45	45	coordination between certain state agencies; defining
46	46	term; providing for codification; and providing an

52	52	BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
53	53	SECTION 1. NEW LAW A new section of law to be codified
54	54	in the Oklahoma Statutes as Section 5-3A.7 of Title 2, unless there
55	55	is created a duplication in numbering, reads as follows:
56	56	A. Subject to federal funding, e very farmers market as defined
57	57	in Section 5-3A.2 of Title 2 of the Oklahoma Statutes shall register
58	58	with the Food and Nutrition Service of the United States Department
59	59	of Agriculture to accept Supplemental Nutrition Assistance Progr am
60	60	(SNAP) benefits as payment for eligible products being sold at the
61	61	farmers market.

88	88	B. The Oklahoma Department of Agriculture, Food and Forestry
89	89	shall coordinate with the Department of Human Services to ensure
90	90	compliance with the provisions of this sect ion.
91	91	C. As used in this section, "eligible products" means items
92	92	identified by the United States Department of Agriculture as
93	93	eligible for SNAP benefits and include fruits and vegetables; meat,
94	94	poultry, and fish; dairy products; breads and cereals; other foods
95	95	such as snack foods and non -alcoholic beverages; and seeds and
96	96	plants, which produce food for the household to eat. Items such as
97	97	beer, wine, liquor, cigarettes, or tobacco; vitamins, medicines, and
98	98	supplements; prepared foods fit for immediate cons umption; hot
99	99	foods; and any nonfood items are not eligible products.
100	100	SECTION 2. This act shall become effective November 1, 2021.
