3461 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:

3662 SECTION 1. NEW LAW A new section of law to be codified
3763 in the Oklahoma Statutes as Section 1-731.3 of Title 63, unless
3864 there is created a du plication in numbering, reads as follows:

4065 A. No person shall perform or induce an abortion upon a
4166 pregnant woman without first detecting whether or not her unborn
4267 child has a heartbeat. No pers on shall perform or induce an

4496 has been determined to have a detectable heart beat except if, in
4597 reasonable medical judgment, she has a condition that so complicates

98+her medical condition tha t it necessitates the abortion of her
4799 pregnancy to avert her death or to avert serious risk of substantial
48100 and irreversible physical impairment of a major bodily function, not
49101 including psychological or emo tional conditions. No such condition
50102 may be determined to exist if it is based on a claim or diagnosis
51103 that the woman will engage in conduct which she intends to result in
52104 her death or in substantial and irreversible physical impairment of
53105 a major bodily function.

55106 B. A "detectable heartbeat " shall mean embryonic or fetal
56107 cardiac activity or the steady or repetiti ve rhythmic contract of
57108 the heart within the gestational sac.

59109 C. "Reasonable medical judgment " means a medical judgment that
60110 would be made by a reasonably prudent physician, knowledgeable about
61111 the case and the treatment possibilities with respect to the medical
62112 conditions involved.

64113 D. Any person violating subsection A of this section shall be
65114 guilty of homicide.

67115 SECTION 2. This act shall become effective November 1, 2021.
