1647 Telecommunications Act of 1997; modifying
1748 definitions; defining terms; amending Section 3,
1849 Chapter 165, O.S.L. 2020, as amended by Section 1,
1950 Chapter 167, O.S.L. 2020 (17 O.S. Supp. 2020, Section
2051 139.202), which rela tes to the Rural Broadband
2152 Expansion Council; expanding number of Council
2253 members; modifying qualification of certain

98+Section 139.102. As used in the Oklahoma Telecommunications Act
4399 of 1997:

45100 1. "Access line" means the facilities provided and maintained
46-by a telecommunications service provider which permit access to or ENR. H. B. NO. 2090 Page 2
101+by a telecommunications service provider which permit access to or
47102 from the public switched netwo rk or its functional equivalent
48103 regardless of the technol ogy or medium used;

50104 2. "Administrative process" means an administrative application
51105 process which allows eligible local exchange telecommunications
52106 providers and eligible providers to request fundin g and an
53107 administrative submission process that allows Ok lahoma Universal
54108 Service Fund Beneficiaries to submit a preapproval request directly
55109 with the Administrator. Both of the administrative processes shall
56110 not require an order from the Commission to de termine eligibility
57111 for, allocate or disburse funds unles s a request for reconsideration
58112 is filed;

60113 3. "Administrator" means the Director of the Public Utility
61114 Division of the Corporation Commission;

63115 4. "Broadband", as used in Section 139.202 of this titl e, means
64116 those services and underlying facilities that pr ovide access to and
65117 from the Internet of continuous speeds of at least twenty -five (25)
66118 megabits per second (Mbps) downstream, from the provider to the
67119 customer, and continuous speeds of at least thr ee (3) megabits per
68120 second (Mbps) upstream, from the cust omer to the provider, using

70149 wireless, copper wire, fiber optic cable, or coaxial cable, to
71150 provide such service. The minimum Internet sp eeds listed in this
72151 paragraph shall be subject to change or update when, or if, the
73152 Federal Communications Commission makes new rulings related to its
74153 definition of broadband;

76154 5. "Commission" means the Corporation Commission of this state;

78155 5. 6. "Competitive local exchange carrier" or "CLEC" means,
79156 with respect to an area or exchange, a telecommunications service
80157 provider that is certificated by the Commission to provide local
81158 exchange services in that area or exchange within the state after
82159 July 1, 1995;

84160 6. 7. "Competitively neutral" means not advantaging or favoring
85161 one person or technology over another;

87162 7. 8. "Consortium" means, as used in Section 6 139.109.1 of
88163 this act title, two or more Oklahoma Universal Service Fund
89164 Beneficiaries that choose to r equest support under the Federal
90165 Universal Service Suppor t Mechanism or successor program or programs

93167 8. 9. "Contributing providers" means providers, including but
94168 not limited to providers of intrastate telecommunications, providers
95169 of intrastate telecommunications for a fee on a non -common-carrier
96170 basis, providers of wireless telephone service and providers of
97171 interconnected Voice over Internet Protocol (VoIP). Contributing
98172 providers shall contribute to the Oklahoma Universal Service Fund

99200 and Oklahoma Lifeline Fund. VoIP providers shall be assessed only
100201 as provided for in the decision of the Federal Communications
101202 Commission, FCC 10-185, released November 5, 2010, or such other
102203 assessment methodology that is not inconsistent with fede ral law.
103204 Entities exempt from contributing to the Federa l Universal Service
104205 Support Mechanisms are also exempt from contributing to the Oklahoma
105206 Universal Service Fund and Oklahoma Lifeline Fund consistent with 47
106207 C.F.R., Section 54.706(d). The term "con tributing providers" may be
107208 modified to conform to the de finition of contributors as defined by
108209 the FCC if adopted by the Commission, after notice and hearing;
109-
110210 9. 10. "Eligible entity" means any terrestrial Internet service
111211 provider willing to go into uns erved or underserved areas, as
112212 determined by the Broadban d Expansion Council mapping. The eligible
113213 entity shall provide at least the minimum broadband speeds pursuant
114214 to paragraph 4 of this section ;

116215 11. "Eligible healthcare health care entity" means a not-for-
117216 profit hospital, county health department, city -county health
118217 department, not-for-profit mental health and substance abuse
119218 facility or Federally Qualified Health Center in Oklahoma. Eligible
120219 healthcare health care entity shall also include telemedic ine
121220 services provided by the Oklahoma Department of Corre ctions at
122221 facilities identified in Section 509 of Title 57 of the Oklahoma

125250 10. 12. "Eligible local exchange telecommunications service
126251 provider" means ILEC, CLEC and commercial radio mobil e service
127252 provider as those terms are used in the Oklahom a Telecommunications
128253 Act of 1997;

149268 c. involve end-user interaction with information stored

152270 14. 16. "Exchange" means a geographic area established by an
153271 incumbent local exchange telecommunications provider as filed with
154272 or approved by the Commission for the administration of local
155273 telecommunications service in a specified area which usual ly

