1948 O.S. Supp. 2020, Section 6 -102), which relates to

2857 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:

3058 SECTION 1. AMENDATORY Section 142, Chapter 366, O.S.L.
3159 2016, as last amended by Section 20, Chapter 161, O.S.L. 2020 (37A
3260 O.S. Supp. 2020, Section 6 -102), is amended to read as follows :

3461 Section 6-102. A. No licensee of the ABLE Commiss ion shall:

3662 1. Receive, possess or sell any alcoholic beverage except as
3763 authorized by the Oklahoma Alcoholic Beverage Control Act and by the
3864 license or permit which the licensee holds;

4092 2. Employ any person under eighteen (18) years of age in the
4193 selling of beer or wine or employ any person under twenty -one (21)
4294 years of age in the selling of spirits. Provided:

4495 a. a mixed beverage, beer and wine, caterer, public
4596 event, special event, bottle club, retail wine or

4798 clerks who are at least eighteen (18) years of age,
4899 except persons under twenty -one (21) years of age may

51101 b. a mixed beverage, beer and wine, caterer , public
52102 event, special event or bottle club licensee may
53103 employ or hire musical bands who have musicians who
54104 are under eighteen (18) years of age if each such
55105 musician is either accompanied by a parent or legal
56106 guardian or has on their person, to be made available
57107 for inspection upon demand by any employee of the ABLE
58108 Commission or law enforcement officer, a written,
59109 notarized affidavit from the parent or legal guardian
60110 giving the underage musician permission to perform in
61111 designated bar or lounge areas;

63112 3. Give any alcoholic beverage as a prize, premium or
64113 consideration for any lottery, game of chance or skill or any type
65114 of competition;

67142 4. Use any of the following means or inducements to stimulate
68143 the consumption of alcoholic beverages, including but no t limited
69144 to:

71145 a. deliver more than two drinks to one person at one
72146 time, except as provided for serving tasting flights
73147 defined in Section 2 6-102.1 of this act title,

75148 b. sell or offer to sell to any person or group of
76149 persons any drinks at a price that is less than six
77150 percent (6%) below the markup of the c ost to the mixed
78151 beverage licensee; provided, a mixed beverage licensee
79152 shall be permitted to offer these drink specials on
80153 any particular hour of any particular day and shall
81154 not be required to offer th ese drink specials for an
82155 entire calendar week or fro m open to close,

84156 c. sell or offer to sell to any person an unlimited
85157 number of drinks during any set period of time for a
86158 fixed price, except at private functions not open to
87159 the public,
88-
89160 d. sell or offer to sell drinks to any person or group of
90161 persons on any one day or portion thereof at prices

95192 e. increase the volume of alcoholic beverages containe d
96193 in a drink without increasing proportionately the
97194 price regularly charged for such drink during the same
98195 calendar week, or

100196 f. encourage or permit, on the licensed premises, any
101197 game or contest which involves drinking or the
102198 awarding of drinks as prizes.

104199 Provided, that the provisions of this paragraph shall not
105200 prohibit the advertising or offering of food or entertainment in
106201 licensed establishments;
107-
108202 5. Permit or allow any patron or person to exit the licensed
109203 premises with an open container of any alcohol ic beverage.
110204 Provided, this prohibition shall not be applicable to closed
111205 original containers of alcoholic beverages which are carried from
112206 the licensed premises of a bottle club by a patron, closed original
113207 wine containers removed from the premises of re staurants, hotels and
114208 motels, or to closed original c ontainers of alcoholic beverages
115209 transported to and from the place of business of a licensed caterer
116210 by the caterer or an employee of the caterer;
117-
118211 6. Serve or sell alcoholic beverages with an expired li cense
119212 issued by the ABLE Commission; or

121213 7. Permit any person to be drunk or intoxicated on the
122214 licensee's licensed premises ; or

124242 8. Permit or allow any patron to serve or pour himself or
125243 herself any alcoholic beverage, except a licensee may offer a patron
126244 self-pour service of beer or wine, or both, from aut omated devices
127245 on licensed premises so long as:

