41	49		amending 19 O.S. 2011, Section 130.7, as amended by
42	50		Section 1, Chapter 103, O.S.L. 2015 (19 O.S. Supp.
43	51		2020, Section 130.7), which relates to county
44	52		government personnel education and training;
45	53		requiring certain hours of training for county
46	54		officers; requiring certain training for county
47	55		officers elected after certain date; requiring
48	56		certain training for current county officers;
49	57		requiring certain continuing education; requiring
50	58		training for county deputies; amending 19 O.S. 2011,
51	59		Section 166, which relates to forfeiture of travel
52	60		allowance; providing for forfeiture of monthly travel
53	61		allowance for failure to complete training
54	62		requirements; requiring written notification;
55	63		providing an effective date; and declaring an
56	64		emergency.

62	69		BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
63	70		SECTION 1. AMENDATORY 19 O.S. 2011, Section 130.7, as
64	71		amended by Section 1, Chapter 103, O.S.L. 2015 (19 O.S. Supp. 2020,
65	72		Section 130.7), is amended to read as follows:
66		-	Section 130.7 A. Each county commissioner, county clerk,
67		-	county treasurer, and court clerk holding office on May 11, 1982
68		-	elected or appointed after November 1, 2021, and those elected

	100	+	Section 130.7 A. Each county commissioner, county clerk,
	101	+	county treasurer, and court clerk holding office on May 11, 1982
	102	+	elected or appointed after November 1, 2021 , and those elected
95	103		thereafter and the deputies of such elected county officers shall be
96	104		required to participate in the appropriate training programs, as
97	105		defined in subsection B of this section, and educational seminars
98	106		relevant to their positions and duties conducted pursuant to
99	107		Sections 130.1 through 130.7 of this title. In addition, county
100	108		sheriffs and county assessors may attend the training programs
101	109		specified in this section , within ninety (90) days after the general
102	110		election of his or her first term of office, to attend and complete
103	111		the orientation training provided through or approved by the County
104	112		Training Program of the Cooperative Extension Service at Oklahoma
105	113		State University.
106	114		B. Appropriate training programs shall include those programs
107	115		provided by the Cooperative Extension Service at Oklahoma State
108	116		University 1. Each county commissioner, cou nty clerk and county
109	117		treasurer elected or appointed after November 1, 2021, shall be
110	118		required to obtain a Basic Certification by the end of his or her
111	119		first term, an Advanced I Certification by the end of his or her
112	120		second term, and an Advanced II Certific ation by the end of his or
113	121		her third term prescribed by and provided through the County
114	122		Training Program of the Cooperative Extension Service at Oklahoma
115	123		State University.
116		-	2. Each county commissioner, county clerk and county treasurer
117		-	holding office on November 1, 2021, shall obtain:

	151	+	2. Each county commissioner, county clerk and county treasurer
	152	+	holding office on No vember 1, 2021, shall obtain:
144	153		a. Basic Certification by November 1, 2025, if still
145	154		holding the same office,
146	155		b. Advanced I Certification by November 1, 2029, if still
147	156		holding the same office, and
148	157		c. Advanced II Certification by November 1, 2033, if
149	158		still holding the same office.
150	159		C. At the discretion of the County Training Program of the
151	160		Cooperative Extension Service at Oklahoma State University, current,
152	161		approved training hours accumulated through previous terms shall
153	162		apply toward Basic, Advanced I and Adva nced II certifications.
154	163		D. 1. Each court clerk elected or appointed after November 1,
155	164		2021, shall complete the required hours to obtain his or her
156	165		certificate through the County Training Program of the Cooperative
157	166		Extension Service at Oklahoma State Univ ersity by the end of his or
158	167		her first term. Each county assessor and county sheriff elected or
159	168		appointed after November 1, 2021, shall obtain his or her
160	169		certificate through the County Training Program of the Cooperative
161	170		Extension Service at Oklahoma State University by the end of his or
162	171		her second term. By discretion of the County Training Program of
163	172		the Cooperative Extension Service at Oklahoma State University,
164	173		current, approved training hours accumulated through previous terms
165	174		shall apply toward certif icate hours.
166		-	2. Court clerks holding office November 1, 2021, shall complete
167		-	the required hours to obtain their certificate through the C ounty