156301 embraces a city, town, or village and its environs and which may
157302 consist of one or more central offices together with associated
158303 plant used in furnishing telecommunications service in that area;

160304 15. 17. "Facilities" means all the plant and equipment of a
161305 telecommunications service provider, including all tangible and
162306 intangible real and personal property without limitation, and any
163307 and all means and instrumentalities in any manner owned, operated,
164308 leased, licensed, used, controlled, furnished, or suppli ed for, by,
165309 or in connection with the business of any telecommunications service
166310 provider;

168311 16. 18. "Federally Qualified Health Center" or "(FQHC)" means
169312 an entity which:

171313 a. is receiving a grant unde r Section 330 of the Public
172314 Health Service (PHS) Act, 42 U.S.C., Section 254b, or
173315 is receiving funding from a grant under a contract
174316 with the recipient of such a grant and meets the
175317 requirements to receive a grant under Section 330 of
176318 the PHS Act,

178319 b. based on the recommendation of the Health Resources
179320 and Services Administration within the Public Health

186353 Health and Human Services, for purposes of part B of
187354 Section 330 of the PHS Act, as a comprehensive
188355 federally funded health center as of January 1, 1990,

192358 by a tribe or tribal organization under the Indian
193359 Self-Determination Act, 25 U.S.C., Section 450f et
194360 seq., or by an urban Indian organization receiving
195361 funds under Title V of the Indian Health Care
196362 Improvement Act, 25 U.S.C., Section 1651 et seq.;

198363 17. 19. "Federal Universal Service Support Mechanism" is the
199364 support program established by the Telecommunications Act of 1996,
200365 47 U.S.C., Section 254(h). The program includes support for
201366 schools, libraries and healthcare health care providers;

203367 18. 20. "Funding year" means, for purposes of administering the
204368 Oklahoma Universal Service Fund, the period of July 1 through June
205369 30;

207370 19. 21. "High speed Internet access service" or "broadband
208371 service" means, as used in Section 139.110 139.202 of this title,
209372 those services and underlying facilities that provide upstream, from
210373 customer to provider, or downstream, from provider to customer,
211374 transmission to or from the Internet in excess of one hundred fifty
212375 (150) kilobits per second or at a constant download speed of twenty -

213403 five (25) megabits per second (Mbps) and in excess of or at a
214404 constant upload speed of three (3) megabits per second (Mbps) ,
215405 regardless of the technology or medium used , including, but not
216406 limited to, wireless, copp er wire, fiber optic cable, or coaxial
217407 cable, to provide such service;

219408 20. 22. "Hospital" means a healthcare health care entity that
220409 has been granted a license as a hospital by the Oklahoma State
221410 Department of Health for that particular location;

223411 21. 23. "Incumbent local exchange telecommunications service
224412 provider" or "ILEC" means, with respect to an area or exchanges, any
225-telecommunications service provider furnishing local exchange ENR. H. B. NO. 2090 Page 6
413+telecommunications service provider furnishing local exchange
226414 service in such area or exchanges within this state on July 1, 1995,
227415 pursuant to a certificate of convenience and necessity or
228416 grandfathered authority;

230417 22. 24. "Installation charge" means any charge for a
231418 nonrecurring service charged by an eligible provider necessary to
232419 initiate Special Universal Services. Installation char ges may not
233420 exceed the cost which would be charged for in stallation, if the cost
234421 were not being paid for by the OUSF;

236422 23. 25. "Interexchange telecommunications carrier" or "IXC"
237423 means any person, firm, partnership, corporation or other entity,
238424 except an incumbent local exchange telecommunications service
239425 provider, engaged in furnishing regulated interexchange

240453 telecommunications services under the jurisdiction of the
241454 Commission;

243455 24. 26. "Internet" means the international research -oriented
244456 network comprised of business, government, academic and other
245457 networks;

247458 25. 27. "Local exchange telecommunications service" means a
248459 regulated switched or dedicated telecommunications service which
249460 originates and terminates within an exchange or an exchange service
250461 territory. Local exchange telecommunications service may be
251462 terminated by a telecommunications service provider other than the
252463 telecommunications service provider on whose network the call
253464 originated. The local exchange service territory defined in the
254465 originating provider's tariff shall determine whether the call is
255466 local exchange service;

257467 26. 28. "Local exchange telecommunications service provider"
258468 means a company holding a certificate of convenience and necessity
259469 from the Commission to provide local exchange telecommunications
260470 service;

262471 27. 29. "Not-for-profit hospital" means:

264472 a. a hospital located in this state which has been
265473 licensed as a hospital at that location pursuant to
266474 Section 1-701 et seq. of Title 63 of the Oklahoma
267475 Statutes for the diagnosis, trea tment, or care of
268476 patients in order to obtain medical car e, surgical

279513 patients in order to obtain medical care, surgical
280514 care, or obstetrical care;