129246 a. the licensee monitors and has the ability to control
130247 the dispensing of such beer or wine, or both, from the
131248 automated devices. "Automated device" shall mean any
132249 mechanized device capable of dispensing win e or beer,
133250 or both, directly to a patron in exchange for
134251 compensation that a licensee has received directly
135252 from the patron, and

137253 b. each licensee offering a patron self -pour service of
138254 wine or beer, or both, from any automated device shall
139255 provide constant video monitoring of the automated
140256 device at all times during which the licensee is open
141257 to the public. The licensee shall keep recorded
142258 footage from the video monitoring for at least sixty
143259 (60) days, and shall provide the footage, upon
144260 request, to any agent of the Director of the ABLE
145261 Commission or other authorized law enforcement agent.

147262 B. 1. The compensation required by subparagraph a of paragraph
148263 8 of subsection A of this section shall be in the fo rm of a radio
149264 frequency identification (RFID) device, mobile application or any
150265 other technology approved by the ABLE Commission containing a fixed

153295 dispensed from the automated dev ice:

155296 a. RFID devices may be assigned, used or reactivated only
156297 during a business day,

158298 b. each RFID device shall be obtained from the licensee
159299 by a patron,

161300 c. a licensee shall not issue more than one acti ve RFID
162301 device to a patron, and

164-d. an RFID device shall be deemed active if the RFID

165303 device contains volume credit or has not yet been used
166304 to dispense ten (10) ounces of wine or thirty -two (32)
167305 ounces of beer.

169306 2. In order to obtain a n RFID device from a l icensee, each
170307 patron shall produce a valid driver lic ense, identification card or
171308 other government-issued document that contains a photograph of the
172309 individual and demonstrates that the individual is at least twenty -
173310 one (21) years of age. Each RFID device shall be programmed to
174311 require the production of the patron's valid identification before
175312 the RFID device can be used for the first time during any business
176313 day or for any subsequent reactivation.

178314 3. Each RFID device shall become inactive at the end of each
179315 business day.

181343 4. Each RFID device shall be prog rammed to allow the dispensing
182344 of no more than ten (10) ounces of wine or thirty -two (32) ounces of
183345 beer to a patron:

185-a. once an RFID device has been used to dispense ten (10)
346+a. once a RFID device has been used to dispense ten (10)
186347 ounces of wine or thirty -two (32) ounces of beer to a
187348 patron, the RFID device sha ll become inactive, and

189349 b. any patron in possession of an inactive RFID device
190350 may, upon production of the patron's valid
191351 identification to the licensee or licensee's employee,
192352 have the RFID device react ivated to allow the
193353 dispensing of an additional ten ( 10) ounces of wine or
194354 thirty-two (32) ounces of beer from an automated
195355 device.

197356 Paragraphs 1, 2, 3 and 4 of this subsection shall not apply to wine
198357 or beer that is dispensed directly to the licensee or th e licensee's
199358 agent or employee.

201359 B. C. A mixed beverage or beer and wine licensee shall not be
202360 deemed to have violated the provisions of paragraph 5 of subsection
203361 A of this section if it allowed a patron to leave the licensed
204362 premises with an open containe r of beer or wine only and:

206363 1. The otherwise prohibi ted act was committed during the hours
207364 of 8 a.m. to midnight on the day of a scheduled home football game
208365 of institutions within The Oklahoma State System of Higher

209393 Education, and the establishment is lo cated within two thousand
210394 (2,000) feet of the institu tion;

212395 2. The licensee is participating by invitation in a municipally
213396 sanctioned art, music or sporting event within city limits when the
214397 municipality has provided written notice of the event and a list of
215398 invited licensees to the ABLE Commission at least five (5) days
216399 prior to the event; or
217-
218400 3. The patron remains on the connected, physical property of
219401 the licensee or in a public area adjacent to the physical property
220402 of the licensee with prior municipal approval; provided that written
221403 notice of the use of the connected, physical property of the
222404 licensee or public area shall be provided to the ABLE Commission at
223405 least five (5) days prior to such use.