	202	+	2. Court clerks holding office November 1, 2021, shall complete
	203	+	the required hours to obtain their certificate through the County
194	204		Training Program of the Cooperative Extension Service at Oklahoma
195	205		State University by November 1, 2025, if stil l holding the same
196	206		office. Each county assessor and county sheriff holding office on
197	207		November 1, 2021, shall obtain his or her certificate through the
198	208		County Training Program of the Cooperative Extension Service at
199	209		Oklahoma State University by November 1, 2029, if still holding the
200	210		same office. By discretion of the County Training Program of the
201	211		Cooperative Extension Service at Oklahoma State University, current,
202	212		approved training hours accumulated through previous terms shall
203	213		apply toward certificate hou rs.
204	214		E. Upon completion of the requirements in subsections A through
205	215		D of this section, each county commissioner, county clerk, county
206	216		treasurer and county court clerk shall be required to attend six (6)
207	217		hours of continuing education per calendar year thro ugh or approved
208	218		by the County Training Program of the Cooperative Extension Service
209	219		at Oklahoma State University.
210	220		F. The deputies of each elected county officer shall
211	221		participate in the training and educational seminars relevant to
212	222		their positions and dut ies.
213	223		SECTION 2. AMENDATORY 19 O.S. 2011, Section 166, is
214	224		amended to read as follows:
215		-	Section 166. A. Failure of a county officer to attend any
216		-	school, conference or meeting unless excused prior thereto shall
217		-	cause the county officer to forfeit his or her right to the monthly

	252	+	Section 166. A. Failure of a county officer to attend any
	253	+	school, conference or meeting unless excused prior thereto shall
	254	+	cause the county off icer to forfeit his or her right to the monthly
244	255		travel allowance provided by Section 165 of this title for the month
245	256		in which such school, conference or meeting is held. The directing
246	257		state officer or agency head shall notify the county clerk of the
247	258		county of the forfeiture of such county officer.
248	259		B. Any county commissioner, county treasurer, county clerk,
249	260		county sheriff or county court clerk who fails to complete the
250	261		training requirements as outlined in Section 130.7 of this title
251	262		shall, but not limited to, forfeit his or her right to receive the
252	263		monthly travel allowance provided by Section 165 of this title or
253	264		any other penalties authorized by law.
254	265		C. The County Training Program Director of the Cooperative
255	266		Extension Service at Oklahoma State University shall send written
256	267		notification of noncompliance to the county clerk of the county, the
257	268		board of county commissioners and the State Auditor and Inspector.
258	269		Upon such notification, the board of county commissioners shall not
259	270		approve payment of the monthly travel allowance for said county
260	271		officer. The monthly travel allowance may be reinstated the
261	272		following month once the county officer becomes compliant with the
262	273		training requirements. The County Training Program Director of the
263		-	Cooperative Extension Service at Oklahoma State University shall
264		-	send written notification to the county clerk of the county, the
265		-	board of county commissioners and th e State Auditor and Inspector
266		-	when a county officer reestablishes compliance with the training
267		-	requirements.

	303	+	the State Auditor and Inspector when a county officer reestablishes
	304	+	compliance with the training requirements.
294	305		D. Any county, county officer or dep uty may join his or her
295	306		respective state, national or international association, including
296	307		but not limited to, the National Association of Counties, the
297	308		International Association of Assessors and the International
298	309		Association of Clerks, Recorders, Election Officials and Treasurers.
299	310		It shall not be mandatory for a county officer or his or her deputy
300	311		to attend any meeting, school, institute or conference sponsored or
301	312		held by anyone other than a state officer or agency head, but if
302	313		funds are available for tra vel to such meeting, school, institute or
303	314		conference, either within or outside this state, from funds
304	315		appropriated for traveling expenses in addition to the monthly
305	316		travel allowance provided by Section 165 of this title, then it
306	317		shall be lawful for such tr aveling expenses to be paid from such
307	318		travel funds so appropriated to the county officer or his or her
308	319		deputies.
309	320		SECTION 3. This act shall become effective July 1, 2021.
310	321		SECTION 4. It being immediately necessary for the pr eservation
311	322		of the public peace, health or safety, an emergency is hereby
312	323		declared to exist, by reason whereof this act shall take effect and
313	324		be in full force from and after its passage and approval.
