40	43		An Act relating to health care; creating the Oklahoma
41	44		Medical Education Protection Ac t; defining terms;
42	45		requiring certain contracted entities to preserve and
43	46		protect reimbursement programs for care of Medicaid
44	47		patients at a certain level; prohibiting certain
45	48		contracted entities from taking actions that reduce
46	49		the number of Medicaid patient s cared for by certain
47	50		entities; providing for contract termination in
48	51		certain circumstances; providing for reimbursement in
49	52		certain cases of contract termination; providing for

56	59		BE IT ENACTED BY THE PEO PLE OF THE STATE OF OKLAHOMA:
57	60		SECTION 1. NEW LAW A new section of law to be codified
58	61		in the Oklahoma Statutes as Section 3229 of Title 63, unless there
59	62		is created a duplication in numbering, reads as follows:
60	63		This act shall be known and may be cited as the "Oklahoma
61	64		Medical Education Protection Act ".
62	65		SECTION 2. NEW LAW A new section of law to be codified
63	66		in the Oklahoma Statutes as Section 3230 of Title 63, unless there
64	67		is created a duplication in numbering, r eads as follows:

	95	+	As used in the Oklahoma Medical Education Protection Act:
92	96		1. "Contracted entity" means any entity entering into a
93	97		contract with the state or one of its constituent agencies for the
94	98		management of Medicaid patients under a managed care cont ract;
95	99		2. "Enhanced reimbursement payment program" means any program
96	100		directly or indirectly funded by or through the state or any of its
97	101		agencies, including but not limited to the Oklahoma Health Care
98	102		Authority, or any agency or department of the federal g overnment,
99	103		including but not limited to the Centers for Medicare and Medicaid
100	104		Services (CMS), for the treatment of Medicaid patients by the health
101		-	care professionals or health care worker s affiliated with ~~the~~
102		-	~~Oklahoma~~ State University Center for Health ~~Sciences~~ or the
103		-	~~University of~~ Oklahoma Health Sciences Center;

	106	+	State University Center for Health Science s or the University of
	107	+	Oklahoma Health Sciences Center;
104	108		3. "Medical Education" means any training program operated by
105	109		the Oklahoma State University Center for Health Sciences or the
106	110		University of Oklahoma Health Sciences Center for the training of
107	111		health care professionals or health care workers;
108	112		4. "Supplemental Payment Program " means any program directly or
109	113		indirectly funded by or through the state or any of its agencies ,
110	114		including but not limited to the Oklahoma Health Care Authority, or
111	115		any agency or department of the federal government, including but
112	116		not limited to the Centers for Medicare and Medicaid Services (CMS),
113	117		for the training of health care professionals or health care

141	146		5. "Teaching hospital", "affiliated hospital", or "hospital
142	147		partner" means any hospital utilized by the Oklahoma State
143	148		University Center for Health Sciences or the University of Oklahoma
144	149		Health Sciences Center for the training of health care professionals
145	150		or health care workers.
146	151		SECTION 3. NEW LAW A new section of law to be codified
147	152		in the Oklahoma Statutes as Section 3231 of Title 63, unless there
148	153		is created a duplication in numbering, reads as follows:
149	154		A. When entering into contract ual arrangements with any entity
150	155		for the management of Me dicaid patients, the state or any agency
151	156		thereof, the Oklahoma Health Care Authority, or any subsequent state
152	157		entity with the authority to reimburse providers for the treatment
153	158		of Medicaid patients shall preserve and protect the supplemental
154	159		payment programs payable to the Oklahoma State University Center for
155	160		Health Sciences or the University of Oklahoma Health Sciences
156	161		Center, their teaching hospitals, affiliated hospitals, and hospital
157	162		partners. Such preservation and protection shall be prescribed at
158	163		the level of reimbursement to be no lower than the highest annual
159	164		aggregate payment within the three (3) years prior to the effective
160	165		date of this act.
161	166		B. When entering into contractual arrangements with any entity
162	167		for the management of Medicaid patients, th e state or any agency
163	168		thereof, the Oklahoma Health Care Authority, or any subsequent state
164	169		entity with the authority to reimburse providers for the treatment

194	200		Health Sciences Center, their teaching hospitals, affiliated
195	201		hospitals, and hospital partners. Such preservation and protection
196	202		shall be prescribed at the level of reimbursement to be no lower
197	203		than the highest annual aggregate payment within the three (3) years
198	204		prior to the effective date of this act.
199	205		SECTION 4. NEW LAW A new section of law to be codified
200	206		in the Oklahoma Statutes as Section 3232 of Title 63, unless there
201	207		is created a duplication in numbering, reads as follows:
202	208		A. When entering into contractual arrangements with any entity
203	209		for the management of Medicaid patients, the state or any agency
204	210		thereof, the Oklahoma Health Care Author ity, or any subsequent state
205	211		entity with the authority to reimburse providers for the treatment
206	212		of Medicaid patients shall preclude the contracted entity from
207	213		taking any action that would directly or indirectly reduce the
208	214		number of Medicaid patients treate d by the Oklahoma State University
209	215		Center for Health Sciences or the University of Oklahoma Health
210	216		Sciences Center, their teaching hospitals, affiliated hospitals, or
211	217		hospital partners.
212	218		B. Any action taken by any entity under contract with the state
213	219		or any agency thereof to manage Medicaid patients that directly or
214	220		indirectly reduces the number of Medicaid patients treated by the

241	248		Oklahoma State University Center for Health Sciences or the
242	249		University of Oklahoma Health Sciences Center, their teaching
243	250		hospitals, affiliated hospitals, or hospital partners shall
244	251		constitute cause for termination of the managed care contract.
245	252		C. Any contract entered into by the state or any agencies
246	253		thereof for the management of Medicaid patients shall provide for
247	254		the reimbursement by the contracted entity for any lost or decreased
248	255		revenues experienced by the Oklahoma State University Center for
249	256		Health Sciences or the University of Oklahoma Health Sciences
250	257		Center, their teaching hospitals, affiliated hospitals, or hospital
251	258		partners as a result of termination pursuant to subsection B of this
252	259		section.
253	260		SECTION 5. It being immediately necessary for the preservation
254	261		of the public peace, health or safety, an emergency is hereby
255	262		declared to exist, by reason whereof this act shall take effect and
256	263		be in full force from and after its passage and approval.
