321537 Section 420. A. A person in possession of a state -issued

347554 B. Possession of up to one and one -half (1.5) ounces or forty-
348555 two and forty-five one-hundredths (42.45) grams of marijuana by
349556 persons who can state a medical condition, but are not in possession
350557 of a state-issued medical marijuana patient license, shall
351558 constitute a misdemeanor offense not subject to imprisonm ent but

352585 punishable by a fine not to exceed Four Hundred Dollars ($400.00)
353586 and shall not be subject to imprisonment for the offense . Any law
354587 enforcement officer who comes in contact with a person in violation
355588 of this subsection and who is satisfied as to t he identity of the
356589 person, as well as any other pertinent information the law
357590 enforcement officer deems necessary, shall issue to the person a
358591 written citation containing a notice to answer the charge against
359592 the person in the appropriate court. Upon rece iving the written
360-promise of the alleged violator to answer as specified in the ENR. H. B. NO. 2646 Page 9
593+promise of the alleged violator to answer as specified in the
361594 citation, the law enforcement officer shall release the person upon
362595 personal recognizance unless there has been a violation of another
363596 provision of law.

365597 C. A regulatory office shall be established under the State
366598 Department of Health which shall receive applications for medical
367599 marijuana patient and caregiver license recipients, dispensaries,
368600 growers, and packagers processors within sixty (60) days of the
369601 passage of this initia tive.
370-
371602 D. The State Department of Health shall, within thirty (30)
372603 days of passage of this initiative, make available on its website,
373604 in an easy-to-find location, an application for a medical marijuana
374605 patient license. The license shall be good valid for two (2) years.
375606 The biannual application fee shall be One Hundred Dollars ($100.00),
376607 or Twenty Dollars ($20.00) for individuals on Medicaid, Medicare or
377608 SoonerCare. The methods of payment shall be provided on the website

18613221 meet the emergency. Such action may include, but is not limited to,
18623222 ordering the licensee to immediately cease and desist operations by
18633223 the licensee. The order shall be effective immediately upon
18643224 issuance. Any person to whom the order is directed shall comply
18653225 immediately with the provisions of the order. The Department may
18663226 assess a penalty not to exceed Ten Thousand Dollars ($10,000.00) per
18673227 day of noncompliance with the order. In assessing such a penalty,
18683228 the Department shall co nsider the seriousness of the violation and
18693229 any efforts to comply with applicable requirements. Upon
18703230 application to the Department, the licensee shall be offered a
18713231 hearing within ten (10) days of the issuance of the order.

32825597 Department and is embargoed. The notice shall further provide a
32835598 warning to all persons not to remove or dispose of the medical
32845599 marijuana or medical marijuana pro duct until permission for removal
32855600 or disposal is given by the Department. It shall be unlawful for
32865601 any person to remove or dispose of the medical marijuana or medical
32875602 marijuana product embargoed without permission by the Department.

32895603 B. If the State Commi ssioner of Health finds that medical
32905604 marijuana or medical marijuana product embargoed pursuant to
32915605 subsection A of this section does not meet the requirements of
32925606 applicable laws or rules and regulations of the Department, or is
32935607 poisonous, deleterious to hea lth or otherwise unsafe, the
32945608 Commissioner may institute an action in the district court in whose
32955609 jurisdiction the medical marijuana or medical marijuana product is
32965610 embargoed for the condemnation and destruction of the medical
32975611 marijuana or medical marijuana product. If the Commissioner finds
32985612 that the medical marijuana or medical marijuana product embargoed
32995613 does meet the requirements of applicable laws and the rules and
33005614 regulations of the Department and is not poisonous, deleterious to
33015615 health or otherwise un safe, the Commissioner shall remove the
33025616 embargo. In any court proceeding regarding an embargo, neither the

35366004 C. No license shall be issued except upon proof of sufficient
35376005 liability insurance and financial responsibility. Liability
35386006 insurance shall be provided by the applicant and shall apply to
35396007 sudden and nonsudden bodily injury or property damage on, below or
35406008 above the surface, as required by the rules of the Authority. Such
35416009 insurance shall be maintained for the period of operation of the
35426010 facility and shall provide coverage for damages resulting from
35436011 operation of the facility during operation and after closing. In
35446012 lieu of liability insurance required by this subsection, an
35456013 equivalent amount of cash, securities, bond or al ternate financial
35466014 assurance, of a type and in an amount acceptable to the Authority,
35476015 may be substituted; provided, that such deposit shall be maintained
35486016 for a period of five (5) years after the date of last operation of
35496017 the facility.

