52	52	BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
53	53	SECTION 1. NEW LAW A new section of law to be codified
54	54	in the Oklahoma Statutes as Section 42.1 of Title 85A, unless there
55	55	is created a duplication in numbering, reads as follows:
56	56	As used in this act:
57	57	1. "Work-based learning coordinator" mean s a teacher, as
58	58	defined by Section 6 -101.3 of Title 70 of the Oklahoma Statutes, who
59	59	coordinates and supervises students in work -based learning
60	60	placements;
61	61	2. "Work-based learning employer" means an employer who
62	62	provides work-based learning placements;

89	89	3. "Work-based learning placement" or "placement" means an
90	90	arrangement between a business or industry partner and a local
91	91	school system in which students are released for a portion of the
92	92	school day for structured learning at an employer's job site in
93	93	either a paid or unpaid position while receiving academic credit.
94	94	Work-based learning placements include, but are not limited to,
95	95	employability skill development, service learning, cooperative
96	96	education, internship, youth apprenticeship, and clinical
97	97	experiences; and
98	98	4. "Work-based learning student" means a student sixteen (16)
99	99	years of age or older in a work -based learning placement for an
100	100	employer.
101	101	SECTION 2. NEW LAW A new section of law to be codified
102	102	in the Oklahoma Statutes as Secti on 42.2 of Title 85A, unless there
103	103	is created a duplication in numbering, reads as follows:
104	104	A. For each policy of workers' compensation insurance issued or
105	105	renewed in this state on or after November 1, 2021 , there may be
106	106	granted by the insurer a reduction in the premium for such policy,
107	107	not to exceed five percent (5%), if the insured has been certified
108	108	by the State Board of Career and Technology Education to the
109	109	Administrative Workers' Compensation Commission as a work -based
110	110	learning employer pursuant to S ection 3 of this act and has notified
111	111	its insurer in writing of such certification.

138	138	B. If granted, the premium discount provided by this section
139	139	may be applied to an insured's policy of workers' compensation
140	140	insurance at the discretion of the insured's in surer pro rata as of
141	141	the date the insured receives such certification and shall continue
142	142	for as long as the insured maintains the certification; provided,
143	143	however, that an insurer shall not be required to credit the actual
144	144	amount of the premium discount to the account of the insured until
145	145	the final premium audit under such policy. Certification of an
146	146	insured shall be required for each year in which a premium discount
147	147	is granted.
148	148	C. If it is determined that an insured misrepresented its
149	149	qualifications for certification pursuant to Section 3 of this act,
150	150	the workers' compensation insurance policy of such insured may be
151	151	subject to an additional premium for the purposes of reimbursement
152	152	of a previously granted premium discount and to cancellation in
153	153	accordance with the provisions of the policy.
154	154	D. Each insurer, at the discretion of the insured's insurer if
155	155	granting a premium reduction, shall make an annual report, in
156	156	accordance with rules promulgated by the Insurance Commissioner, to
157	157	the Insurance Commissioner illustrating the total dollar amount of
158	158	the premium discounts applied pursuant to this section.
159	159	E. The Insurance Commissioner and the State Board of Career and
160	160	Technology Education shall conduct a study to determine the impact
161	161	of the premium discounts pr ovided pursuant to this section in

188	188	encouraging employers to provide work -based learning opportunities
189	189	for students sixteen (16) years of age or older.
190	190	F. The Insurance Commissioner shall be authorized to promulgate
191	191	rules necessary for the implementation a nd enforcement of this
192	192	section.
193	193	SECTION 3. NEW LAW A new section of law to be codified
194	194	in the Oklahoma Statutes as Section 42.3 of Title 85A, unless there
195	195	is created a duplication in numbering, reads as follows:
196	196	A. A work-based learning employer that has been certified
197	197	pursuant to this section may be eligible for a premium discount
198	198	under the employer's workers' compensation insurance policy pursuant
199	199	to Section 2 of this act if the State Board of Career and Technology
200	200	Education certifies to the Administrative Workers' Compensation
201	201	Commission and the Insurance Commissioner that the work -based
202	202	learning employer:
203	203	1. Has entered into a training agreement with one or more work -
204	204	based learning students, the student's parent or guardian, and the
205	205	school's work-based learning coordinator;
206	206	2. Has developed, in conjunction with the school's work -based
207	207	learning coordinator, a detailed training plan for the work -based
208	208	learning student that focuses on development of technical skills and
209	209	employability skills;

236	236	3. Assigns a mentor to each work -based learning student and
237	237	assists in monitoring the progress of the student; provided, a
238	238	mentor may be assigned to more than one student;
239	239	4. Provides workers' compensation insurance coverage for each
240	240	work-based learning student;
241	241	5. Complies with all federal, state, and local laws and
242	242	regulations regarding the employment of students; and
243	243	6. Complies with the rules of the State Board of Career and
244	244	Technology Education regarding work -based learning placement.
245	245	B. A self-insured employer or an employer member of a group
246	246	self-insurance association that provides work -based learning
247	247	placements for one or more work -based learning students
248	248	substantially in accordance with this section may be certified by
249	249	the State Board of Career and Technology Education to the Insurance
250	250	Commissioner and the Administrative Workers' Compensation Commission
251	251	as a work-based learning employer in compliance with this act.
252	252	SECTION 4. This act shall become effective November 1 , 2021.
