3939 An Act relating to public health and safety;
4040 directing the Department of Public Safety to develop,

4242 and related instructions; directing the Department to
4343 distribute decals and related instructions to the
4444 Oklahoma Tax Commission; requiring the Department to
4545 provide decals and related instructions to the public
4646 free of charge; directing the Oklahoma Tax Commission
4747 to mail decals and instructions under certain
4848 circumstances; requiring warning decals on new and
4949 used motors and vessels sold in the state; directing
5050 new and used motor and vessel dealers to ensure
5151 decals have been affixed to motors an d vessels;
5252 recognizing decals developed by manufacturers and
5353 approved by the Department of Public Safety; allowing
5454 owners of motors and vessels to request de cals;
5555 providing for codification; and providing an
5656 effective date.

6262 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
6363 SECTION 1. NEW LAW A new section of law to be codified
6464 in the Oklahoma Statutes as Section 4223 of Title 63, unless there
6565 is created a duplication in numbering, reads as follows:
6666 A. The Department of Public Safety shall:
6767 1. Develop, print and distribute carbon monoxide warning decals
6868 that have been approved by the United States Coast Guard;

9595 2. Develop, print and distribute instructions for affixing the
9696 carbon monoxide warning decals on motors and vessels;
9797 3. Provide carbon monoxide warning decals and related
9898 instructions to the Oklahoma Tax Commission to be distributed by the
9999 Commission upon approval and issuance of an original certificate of
100100 title for a motor or vessel or whenever a certificate of title for a
101101 motor or vessel is transferred; and
102102 4. Provide, free of charge and upon request by the public,
103103 carbon monoxide warning decals and related instructions.
104104 B. Upon approving and issuing an original certificate of title
105105 for a motor or vessel or when approving a request to transfer a
106106 certificate of title, t he Oklahoma Tax Commission shall mail with
107107 the certificate of title a carbon monoxide warning decal and related
108108 instructions.
109109 C. A new or used motor or vessel, as defined in Section 4002 of
110110 Title 63 of the Oklahoma Statu tes, other than personal watercraft,
111111 as defined in Section 4201 of Title 63 of the Oklahoma Statutes,
112112 sold within this state shall display a carbon monoxide warning
113113 decal.
114114 D. A new or used motor or vessel dealer shall ensure th at a
115115 carbon monoxide warning decal has been affixed to any motor or
116116 vessel sold by the dealer before completing the sale of said motor
117117 or vessel.

144144 E. A carbon monoxide warning decal previously developed by a
145145 manufacturer of motors or vessels satisfies the requirements of this
146146 section if the decal has been approved by the Department of Public
147147 Safety.
148148 F. If a carbon monoxide warning decal has not previously been
149149 affixed to a motor or vessel by the manufacturer or dealer, the
150150 owner of a motor or vessel may request a carbon monoxide warning
151151 decal from the Department of Public Safety and affix the decal
152152 pursuant to the instructions provided by the Department .
153153 SECTION 2. This act shall become effective November 1, 2021.
