NEW LAW A new section of law to be codified in the Oklahoma Statutes as Section 2105.1 of Title 68, unless there is created a duplication in num bering, reads as follows: A. Any transfer of legal ownership of a mo tor vehicle to a person who is a resident of Oklahoma and has been honorably discharged from active service in any branch of the Armed Forces of the United States or Oklahoma National Gua rd and who has been certified by the United States Department of Vete rans Affairs or its successor to be in receipt of disability compensation at the one - hundred-percent rate and the disability shall be permanent and have been sustained through military ac tion or accident or resulting from disease contracted while in such a ctive service and who is SENATE FLOOR VERSION - HB2476 SFLR Page 2 (Bold face denotes Commit tee Amendments) 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 registered with the veterans registry created by the Oklahoma Department of Veterans Affairs shall be exempt from the sales tax levied for the sale of motor vehic les by Section 1355 of Title 68 of the Oklahoma Statutes. B. The exemption authorized by thi s section shall not be claimed by an individual for more than one vehicle in a consecutive three-year period, unless the vehicle is a replacement for a vehicle which was destroyed and declared by the insurer to be a total loss claim. This exemption shall not be counted against the sales tax exemption cap provided in paragraph 34 of Section 1357 of Title 68 of the Oklahoma Statutes. C. The Oklahoma Tax Commission s hall issue to the buyer a refund of sales tax collected by a motor ve hicle dealer from any person who qualifies for the exemption under this section. If the purchase of the motor vehicle was made with a loan, the refund shall be issued to the lienholder. The lienholder shall deduct the refund amount from the balance due o n the loan. SECTION 2.
