4048 An Act relating to countie s and county officers;
4149 amending 19 O.S. 2011, Section 130.7, as amended by

6269 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
6370 SECTION 1. AMENDATORY 19 O.S. 2011, Section 130.7, as
6471 amended by Section 1, Chapter 103, O.S.L. 2015 (19 O.S. Supp. 2020,
6572 Section 130.7), is amended to read as follows:
66-Section 130.7 A. Each county commissioner, county clerk,
67-county treasurer, and court clerk holding office on May 11, 1982
68-elected or appointed after November 1, 2021, and those elected

100+Section 130.7 A. Each county commissioner, county clerk,
101+county treasurer, and court clerk holding office on May 11, 1982
102+elected or appointed after November 1, 2021 , and those elected
95103 thereafter and the deputies of such elected county officers shall be
96104 required to participate in the appropriate training programs, as
97105 defined in subsection B of this section, and educational seminars
98106 relevant to their positions and duties conducted pursuant to
99107 Sections 130.1 through 130.7 of this title. In addition, county
100108 sheriffs and county assessors may attend the training programs
101109 specified in this section , within ninety (90) days after the general
102110 election of his or her first term of office, to attend and complete
103111 the orientation training provided through or approved by the County
104112 Training Program of the Cooperative Extension Service at Oklahoma
105113 State University.
106114 B. Appropriate training programs shall include those programs
107115 provided by the Cooperative Extension Service at Oklahoma State
108116 University 1. Each county commissioner, cou nty clerk and county
109117 treasurer elected or appointed after November 1, 2021, shall be
110118 required to obtain a Basic Certification by the end of his or her
111119 first term, an Advanced I Certification by the end of his or her
112120 second term, and an Advanced II Certific ation by the end of his or
113121 her third term prescribed by and provided through the County
114122 Training Program of the Cooperative Extension Service at Oklahoma
115123 State University.
116-2. Each county commissioner, county clerk and county treasurer
117-holding office on November 1, 2021, shall obtain:

151+2. Each county commissioner, county clerk and county treasurer
152+holding office on No vember 1, 2021, shall obtain:
144153 a. Basic Certification by November 1, 2025, if still
145154 holding the same office,
146155 b. Advanced I Certification by November 1, 2029, if still
147156 holding the same office, and
148157 c. Advanced II Certification by November 1, 2033, if
149158 still holding the same office.
150159 C. At the discretion of the County Training Program of the
151160 Cooperative Extension Service at Oklahoma State University, current,
152161 approved training hours accumulated through previous terms shall
153162 apply toward Basic, Advanced I and Adva nced II certifications.
154163 D. 1. Each court clerk elected or appointed after November 1,
155164 2021, shall complete the required hours to obtain his or her
156165 certificate through the County Training Program of the Cooperative
157166 Extension Service at Oklahoma State Univ ersity by the end of his or
158167 her first term. Each county assessor and county sheriff elected or
159168 appointed after November 1, 2021, shall obtain his or her
160169 certificate through the County Training Program of the Cooperative
161170 Extension Service at Oklahoma State University by the end of his or
162171 her second term. By discretion of the County Training Program of
163172 the Cooperative Extension Service at Oklahoma State University,
164173 current, approved training hours accumulated through previous terms
165174 shall apply toward certif icate hours.
166-2. Court clerks holding office November 1, 2021, shall complete

202+2. Court clerks holding office November 1, 2021, shall complete
203+the required hours to obtain their certificate through the County
194204 Training Program of the Cooperative Extension Service at Oklahoma
195205 State University by November 1, 2025, if stil l holding the same
196206 office. Each county assessor and county sheriff holding office on
197207 November 1, 2021, shall obtain his or her certificate through the
198208 County Training Program of the Cooperative Extension Service at
199209 Oklahoma State University by November 1, 2029, if still holding the
200210 same office. By discretion of the County Training Program of the
201211 Cooperative Extension Service at Oklahoma State University, current,
202212 approved training hours accumulated through previous terms shall
203213 apply toward certificate hou rs.
204214 E. Upon completion of the requirements in subsections A through
205215 D of this section, each county commissioner, county clerk, county
206216 treasurer and county court clerk shall be required to attend six (6)
207217 hours of continuing education per calendar year thro ugh or approved
208218 by the County Training Program of the Cooperative Extension Service
209219 at Oklahoma State University.
210220 F. The deputies of each elected county officer shall
211221 participate in the training and educational seminars relevant to
212222 their positions and dut ies.
213223 SECTION 2. AMENDATORY 19 O.S. 2011, Section 166, is
214224 amended to read as follows:
215-Section 166. A. Failure of a county officer to attend any

252+Section 166. A. Failure of a county officer to attend any
253+school, conference or meeting unless excused prior thereto shall
254+cause the county off icer to forfeit his or her right to the monthly
244255 travel allowance provided by Section 165 of this title for the month
245256 in which such school, conference or meeting is held. The directing
246257 state officer or agency head shall notify the county clerk of the
247258 county of the forfeiture of such county officer.
248259 B. Any county commissioner, county treasurer, county clerk,
249260 county sheriff or county court clerk who fails to complete the
250261 training requirements as outlined in Section 130.7 of this title
251262 shall, but not limited to, forfeit his or her right to receive the
252263 monthly travel allowance provided by Section 165 of this title or
253264 any other penalties authorized by law.
254265 C. The County Training Program Director of the Cooperative
255266 Extension Service at Oklahoma State University shall send written
256267 notification of noncompliance to the county clerk of the county, the
257268 board of county commissioners and the State Auditor and Inspector.
258269 Upon such notification, the board of county commissioners shall not
259270 approve payment of the monthly travel allowance for said county
260271 officer. The monthly travel allowance may be reinstated the
261272 following month once the county officer becomes compliant with the
262273 training requirements. The County Training Program Director of the
263-Cooperative Extension Service at Oklahoma State University shall
264-send written notification to the county clerk of the county, the
265-board of county commissioners and th e State Auditor and Inspector
266-when a county officer reestablishes compliance with the training
267-requirements.

303+the State Auditor and Inspector when a county officer reestablishes
304+compliance with the training requirements.
294305 D. Any county, county officer or dep uty may join his or her
295306 respective state, national or international association, including
296307 but not limited to, the National Association of Counties, the
297308 International Association of Assessors and the International
298309 Association of Clerks, Recorders, Election Officials and Treasurers.
299310 It shall not be mandatory for a county officer or his or her deputy
300311 to attend any meeting, school, institute or conference sponsored or
301312 held by anyone other than a state officer or agency head, but if
302313 funds are available for tra vel to such meeting, school, institute or
303314 conference, either within or outside this state, from funds
304315 appropriated for traveling expenses in addition to the monthly
305316 travel allowance provided by Section 165 of this title, then it
306317 shall be lawful for such tr aveling expenses to be paid from such
307318 travel funds so appropriated to the county officer or his or her
308319 deputies.
309320 SECTION 3. This act shall become effective July 1, 2021.
310321 SECTION 4. It being immediately necessary for the pr eservation
311322 of the public peace, health or safety, an emergency is hereby
312323 declared to exist, by reason whereof this act shall take effect and
313324 be in full force from and after its passage and approval.
