HOUSE BILL 2373 	By: Davis 
 
 
 
 
AS INTRODUCED 
 
An Act relating to public health and safety; 
directing the Department of Public Safety to develop, 
print and distribute carbon monoxide war ning decals 
and related instructions; directing the Department to 
distribute decals and related instructions to the 
Oklahoma Tax Commission; requiring the Department to 
provide decals and related instructions to the public 
free of charge; directing the Oklahoma Tax Commission 
to mail decals and instructions under certain 
circumstances; requiring warning decals on new and 
used motors and vessels sold in the state; directing 
new and used motor and vessel dealers to ensure 
decals have been affixed to motors an d vessels;  
recognizing decals developed by manufacturers and 
approved by the Department of Public Safety; allowing 
owners of motors and vessels to request de cals; 
providing for codification; and providing an 
effective date. 
 
 
 
 
 
BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA: 
SECTION 1.     NEW LAW     A new section of law to be codified 
in the Oklahoma Statutes as Section 4223 of Title 63, unless there 
is created a duplication in numbering, reads as follows: 
A.  The Department of Public Safety shall: 
1.  Develop, print and distribute carbon monoxide warning decals 
that have been approved by the United States Coast Guard;

2. Develop, print and distribute instructions for affixing the 
carbon monoxide warning decals on motors and vessels; 
3.  Provide carbon monoxide warning decals and related 
instructions to the Oklahoma Tax Commission to be distributed by the 
Commission upon approval and issuance of an original certificate of 
title for a motor or vessel or whenever a certificate of title for a 
motor or vessel is transferred; and 
4.  Provide, free of charge and upon request by the public, 
carbon monoxide warning decals and related instructions. 
B. Upon approving and issuing an original certificate of title 
for a motor or vessel or when approving a request to transfer a 
certificate of title, t he Oklahoma Tax Commission shall mail with 
the certificate of title a carbon monoxide warning decal and related 
instructions. 
C.  A new or used motor or vessel, as defined in Section 4002 of 
Title 63 of the Oklahoma Statu tes, other than personal watercraft, 
as defined in Section 4201 of Title 63 of the Oklahoma Statutes, 
sold within this state shall display a carbon monoxide warning 
decal. 
D.  A new or used motor or vessel dealer shall ensure th at a 
carbon monoxide warning decal has been affixed to any motor or 
vessel sold by the dealer before completing the sale of said motor 
or vessel.

E.  A carbon monoxide warning decal previously developed by a 
manufacturer of motors or vessels satisfies the requirements of this 
section if the decal has been approved by the Department of Public 
Safety. 
F.  If a carbon monoxide warning decal has not previously been 
affixed to a motor or vessel by the manufacturer or dealer, the 
owner of a motor or vessel may request a carbon monoxide warning 
decal from the Department of Public Safety and affix the decal 
pursuant to the instructions provided by the Department . 
SECTION 2.  This act shall become effective November 1, 2021.
