4043 An Act relating to health care; creating the Oklahoma
4144 Medical Education Protection Ac t; defining terms;
4245 requiring certain contracted entities to preserve and

5659 BE IT ENACTED BY THE PEO PLE OF THE STATE OF OKLAHOMA:
5760 SECTION 1. NEW LAW A new section of law to be codified
5861 in the Oklahoma Statutes as Section 3229 of Title 63, unless there
5962 is created a duplication in numbering, reads as follows:
6063 This act shall be known and may be cited as the "Oklahoma
6164 Medical Education Protection Act ".

95+As used in the Oklahoma Medical Education Protection Act:
9296 1. "Contracted entity" means any entity entering into a
9397 contract with the state or one of its constituent agencies for the
9498 management of Medicaid patients under a managed care cont ract;
9599 2. "Enhanced reimbursement payment program" means any program
96100 directly or indirectly funded by or through the state or any of its
97101 agencies, including but not limited to the Oklahoma Health Care
98102 Authority, or any agency or department of the federal g overnment,
99103 including but not limited to the Centers for Medicare and Medicaid
100104 Services (CMS), for the treatment of Medicaid patients by the health
101-care professionals or health care worker s affiliated with the
102-Oklahoma State University Center for Health Sciences or the
103-University of Oklahoma Health Sciences Center;
105+care professionals or health care worker s affiliated with Oklahoma
106+State University Center for Health Science s or the University of
107+Oklahoma Health Sciences Center;
104108 3. "Medical Education" means any training program operated by
105109 the Oklahoma State University Center for Health Sciences or the
106110 University of Oklahoma Health Sciences Center for the training of
107111 health care professionals or health care workers;
108112 4. "Supplemental Payment Program " means any program directly or
109113 indirectly funded by or through the state or any of its agencies ,
110114 including but not limited to the Oklahoma Health Care Authority, or
111115 any agency or department of the federal government, including but
112116 not limited to the Centers for Medicare and Medicaid Services (CMS),
113117 for the training of health care professionals or health care
114118 workers; and

141146 5. "Teaching hospital", "affiliated hospital", or "hospital
142147 partner" means any hospital utilized by the Oklahoma State
143148 University Center for Health Sciences or the University of Oklahoma
144149 Health Sciences Center for the training of health care professionals
145150 or health care workers.
146151 SECTION 3. NEW LAW A new section of law to be codified
147152 in the Oklahoma Statutes as Section 3231 of Title 63, unless there
148153 is created a duplication in numbering, reads as follows:
149154 A. When entering into contract ual arrangements with any entity
150155 for the management of Me dicaid patients, the state or any agency
151156 thereof, the Oklahoma Health Care Authority, or any subsequent state
152157 entity with the authority to reimburse providers for the treatment
153158 of Medicaid patients shall preserve and protect the supplemental
154159 payment programs payable to the Oklahoma State University Center for
155160 Health Sciences or the University of Oklahoma Health Sciences
156161 Center, their teaching hospitals, affiliated hospitals, and hospital
157162 partners. Such preservation and protection shall be prescribed at
158163 the level of reimbursement to be no lower than the highest annual
159164 aggregate payment within the three (3) years prior to the effective
160165 date of this act.
161166 B. When entering into contractual arrangements with any entity
162167 for the management of Medicaid patients, th e state or any agency
163168 thereof, the Oklahoma Health Care Authority, or any subsequent state
164169 entity with the authority to reimburse providers for the treatment

191197 of Medicaid patients shall preserve and protect the enhanced
192198 reimbursement payment programs payabl e to the Oklahoma State
193199 University Center for Health Sciences or the University of Oklahoma
194200 Health Sciences Center, their teaching hospitals, affiliated
195201 hospitals, and hospital partners. Such preservation and protection
196202 shall be prescribed at the level of reimbursement to be no lower
197203 than the highest annual aggregate payment within the three (3) years
198204 prior to the effective date of this act.
199205 SECTION 4. NEW LAW A new section of law to be codified
200206 in the Oklahoma Statutes as Section 3232 of Title 63, unless there
201207 is created a duplication in numbering, reads as follows:
202208 A. When entering into contractual arrangements with any entity
203209 for the management of Medicaid patients, the state or any agency
204210 thereof, the Oklahoma Health Care Author ity, or any subsequent state
205211 entity with the authority to reimburse providers for the treatment
206212 of Medicaid patients shall preclude the contracted entity from
207213 taking any action that would directly or indirectly reduce the
208214 number of Medicaid patients treate d by the Oklahoma State University
209215 Center for Health Sciences or the University of Oklahoma Health
210216 Sciences Center, their teaching hospitals, affiliated hospitals, or
211217 hospital partners.
212218 B. Any action taken by any entity under contract with the state
213219 or any agency thereof to manage Medicaid patients that directly or
214220 indirectly reduces the number of Medicaid patients treated by the

241248 Oklahoma State University Center for Health Sciences or the
242249 University of Oklahoma Health Sciences Center, their teaching
243250 hospitals, affiliated hospitals, or hospital partners shall
244251 constitute cause for termination of the managed care contract.
245252 C. Any contract entered into by the state or any agencies
246253 thereof for the management of Medicaid patients shall provide for
247254 the reimbursement by the contracted entity for any lost or decreased
248255 revenues experienced by the Oklahoma State University Center for
249256 Health Sciences or the University of Oklahoma Health Sciences
250257 Center, their teaching hospitals, affiliated hospitals, or hospital
251258 partners as a result of termination pursuant to subsection B of this
252259 section.
253260 SECTION 5. It being immediately necessary for the preservation
254261 of the public peace, health or safety, an emergency is hereby
255262 declared to exist, by reason whereof this act shall take effect and
256263 be in full force from and after its passage and approval.
