each application and each category |
---|
204 | 196 | | shall require a separate application and application fee. A |
---|
205 | 197 | | commercial grower, process or and dispensary, or any combination |
---|
206 | 198 | | thereof, are authorized to share the same ad dress or physical |
---|
207 | 199 | | location, subject to the restrictions set forth i n the Oklahoma |
---|
208 | 200 | | Medical Marijuana and Patient Protection Act ; |
---|
209 | 201 | | 9. All applicants for a medical marijuana bus iness license, |
---|
210 | 202 | | research facility licen se or education facility license authorized |
---|
211 | 203 | | by the Oklahoma Medical Marijuana and Patient Protection Act, or for |
---|
212 | 204 | | a renewal of such license, shall undergo an Oklahoma crimi nal |
---|
213 | 205 | | history background check conducted by the O klahoma State Bureau of |
---|
214 | 206 | | Investigation (OSBI) within thirty (30) days prior to the |
---|
215 | 207 | | application for the license, including: |

250 | 241 | | charged to any other per son or industry for such background ch ecks; |
---|
251 | 242 | | 11. In order to be considered an Okla homa resident for purposes |
---|
252 | 243 | | of a medical marijuana business application, all applicants sha ll |
---|
253 | 244 | | provide proof of Oklahoma residenc y for at least two (2) years |
---|
254 | 245 | | immediately preceding the date of application or five (5 ) years of |
---|
255 | 246 | | continuous Oklahoma residency dur ing the preceding twenty-five (25) |
---|
256 | 247 | | years immediately preceding the date of application . Sufficient |
---|
257 | 248 | | documentation of proof of r esidency shall include a combination of |
---|
258 | 249 | | the following: |
---|
259 | 250 | | a. an unexpired Oklahoma -issued driver license, |
---|
260 | 251 | | b. an Oklahoma identification card, |
---|
261 | 252 | | c. a utility bill preceding the date of application, |
---|
262 | 253 | | excluding cellular telep hone and Internet bills, |
---|
263 | 254 | | d. a residential property deed to property in the State |
---|
264 | 255 | | of Oklahoma, and |
---|

298 | 288 | | 12. All license applicants shall be required to submit a |

299 | 289 | | registration with the Oklahoma State Bureau of Na rcotics and |
---|
300 | 290 | | Dangerous Drugs Control as provi ded in Sections 2-302 through 2-304 |
---|
301 | 291 | | of this title; |
---|
302 | 292 | | 13. All applicants shall establis h their identity through |
---|
303 | 293 | | submission of a color copy or digital image of one of the following |
---|
304 | 294 | | unexpired documents: |
---|
305 | 295 | | a. front of an Oklahoma driver license, |
---|
306 | 296 | | b. front of an Oklahoma identification card, |
---|
307 | 297 | | c. a United States passport or other photo identification |
---|
308 | 298 | | issued by the United States government, or |
---|
309 | 299 | | d. a tribal identification card approved for |
---|
310 | 300 | | identification purposes by the Ok lahoma Department of |
---|
311 | 301 | | Public Safety; and |

312 | 302 | | 14. All applicants shall submit an applicant photograph . |
---|
313 | 303 | | F. The Authority shall review the m edical marijuana business |
---|

348 | 337 | | business license for the specific category applied und er, which |

349 | 338 | | shall act as proof of their approv ed status. Rejection and denial |
---|
350 | 339 | | letters shall provide a reason for the r ejection or denial. |
---|
351 | 340 | | Applications may only be rejected or denied based on the applicant |
---|
352 | 341 | | not meeting the standards set forth in the provisio ns of the |
---|
353 | 342 | | Oklahoma Medical Marijuana and Pat ient Protection Act and Sections |
---|
354 | 343 | | 420 through 426.1 of this title , improper completion of the |
---|
355 | 344 | | application, or for a reason provi ded for in the Oklahoma Medical |
---|
356 | 345 | | Marijuana and Patient Protection Act and Sections 420 through 426.1 |
---|
357 | 346 | | of this title. If an application is rejected for failure to provide |
---|
358 | 347 | | required information, the applica nt shall have thirty (30) days to |
---|
359 | 348 | | submit the required information for reconsideration . No additional |
---|
360 | 349 | | application fee shall be charged for such reconsideration. Unless |
---|
361 | 350 | | the Department determines otherwise, an application that has been |
---|
362 | 351 | | resubmitted but is st ill incomplete or contains errors that are not |

