AS INTRODUCED 
 
An Act relating to farmers markets; requiring farmers 
markets to accept Supplemental Nutri tion Assistance 
Program benefits as payment subject to federal 
funding; mandating registration with the United 
States Department of Agriculture; providing for 
coordination between certain state agencies; defining 
term; providing for codification; and providing an 
effective date. 
 
 
 
 
BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA: 
SECTION 1.     NEW LAW     A new section of law to be codified 
in the Oklahoma Statutes as Section 5-3A.7 of Title 2, unless there 
is created a duplication in numbering, reads as follows: 
A.  Subject to federal funding, e very farmers market as defined 
in Section 5-3A.2 of Title 2 of the Oklahoma Statutes shall register 
with the Food and Nutrition Service of the United States Department 
of Agriculture to accept Supplemental Nutrition Assistance Progr am 
(SNAP) benefits as payment for eligible products being sold at the 
farmers market.

B.  The Oklahoma Department of Agriculture, Food and Forestry 
shall coordinate with the Department of Human Services to ensure 
compliance with the provisions of this sect ion. 
C.  As used in this section, "eligible products" means items 
identified by the United States Department of Agriculture as 
eligible for SNAP benefits and include fruits and vegetables; meat, 
poultry, and fish; dairy products; breads and cereals; other foods 
such as snack foods and non -alcoholic beverages; and seeds and 
plants, which produce food for the household to eat.  Items such as 
beer, wine, liquor, cigarettes, or tobacco; vitamins, medicines, and 
supplements; prepared foods fit for immediate cons umption; hot 
foods; and any nonfood items are not eligible products. 
SECTION 2.  This act shall become effective November 1, 2021.
