4299 SECTION 1. NEW LAW A new section of law to be codified
43100 in the Oklahoma Statutes as Section 1 -706a of Title 63, unless there
44101 is created a duplication in numbering, reads as follows:

46102 A. This section shall be known and may be cited as the "No
47103 Patient Left Alone Act ".

49104 B. Subject to the provisions of subsections D and E of this
50105 section, each minor who is admitted to a hospital licensed pursuant
51106 to Section 1-702 of Title 63 of the Oklahoma Statutes has the right
52107 to have a parent, guardian or person standing in loco parentis who
53108 shall have the ability to be present while the minor patient is
54109 receiving hospital care.

56110 C. Subject to the provisions of subsections D and E of this
57111 section, each adult who is admitted to a hospital licensed pursuant
58112 to Section 1-702 of Title 63 of the Oklahoma Statutes has the right
59113 to designate a spouse, family member or caregiver who shall have the
60114 ability to be physically present while the adult patient is
61115 receiving hospital care.

63116 D. A hospital may establish visitation policies that limit or
64117 restrict visitation when:

66118 1. The presence of visitors would be medically or
67119 therapeutically contraindicated in the best clinical judgment of
68120 health care professionals;

70121 2. The presence of visitors would interfere with the care of or
71122 rights of any patient;

73149 3. Visitors are engaging in disruptive, thre atening or violent
74150 behavior toward any staff member, patient or other visitor; or

76151 4. Visitors are noncompliant with hospital policy.

78152 E. A hospital may require visitors to wear personal protective
79153 equipment, provided that any such required equipment shall be
80154 provided by the hospital. A hospital may require visitors to comply
81155 with reasonable safety protocols and rules of conduct. The hospital
82156 may revoke visitation rights for failure to comply with this
83157 section.

85158 F. Nothing in this section shall be constru ed to require a
86159 hospital to allow a visitor to enter an operating room, isolation
87160 room, isolation unit , behavioral health setting or other typically
88161 restricted area or to remain present during the administration of
89162 emergency care in critical situations. N othing in this section

95167 G. The rights specifi ed in this section may not be terminated,

97169 or any governmental entity , notwithstanding declarations of

105202 materials developed by the State Department of Health explaining the
106203 rights specified in this section. The State Department of Health

122215 Control and Prevention or other federal guidelines that require or
123216 recommend restricting visitor access; or

125217 4. The acts or omissions of any visitor who is given access to
126218 a hospital-controlled property or location.
