14	43		An Act relating to property; amending 60 O.S. 2011,
15	44		Section 674.1, which relates to the limitations on
16	45		service fees for recovering unclaimed funds or
17	46		property; providing requirement for individuals
18	47		claiming funds or property for a deceased claimant

26	55		BE IT ENACTED BY THE PEOPLE OF THE STAT E OF OKLAHOMA:

28	56		SECTION 1. AMENDATORY 60 O.S. 2011, Section 674.1, is
29	57		amended to read as follows:
	58	+	Section 674.1. A. No person who:
	59	+	1. informs Informs a potential claimant of any unclaimed funds
	60	+	or other property, tangible or int angible, held pursuant to the
	61	+	Uniform Disposition of Unclai med Property Act that such claimant may
	62	+	be entitled to claim such unclaimed property; or

41	93		shall contract for or receive from the cl aimant, for services, an
42	94		amount that exceeds twenty -five percent (25%) of the value of the
43	95		funds or property recovered.

45	96		If the funds or property involved are mineral proceeds, the

47	98		minerals or any production payment, overriding royalty, or similar

50	100		In the event that the claimant of such funds or property is
51	101		deceased and did not personally agree to the fee in writing, a fee
52	102		for recovery can only be collected from each identified heir,
53	103		devisee or legatee that has affirmatively agreed to that fee in
54	104		writing.

56	105		B. The provisions of this section shall apply to contracts
57	106		executed on or after July 1, 1990 November 1, 2021.

59	107		SECTION 2. This act shall become effective November 1, 2021.
