34	61		BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:

36	62		SECTION 1. NEW LAW A new section of law to be codified
37	63		in the Oklahoma Statutes as Section 1-731.3 of Title 63, unless
38	64		there is created a du plication in numbering, reads as follows:

40	65		A. No person shall perform or induce an abortion upon a
41	66		pregnant woman without first detecting whether or not her unborn
42	67		child has a heartbeat. No pers on shall perform or induce an
43	68		abortion upon a pregnant woman after such time as her unborn child

44	96		has been determined to have a detectable heart beat except if, in
45	97		reasonable medical judgment, she has a condition that so complicates
46		-	her medical ~~conditio n that~~ it necessitates the abortion of her ~~ENR. H. B. NO. 2441 Page 2~~
	98	+	her medical condition tha t it necessitates the abortion of her
47	99		pregnancy to avert her death or to avert serious risk of substantial
48	100		and irreversible physical impairment of a major bodily function, not
49	101		including psychological or emo tional conditions. No such condition
50	102		may be determined to exist if it is based on a claim or diagnosis
51	103		that the woman will engage in conduct which she intends to result in
52	104		her death or in substantial and irreversible physical impairment of
53	105		a major bodily function.

55	106		B. A "detectable heartbeat " shall mean embryonic or fetal
56	107		cardiac activity or the steady or repetiti ve rhythmic contract of
57	108		the heart within the gestational sac.

59	109		C. "Reasonable medical judgment " means a medical judgment that
60	110		would be made by a reasonably prudent physician, knowledgeable about
61	111		the case and the treatment possibilities with respect to the medical
62	112		conditions involved.

64	113		D. Any person violating subsection A of this section shall be
65	114		guilty of homicide.

67	115		SECTION 2. This act shall become effective November 1, 2021.
