1443 An Act relating to motor vehicles; amending 47 O.S.
1544 2011, Section 11-309, as last amended by Section 1,
1645 Chapter 184, O.S.L. 2018 (47 O.S. Supp. 2020, Section
1746 11-309), which relates to driving on roadways laned
1847 for traffic; modifying roadways in which certain left

2655 BE IT ENACTED BY THE PEOPLE OF THE ST ATE OF OKLAHOMA:

2856 SECTION 1. AMENDATORY 47 O.S. 2011, Section 11 -309, as
2957 last amended by Section 1, Chapter 184, O.S.L. 2018 (47 O.S. Supp.
3058 2020, Section 11-309), is amended to read as follows:

3259 Section 11-309. Whenever any roadway has been divided into two
3360 or more clearly marked lan es for traffic, the following requirements
3461 in addition to all others consistent herewith shall apply.

3662 1. A vehicle shall be driven as nearly as practicable entirely
3763 within a single lane.

3964 2. A vehicle shall not be moved from the lane until the driver
4065 has first ascertained that the movement can be made with safety and

4495 3. Upon a roadway which is divided into three lanes, a veh icle
4596 shall not be driven in the center lane except when overtaking and

97+passing another vehicle where the roadway is clearly visible and the
4798 center lane is clear of traffic within a safe distance, or in
4899 preparation for a left turn or where the center lane i s at the time
49100 allocated exclusively to traffic moving in the direction the vehicle
50101 is proceeding and is signposted to give notice of the allocation.

52102 4. A two-way left-turn lane is a lane near the center of the
53103 highway set aside for use by vehicles making left turns in both
54104 directions from or into the roadway. Two -way left-turn lanes shall
55105 be designated by distinctive roadway markings consisting of parallel
56106 double yellow lines, interior line dashed and e xterior line solid,
57107 on each side of the lane. A vehi cle shall not be driven in a
58108 designated two-way left-turn lane except when preparing for or
59109 making a left turn from or into a roadway. Vehicles turning left
60110 from the roadway shall not be driven in the t wo-way left-turn lane
61111 for more than two hundred (200) feet while preparing for and making
62112 the turn. A vehicle turning left onto the roadway may utilize the
63113 two-way left-turn lane as a staging area by stopping and waiting for
64114 traffic proceeding in the same direction to clear before merging
65115 into the adjacent lanes of travel. A left turn shall not be made
66116 from any other lane where a two -way left-turn lane has been

67144 designated. Provided, however, this section shall not prohibit
68145 driving across a two -way left-turn lane when moving from a service
69146 drive onto such marked roadway.

71147 5. A vehicle shall not be driven in the left lane of a roadway
72148 except when overtaking and passing another vehicle; provided,
73149 however, this paragraph shall not prohibit driving in the left lane
74150 when traffic conditions, flow or road configura tion, such as the
75151 potential of merging traffic, require the use of the left lane to
76152 maintain safe traffic conditions; provided further, this paragraph
77153 shall not prohibit driving in the left lane of a roa dway within the
78154 city limits of a municipality or upon a county road as long as such
79155 roadway is not part of the National System of Interstate and Defense
80156 Highways or a turnpike.

82157 6. Official signs may be erected directing slow -moving traffic
83158 to use a designated lane or designating those lanes to be used by
84159 traffic moving in a particular direction regardless of the center of
85160 the roadway, and drivers of vehicles shall obey the directions of
86161 every such sign.

88162 Any person convicted of violating any provision of th is section
89163 shall be punished as provided for in Secti on 17-101 of this title.
