55	50		BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA :
56	51		SECTION 1. AMENDATORY 63 O.S. 2021, Section 427.14, is
57	52		amended to read as follows:
58	53		Section 427.14 A. There is hereby created the medica l
59	54		marijuana business license, which shall include the following
60	55		categories:
61	56		1. Medical marijuana commercial grower;
62	57		2. Medical marijuana processor;
63	58		3. Medical marijuana dispensary;
64	59		4. Medical marijuana transporter; and
65	60		5. Medical marijuana testin g laboratory.

93	87		B. The Oklahoma Medical Marijuana Authority, with the aid of
94	88		the Office of Manage ment and Enterprise Services, shall develop a
95	89		website for medical marijuana business applications.
96	90		C. The Authority shall make available on its website in an
97	91		easy-to-find location, applications for a medical marijuana
98	92		business.
99	93		D. The annual, nonrefundable application fee for a medical
100	94		marijuana business license shall be Two Thousand Five Hundred
101	95		Dollars ($2,500.00).
102	96		E. All applicants seeking licensure or licensure renewal as a
103	97		medical marijuana business shall comply with the following general
104	98		requirements:
105	99		1. All applications for licenses and re gistrations authorized
106	100		pursuant to this section shall be made upon forms prescribed by the
107	101		Authority;
108	102		2. Each application shall identify the city or county in which
109	103		the applicant seeks to obtain licensure as a m edical marijuana
110	104		business;
111	105		3. Applicants shall submit a complete application to the
112	106		Department before the application may be accepted or considered;
113	107		4. All applications shall be complete and accurate in every
114	108		detail;

143	136		supplemental information re quired by the forms supplied by the
144	137		Authority;
145	138		6. All applications shall be accompanied by a full remitta nce
146	139		for the whole amount of the application fees . Application fees are
147	140		nonrefundable;
148	141		7. All applicants shall be approved for licensing review that,
149	142		at a minimum, meets the following criteria:
150	143		a. twenty-five (25) years of age or older,
151	144		b. if applying as an individual, proof that the applicant
152	145		is an Oklahoma resident purs uant to paragraph 11 of
153	146		this subsection,
154	147		c. if applying as an entity, proof that seventy-five
155	148		percent (75%) of all members, managers, executive
156	149		officers, partners, board members or an y other form of
157	150		business ownership are Oklahoma residents pursuant to
158	151		paragraph 11 of this subsection,
159	152		d. if applying as an individual or entity, proof that the
160	153		individual or entity is registered to conduct business
161	154		in the State of Oklahoma,
162	155		e. disclosure of all ownership interests pursuant to the
163	156		Oklahoma Medical Marijuana and Patient Protection Act ,

193	185		marijuana research facility, medical marijuana
194	186		education facility and medical marijuana waste
195	187		disposal facility applicant or l icensee has not been
196	188		convicted of a nonviolent felony in the last two (2)
197	189		years, or any other felony conviction within the last
198	190		five (5) years, is not a current inmate in the custody
199	191		of the Department of Corrections , or currently
200	192		incarcerated in a jail or corrections facility;
201	193		8. There shall be no lim it to the number of medical marijuana
202	194		business licenses or categories that an indi vidual or entity can
203	195		apply for or receive, although each application and each category
204	196		shall require a separate application and application fee. A
205	197		commercial grower, process or and dispensary, or any combination
206	198		thereof, are authorized to share the same ad dress or physical
207	199		location, subject to the restrictions set forth i n the Oklahoma
208	200		Medical Marijuana and Patient Protection Act ;
209	201		9. All applicants for a medical marijuana bus iness license,
210	202		research facility licen se or education facility license authorized
211	203		by the Oklahoma Medical Marijuana and Patient Protection Act, or for
212	204		a renewal of such license, shall undergo an Oklahoma crimi nal
213	205		history background check conducted by the O klahoma State Bureau of
214	206		Investigation (OSBI) within thirty (30) days prior to the
215	207		application for the license, including:

243	234		a. individual applicants applying on their own behalf,
244	235		b. individuals applying on behal f of an entity,
245	236		c. all principal officers of an entity, and
246	237		d. all owners of an entit y as defined by the Oklahoma
247	238		Medical Marijuana and Patient Protection Act;
248	239		10. All applicable fees charged by the OSBI are the
249	240		responsibility of the applicant and shall n ot be higher than fees
250	241		charged to any other per son or industry for such background ch ecks;
251	242		11. In order to be considered an Okla homa resident for purposes
252	243		of a medical marijuana business application, all applicants sha ll
253	244		provide proof of Oklahoma residenc y for at least two (2) years
254	245		immediately preceding the date of application or five (5 ) years of
255	246		continuous Oklahoma residency dur ing the preceding twenty-five (25)
256	247		years immediately preceding the date of application . Sufficient
257	248		documentation of proof of r esidency shall include a combination of
258	249		the following:
259	250		a. an unexpired Oklahoma -issued driver license,
260	251		b. an Oklahoma identification card,
261	252		c. a utility bill preceding the date of application,
262	253		excluding cellular telep hone and Internet bills,
263	254		d. a residential property deed to property in the State
264	255		of Oklahoma, and

293	283		for residential property located in the State of
294	284		Oklahoma.
295	285		Applicants that were issued a medical ma rijuana business license
296	286		prior to August 30, 2019, are hereby exempt from the two -year or
297	287		five-year Oklahoma residence requireme nt mentioned above;
298	288		12. All license applicants shall be required to submit a
299	289		registration with the Oklahoma State Bureau of Na rcotics and
300	290		Dangerous Drugs Control as provi ded in Sections 2-302 through 2-304
301	291		of this title;
302	292		13. All applicants shall establis h their identity through
303	293		submission of a color copy or digital image of one of the following
304	294		unexpired documents:
305	295		a. front of an Oklahoma driver license,
306	296		b. front of an Oklahoma identification card,
307	297		c. a United States passport or other photo identification
308	298		issued by the United States government, or
309	299		d. a tribal identification card approved for
310	300		identification purposes by the Ok lahoma Department of
311	301		Public Safety; and
312	302		14. All applicants shall submit an applicant photograph .
313	303		F. The Authority shall review the m edical marijuana business
314	304		application; approve, reject or deny the application; and mail the

342	331		approval, rejection, denial or status-update letter to the applicant
343	332		within ninety (90) business days of receipt of the appli cation.
344	333		G. 1. The Authority shall re view the medical marijuana
345	334		business applications and conduct all investigations, inspections
346	335		and interviews before app roving the application.
347	336		2. Approved applicants shall be issued a medical marijuana
348	337		business license for the specific category applied und er, which
349	338		shall act as proof of their approv ed status. Rejection and denial
350	339		letters shall provide a reason for the r ejection or denial.
351	340		Applications may only be rejected or denied based on the applicant
352	341		not meeting the standards set forth in the provisio ns of the
353	342		Oklahoma Medical Marijuana and Pat ient Protection Act and Sections
354	343		420 through 426.1 of this title , improper completion of the
355	344		application, or for a reason provi ded for in the Oklahoma Medical
356	345		Marijuana and Patient Protection Act and Sections 420 through 426.1
357	346		of this title. If an application is rejected for failure to provide
358	347		required information, the applica nt shall have thirty (30) days to
359	348		submit the required information for reconsideration . No additional
360	349		application fee shall be charged for such reconsideration. Unless
361	350		the Department determines otherwise, an application that has been
362	351		resubmitted but is st ill incomplete or contains errors that are not
363	352		clerical or typographical in nature shall be denied.
364	353		3. Status-update letters shall provide a reason for delay in
365	354		either approval, rejection or denial should a situation arise in

394	382		processing the applicati on occurred.
395	383		4. Approval, rejection, denial or status-update letters shall
396	384		be sent to the applicant in the same method the appli cation was
397	385		submitted to the Department.
398	386		H. A license for a medical marijuana business, medical
399	387		marijuana research facility, me dical marijuana education facility or
400	388		medical marijuana waste disposal facility shall not be issued to or
401	389		held by:
402	390		1. A person until all required fees have been paid;
403	391		2. A person who has been c onvicted of a nonviolent felony
404	392		within two (2) years of the d ate of application, or within five (5)
405	393		years for any other felony;
406	394		3. A corporation, if the criminal history of any of its
407	395		officers, directors or stockholders indicates that the officer,
408	396		director or stockholder has been convicted of a nonviolent felony
409	397		within two (2) years of the date of application, or within five (5)
410	398		years for any other felony;
411	399		4. A person under twenty-five (25) years of age;
412	400		5. A person licensed pursuant to this section w ho, during a
413	401		period of licensure, or who, at the time of applica tion, has failed
414	402		to:
415	403		a. file taxes, interest or penalties due related to a
416	404		medical marijuana business, or