282515 28. 30. "Not-for-profit mental health and substance abuse
283516 facility" means a facility, not for the sole purpose of
284517 administration, which is operated by the Department of Mental Health
285518 and Substance Abuse Services or a facility certified by the
286519 Department of Mental Health and Substance Abuse Services as a
287520 Community Mental Health Care Center, a Community -Based Structured
288521 Crisis Center or a Community Comprehensive Addiction Recovery
289522 Center;

291523 29. 31. "Oklahoma High Cost Fund" means the fund established b y
292524 the Commission in Cause Nos. PUD 950000117 and 950000119;

294525 30. 32. "Oklahoma Lifeline Fund" or "(OLF)" means the fund
295526 established and required to be implemented by the Commission
296527 pursuant to Section 139.105 of this title;

320573 customers which provides access to other lines for the transmission
321574 of two-way switched or dedicated communication in the local calling
322575 area without additional, usage -sensitive charges, including:

341613 36. 38. "Public library" means a library or library system that
342614 is freely open to all persons under identical conditions and which
343615 is supported in whole or in part by pu blic funds. Public library
344616 shall not include libraries o perated as part of any university,
345617 college, school museum, the Oklahoma Historical Society or county
346618 law libraries;

348619 37. 39. "Public school" means all free schools supported by
349620 public taxation, and s hall include grades prekindergarten through
350621 twelve and technology center schools that provide vocational and
351622 technical instruction for high school students who attend the
352623 technology center school on a tuition -free basis. Public school
353624 shall not include pr ivate schools, home schools or virtual schools;

355625 38. 40. "Regulated telecommunications service" means the
356626 offering of telecommunications for a fee directly to the public
357627 where the rates for such service are regulated by the Commission.

361658 directories, maintenance of inside wire, customer premises
362659 equipment, and billing and collection service, nor does it include
363660 the provision of wireless telephone service, enhanced service, and
364661 other unregulated services, including services not under the
365662 jurisdiction of the Commission, and services determined by the
366663 Commission to be competitive;

368664 41. "Served area" means an area or region with access to
369665 broadband at or above a defined transmission speed threshold as
370666 described in paragraph 4 of this section;

372667 39. 42. "Special Universal Services" means the
373668 telecommunications services su pported by the OUSF which are
374669 furnished to public schools , public libraries and eligible health
375670 care entities as provided for in Section 6 139.109.1 of this act
376671 title;

378672 40. 43. "Tariff" means all or any part of the body of rates,
379673 tolls, charges, classifica tions, and terms and conditions of service
380674 relating to regulated services offered, the conditions under which
381675 offered, and the charges therefor, which have been filed with the
382676 Commission and have become effective;

384677 41. 44. "Telecommunications" means the tr ansmission, between or
385678 among points specified by the user , of information of the user's
386679 choosing, without change in the form or content of the information
387680 as sent and received;

389708 42. 45. "Telecommunications carrier" means a person that
390709 provides telecommunic ations service in this state;

392710 43. 46. "Telecommunications service" means the offering of
393711 telecommunications for a fee;

395712 44. 47. "Telemedicine service" means the practice of health
396713 care delivery, diagnosis, consultation and treatment, including but
397714 not limited to the transfer of medical data or exchange of medic al
398715 education information by means of audio, video or data
399716 communications. Telemedicine service shall not mean a consultation
400717 provided by telephone or facsimile machine;

402718 45. 48. "Underserved area" m eans an area or region that has
403-Internet service at speeds higher than those that meet the ENR. H. B. NO. 2090 Page 10
719+Internet service at speed s higher than those that meet the
404720 definition of an unserved area, but lower than those service speeds
405721 of high-speed Internet;

407722 49. "Universal service area" has the same meaning as the term
408723 "service area" as defined in 47 U.S.C., Section 214(e)(5);

410724 46. 50. "Unserved area" means an area or region in which there
411725 is not at least one provider of terrestrial broadband service that
412726 is either:

414727 a. offering a connection to the Internet, or
415-
416728 b. required, under the terms of the Federal Universal
417729 Service Fund or other federal or state grant, to
418730 provide a connection to the Internet;

421759 scale geographical area. A WAN connects different smaller networks,
422760 including local area networks and metro area networks, which ensures
423761 that computers and users in one location can communicate with
424762 computers and users in other locations;

426763 47. 52. "Wire center" means a geographic area normally served
427764 by a central office; and

429765 48. 53. "Wireless Internet service provider" or "WISP", as used
430766 in Section 2 of this act, means a fixed wireless access provider

517920 regarding existing capability for persons and businesses to access

519922 services from existing service providers, the estimated costs for
520923 improving rural broadband access, the likelihood of changes in rural
521924 broadband access in the near and intermediate future based on
522925 available information regarding private or public sector plans or
523926 programs to create or enhance broadband access in rural areas, the
524927 need for change in state or local law or policy that impacts the
525928 ability for persons or business entities in rural areas to access
526929 broadband services at a reasonable price and such other information
527930 as the Council may determine to be relevant in order to est ablish

6051078 executive branch agencies or other actions in furtherance of the
6061079 mission and duties of the Council. The report shall be submitted to