364 | 353 | | 3. Status-update letters shall provide a reason for delay in |

398 | 386 | | H. A license for a medical marijuana business, medical |

399 | 387 | | marijuana research facility, me dical marijuana education facility or |

400 | 388 | | medical marijuana waste disposal facility shall not be issued to or |
---|
401 | 389 | | held by: |
---|
402 | 390 | | 1. A person until all required fees have been paid; |
---|
403 | 391 | | 2. A person who has been c onvicted of a nonviolent felony |
---|
404 | 392 | | within two (2) years of the d ate of application, or within five (5) |
---|
405 | 393 | | years for any other felony; |
---|
406 | 394 | | 3. A corporation, if the criminal history of any of its |
---|
407 | 395 | | officers, directors or stockholders indicates that the officer, |
---|
408 | 396 | | director or stockholder has been convicted of a nonviolent felony |
---|
409 | 397 | | within two (2) years of the date of application, or within five (5) |
---|
410 | 398 | | years for any other felony; |
---|
411 | 399 | | 4. A person under twenty-five (25) years of age; |

412 | 400 | | 5. A person licensed pursuant to this section w ho, during a |

413 | 401 | | period of licensure, or who, at the time of applica tion, has failed |

449 | 436 | | Section 427.2 of this title, has been revoked by the Department ; or |

450 | 437 | | 8. A person who was involved in the management or operations of |
---|
451 | 438 | | any medical marijuana business, medical marijua na research facility, |
---|
452 | 439 | | medical marijuana education facility or medical marijuana wa ste |
---|
453 | 440 | | disposal facility that, after the initiation of a disc iplinary |
---|
454 | 441 | | action, has had a medical marijuana license revoked, not ren ewed, or |
---|
455 | 442 | | surrendered during the five (5) years preceding submission of the |
---|
456 | 443 | | application and for the following violations: |
---|
457 | 444 | | a. unlawful sales or purchases, |
---|
458 | 445 | | b. any fraudulent acts, falsific ation of records or |
---|
459 | 446 | | misrepresentation to the Authority, medical marijua na |
---|
460 | 447 | | patient licensees, caregiver licensees or me dical |
---|
461 | 448 | | marijuana business licensees, |
---|
462 | 449 | | c. any grossly inaccurate or fraudulent report ing, |
---|
463 | 450 | | d. threatening or harming any medical marijuana p atient, |
---|
464 | 451 | | caregiver, medical practitioner or employee of the |
---|
465 | 452 | | Department, |
---|
466 | 453 | | e. knowingly or intentionally refusing to permit the |
---|
467 | 454 | | Department access to premises or r ecords, |
---|

501 | 487 | | I. In investigating the qualifications of an applicant or a |
---|
502 | 488 | | licensee, the Department, Authority and muni cipalities may have |
---|
503 | 489 | | access to criminal history record information furnished by a |
---|
504 | 490 | | criminal justice agency subject to any restr ictions imposed by such |
---|
505 | 491 | | an agency. |
---|
506 | 492 | | J. The failure of an applicant or licensee to provide the |
---|
507 | 493 | | requested information by the Authori ty deadline may be grounds for |
---|
508 | 494 | | denial of the application. |
---|
509 | 495 | | K. All applicants and licensees shall submit information to the |
---|
510 | 496 | | Department and Authority in a full, faith ful, truthful and fair |
---|
511 | 497 | | manner. The Department and Authority may recommend denial of an |
---|
512 | 498 | | application where the applicant or licensee made misstatements, |
---|
513 | 499 | | omissions, misrepresentations or untruths in the application or in |
---|
514 | 500 | | connection with the background invest igation of the applicant. This |
---|
515 | 501 | | type of conduct may be grounds for administrative action ag ainst the |
---|
516 | 502 | | applicant or licensee. Typos and scrivener errors shall not be |
---|