444	431		b. pay taxes, interest or penalties due related to a
445	432		medical marijuana business;
446	433		6. A sheriff, deputy sheriff, police officer or prosecuting
447	434		officer, or an officer or employee of the Authority or municipality;
448	435		7. A person whose autho rity to be a caregiver, as defined in
449	436		Section 427.2 of this title, has been revoked by the Department ; or
450	437		8. A person who was involved in the management or operations of
451	438		any medical marijuana business, medical marijua na research facility,
452	439		medical marijuana education facility or medical marijuana wa ste
453	440		disposal facility that, after the initiation of a disc iplinary
454	441		action, has had a medical marijuana license revoked, not ren ewed, or
455	442		surrendered during the five (5) years preceding submission of the
456	443		application and for the following violations:
457	444		a. unlawful sales or purchases,
458	445		b. any fraudulent acts, falsific ation of records or
459	446		misrepresentation to the Authority, medical marijua na
460	447		patient licensees, caregiver licensees or me dical
461	448		marijuana business licensees,
462	449		c. any grossly inaccurate or fraudulent report ing,
463	450		d. threatening or harming any medical marijuana p atient,
464	451		caregiver, medical practitioner or employee of the
465	452		Department,
466	453		e. knowingly or intentionally refusing to permit the
467	454		Department access to premises or r ecords,

495	481		f. using a prohibited, hazardous sub stance for processing
496	482		in a residential area,
497	483		g. criminal acts relating to the operation of a medical
498	484		marijuana business, or
499	485		h. any violations that endanger public health and safety
500	486		or product safety.
501	487		I. In investigating the qualifications of an applicant or a
502	488		licensee, the Department, Authority and muni cipalities may have
503	489		access to criminal history record information furnished by a
504	490		criminal justice agency subject to any restr ictions imposed by such
505	491		an agency.
506	492		J. The failure of an applicant or licensee to provide the
507	493		requested information by the Authori ty deadline may be grounds for
508	494		denial of the application.
509	495		K. All applicants and licensees shall submit information to the
510	496		Department and Authority in a full, faith ful, truthful and fair
511	497		manner. The Department and Authority may recommend denial of an
512	498		application where the applicant or licensee made misstatements,
513	499		omissions, misrepresentations or untruths in the application or in
514	500		connection with the background invest igation of the applicant. This
515	501		type of conduct may be grounds for administrative action ag ainst the
516	502		applicant or licensee. Typos and scrivener errors shall not be
517	503		grounds for denial.

545	530		L. A licensed medical marijuana business premises shall be
546	531		subject to and responsible for compliance with applicab le provisions
547	532		consistent with the zoning where such business is located as
548	533		described in the most recent versions of the Oklahom a Uniform
549	534		Building Code, the International Buil ding Code and the International
550	535		Fire Code, unless granted an exemption by a municipality or
551	536		appropriate code enforcement entity .
552	537		M. All medical marijuana business , medical marijuana research
553	538		facility, medical marijuana education facility and medical marij uana
554	539		waste disposal facility licensees shall pay the relevant licensure
555	540		fees prior to receiving licensure to operate.
556	541		N. A medical marijuana business, medical marijuana research
557	542		facility, medical marijuana ed ucation facility or medical marijuana
558	543		waste disposal facility that attempts to renew its license after the
559	544		expiration date of the license shall pay a late renewal fee in an
560	545		amount to be determined by the Department to reinstate the license .
561	546		Late renewal fees are nonrefundable . A license that has been
562	547		expired for more than ninety (90) day s shall not be renewed.
563	548		O. No medical marijuana business, medical marijuana research
564	549		facility, medical marijuana education facility or medical marijuana
565	550		waste disposal facility shall possess, sell or transfer medical
566	551		marijuana or medical marijuana product s without a valid, unexpired
567	552		license issued by the Department.

596	580		research facilities, medical marijuana educ ation facilities, and
597	581		medical marijuana waste d isposal facilities shall display their
598	582		license issued by the Authority in a conspicuous location or manner
599		-	easily visible to any p erson entering the business. For purposes of
600		-	this section, "easily visible" for medical marijuan a license holders
601		-	operating a commercial grow shall mean viewable from the street
602		-	nearest to the entrance of the site of the com mercial grow
