5548 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
56-SECTION 1. AMENDATORY 59 O.S. 2011, Section 887.17, as
57-last amended by Section 46, Chapter 475, O.S.L. 2019 (59 O.S. Supp.
58-2020, Section 887.17), is am ended to read as follows:
59-Section 887.17 A. 1. Except for workers' compensation claims,
60-any person licensed under the Physical Therapy Practice Act as a
61-physical therapist shall be able to evaluate and treat human
62-ailments by physical therapy on a patie nt without a referral from a
63-licensed health care practitioner for a period not to exceed thirty
64-(30) sixty (60) days. Treatment may be provided by a physical
65-therapist assistant under the supervision of a physical therapist.

93-Any treatment provided beyon d the thirty-day sixty-day period shall
94-be only under the referral of a person licensed as a physician or
95-surgeon with unlimited license, or the physician assistant of the
96-person so licensed, and Doctors of Dentistry, Chiropractic and
97-Podiatry and an Advan ced Practice Registered Nurse, with those
98-referrals being limited to their respective areas of training and
99-practice.
100-2. A physical therapist may provide services within the scope
101-of physical therapy practice without a physician referral to
102-children who receive physical therapy services pursuant to the
103-Individuals with Disabilities Education Improvement Act of 2004, as
104-may be amended, and Section 504 of the Rehabilitation Act of 1973,
105-as may be amended. Provided further, a plan of care developed by a
106-person authorized to provide services within the scope of the
107-Physical Therapy Practice Act shall be deemed to be a prescription
108-for purposes of providing services pursuant to the provisions of the
109-Individuals with Disabilities Education Improvement Act of 200 4, as
110-may be amended, and Section 504 of the Rehabilitation Act of 1973,
111-as may be amended.
112-3. Nothing in the Physical Therapy Practice Act shall prevent a
113-physical therapist from performing screening and educational
114-procedures within the scope of physica l therapy practice without a
115-physician referral.

143-4. Nothing in the Physical Therapy Practice Act shall prevent a
144-physical therapist from performing services that are provided for
145-the purpose of fitness, wellness, or prevention that is not related
146-to the treatment of an injury or ailment.
147-5. Nothing in the Physical Therapy Practice Act shall be
148-construed as authorization for a physical therapist or physical
149-therapist assistant to practice any branch of the healing art.
150-6. Any person violating the provisio ns of the Physical Therapy
151-Practice Act shall be guilty of a misdemeanor as per Section 887.16
152-of this title.
153-B. 1. The provisions of the Physical Therapy Practice Act are
154-not intended to limit the activities of persons legitimately engaged
155-in the nontherapeutic administration of baths, massage, and normal
156-exercise.
157-2. The Physical Therapy Practice Act shall not prohibit
158-students who are enrolled in schools of physical therapy approved by
159-the State Board of Medical Licensure and Supervision from performi ng
160-such work as is incidental to their course of study; nor shall it
161-prevent any student in any recognized school of the healing art in
162-carrying out prescribed courses of study; provided such school is a
163-recognized institution by the statutes of Oklahoma, and its
164-practitioners are duly licensed as prescribed by law.
165-3. Nothing in the Physical Therapy Practice Act shall apply to
166-any person employed by an agency, bureau, or division of the federal

194-government while in the discharge of official duties; however , if
195-such individual engages in the practice of physical therapy outside
196-the line of official duty, the individual must be licensed as herein
197-provided.
49+SECTION 1. NEW LAW A new section of law not to be
50+codified in the Oklahoma Statutes reads as follows:
51+This act shall be known and may be cited as the "Physical
52+Therapy Act of 2021".