35526045 disposal license shall constitute permission for entry to and
35536046 inspection of the facility of the licensee during hours of operation
35546047 and other reasonable times. Refusal to permit such entry of
35556048 inspection shall consti tute grounds for the nonrenewal, suspension
35566049 or revocation of a license. The Authority may perform an annual
35576050 unannounced on-site inspection of the operations and any facility of
35586051 the licensee. If the Authority receives a complaint concerning
35596052 noncompliance by a licensee with the provisions of this act the
35606053 Oklahoma Medical Marijuana Waste Management Act , the Authority may
35616054 conduct additional unannounced, on -site inspections beyond an annual
35626055 inspection. The Authority shall may refer all complaints alleging
35636056 criminal activity that are made against a licensed facility to
35646057 appropriate state or local law enforcement authorities.

35666058 E. The Authority shall issue a an annual permit for each
35676059 medical marijuana waste disposal facility operated by a licensee. A
35686060 permit shall be issued only upon proper application by a licensee
35696061 and determination by the Authority that the proposed site and
35706062 facility are physically and technically suitable. Upon a finding
35716063 that a proposed medical marijuana waste disposal facility is not
35726064 physically or technically suitable, the Authority shall deny the

35846101 facility permit that has been revoked shall be reinstated upo n
35856102 remittance of a reinstatement fee of Five Hundred Dollars ($500.00)

35876104 be deposited into the Public Health Special Oklahoma Medical
35886105 Marijuana Authority Revolving Fund as provided in Section 1-107
35896106 427.5 of Title 63 of the Oklahoma Statutes this title.

35926108 shall not be required to obtain a medical marijuana transporter
35936109 license provided for in the Oklahoma Medical Marijuana and Patient

36446207 promulgated by the Director. This provision shall also apply to
36456208 wholesale distributors who distribute controlled dangerous

37656407 J. A separate registration shall be required at each principal
37666408 place of business or professional practice where the applicant
37676409 manufactures, distributes, dispenses, prescribes, administers , or
37686410 uses for scientific purposes controlled dangerous substances.

37706411 K. The Director is authorized to inspect the establishment of a
37716412 registrant or applicant for registration in accordance with rules
37726413 promulgated by the Director.

37896453 under subsection H of this section shall be subject to the
37906454 registration requirements of Section 2 -101 et seq. of this title.

37936456 level practitioner shall notify and furnish to the Director, not

37956458 professional holds a valid license, a current listing of individuals

38746599 intoxicating substance which ad versely affected the central nervous
38756600 system, vision, hearing or other sensory or motor functioning to

38936642 sale of perishable substances and the deposit of the proceeds of the
38946643 sale with the court. Upon a revocation order becoming final, all
38956644 such controlled dangerous substances shall be forfeited to the
38966645 state.

38986646 C. The Drug Enforcement Administration shall promptly be
38996647 notified of all orders suspending or revoking registration and all
39006648 forfeitures of controlled dangerous substances.

39026649 D. In lieu of or in addition to any other remedies available to
39036650 the Director, if a finding is made that a registrant has committed
39046651 any act in violation of federal law relating to any controlled
39056652 substance, any provision of the Uniform Controlled Dangerous
39066653 Substances Act, or any rules of the Oklahoma State Bureau of
39076654 Narcotics and Dangerous Drugs Control, the Director is hereby
39086655 authorized to assess an administrative p enalty not to exceed Two
39096656 Thousand Dollars ($2,000.00) for each such act. The provisions of
39106657 this subsection shall not apply to violations of subsection G of
39116658 Section 2-309D of this title. Nothing in this section shall be
39126659 construed so as to permit the Direc tor of the State Bureau of
39136660 Narcotics and Dangerous Drugs Control to assess administrative fines
39146661 for violations of the provisions of subsection G of Section 2 -309D

39306701 appear before the appropriate person or agency at a time and place
39316702 within thirty (30) days afte r the date of service of the order, but
