39	39	An Act relating to public health and safety;
40	40	directing the Department of Public Safety to develop,
41	41	print and distribute carbon monoxide war ning decals
42	42	and related instructions; directing the Department to
43	43	distribute decals and related instructions to the
44	44	Oklahoma Tax Commission; requiring the Department to
45	45	provide decals and related instructions to the public
46	46	free of charge; directing the Oklahoma Tax Commission
47	47	to mail decals and instructions under certain
48	48	circumstances; requiring warning decals on new and
49	49	used motors and vessels sold in the state; directing
50	50	new and used motor and vessel dealers to ensure
51	51	decals have been affixed to motors an d vessels;
52	52	recognizing decals developed by manufacturers and
53	53	approved by the Department of Public Safety; allowing
54	54	owners of motors and vessels to request de cals;
55	55	providing for codification; and providing an
56	56	effective date.

62	62	BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
63	63	SECTION 1. NEW LAW A new section of law to be codified
64	64	in the Oklahoma Statutes as Section 4223 of Title 63, unless there
65	65	is created a duplication in numbering, reads as follows:
66	66	A. The Department of Public Safety shall:
67	67	1. Develop, print and distribute carbon monoxide warning decals
68	68	that have been approved by the United States Coast Guard;

95	95	2. Develop, print and distribute instructions for affixing the
96	96	carbon monoxide warning decals on motors and vessels;
97	97	3. Provide carbon monoxide warning decals and related
98	98	instructions to the Oklahoma Tax Commission to be distributed by the
99	99	Commission upon approval and issuance of an original certificate of
100	100	title for a motor or vessel or whenever a certificate of title for a
101	101	motor or vessel is transferred; and
102	102	4. Provide, free of charge and upon request by the public,
103	103	carbon monoxide warning decals and related instructions.
104	104	B. Upon approving and issuing an original certificate of title
105	105	for a motor or vessel or when approving a request to transfer a
106	106	certificate of title, t he Oklahoma Tax Commission shall mail with
107	107	the certificate of title a carbon monoxide warning decal and related
108	108	instructions.
109	109	C. A new or used motor or vessel, as defined in Section 4002 of
110	110	Title 63 of the Oklahoma Statu tes, other than personal watercraft,
111	111	as defined in Section 4201 of Title 63 of the Oklahoma Statutes,
112	112	sold within this state shall display a carbon monoxide warning
113	113	decal.
114	114	D. A new or used motor or vessel dealer shall ensure th at a
115	115	carbon monoxide warning decal has been affixed to any motor or
116	116	vessel sold by the dealer before completing the sale of said motor
117	117	or vessel.

144	144	E. A carbon monoxide warning decal previously developed by a
145	145	manufacturer of motors or vessels satisfies the requirements of this
146	146	section if the decal has been approved by the Department of Public
147	147	Safety.
148	148	F. If a carbon monoxide warning decal has not previously been
149	149	affixed to a motor or vessel by the manufacturer or dealer, the
150	150	owner of a motor or vessel may request a carbon monoxide warning
151	151	decal from the Department of Public Safety and affix the decal
152	152	pursuant to the instructions provided by the Department .
153	153	SECTION 2. This act shall become effective November 1, 2021.
