36166 BE IT ENACTED BY THE PEOPLE OF THE STAT E OF OKLAHOMA:

38167 SECTION 1. AMENDATORY 74 O.S. 2011, Section 129.4, as
39168 renumbered by Section 39, Chapter 209, O.S.L. 2013, and as last
40169 amended by Section 2, Chapter 204, O.S.L. 2019 (61 O.S. Supp. 2020,
41170 Section 327), is amended to r ead as follows:

43171 Section 327. A. Unless procedures for state agency real
44172 property transactions are otherwise specifically provided for by

45199 law, no state agency shall sell, lease, exchange, or otherwise
46-dispose of such real property subject to its jurisdiction, or lease, ENR. H. B. NO. 2863 Page 2
200+dispose of such real property subject to its jurisdict ion, or lease,
47201 purchase or otherwise acquire real property subject to its
48202 jurisdiction, except as authorized by subsection L of this section
49203 and as otherwise provided for in this section. As used in this
50204 section, "state agency" means any department, board , commission,
51205 institution, agency or entity of state government.

53206 B. 1. Every state agency shall request the Office of
54207 Management and Enterprise Services to dispose of real property upon:
55-
56208 a. legislative authorization,
57-
58209 b. authorization by the Long -Range Capital Planning
59210 Commission, or
60-
61211 c. a determination, in writing, by the Office of
62212 Management and Enterprise Services or the state agency
63213 that a parcel of real property subject to its
64214 jurisdiction is no longer needed.
65-
66215 2. Upon the request of the state agency t o dispose of real
67216 property, the Office of Management and Enterprise Services shall:
68-
69217 a. obtain at least one complete appraisal made by a
70218 person certified by the Real Estate Appraiser Board of
71219 the Oklahoma Insurance Department, who shall
72220 ascertain:
221+(1) the present fair value of the property,

76248 (2) the present value of the improvements on such
77249 property, and

79250 (3) the actual condition of the improvements on the

82252 b. after completion of the provisions of subsection L of
83253 this section, cause notice of such sal e to be
84254 published for at least one (1) day in a newspaper of
85255 general statewide circulation authorized to publish
86256 legal notices, and weekly for three (3) consecutive
87257 weeks in a newspaper of general circulation published
88258 in the county or counties in which th e property is
89259 located. The notice shall contain the legal
90260 description of each parcel of real property to be
91-offered for sale, the appraised value thereof, the ENR. H. B. NO. 2863 Page 3
261+offered for sale, the appraised value thereof, the
92262 time and location of the sale or opening of the bids,
93263 and terms of the sale including the fact t hat no
94264 parcel of property shall be sold for less than ninety
95265 percent (90%) of the appraised value of the real
96266 property; provided, in lieu of such procedure, the
97267 information may be published electronically on the
98268 Office of Management and Enterprise Services ' website
99269 if the notice of sale and instructions on accessing
100270 the public information are published in a newspaper of
101271 general circulation in the county or counties in which

102298 the property is located weekly for three (3)
103299 consecutive weeks,

105300 c. offer the property through public auction or sealed
106301 bids within three (3) weeks after the last publication
107302 of the notice. The property shall be sold to the
108303 highest bidder. The Office of Management and
109304 Enterprise Services shall not accept a bid of less
110305 than ninety percent (90%) of the average appraised
111306 fair value of the property and the improvements on
112307 such property, and
113-
114308 d. if the property is being disposed of in compliance
115309 with Section 908 of Title 62 of the Oklahoma Statutes,
116310 the Office may auction the property at public or
117311 electronic auction provided proper public notice is
118312 given in compliance with this section and the property
119313 has been approved for liquidation by the Long -Range
120314 Capital Planning Commission. The Office of Management
121315 and Enterprise Services is authorized to reject all
122316 bids.

124317 3. The cost of the appraisal required by the provisions of this
125318 section, together with other necessary expenses incurred pursuant to
126319 this section, shall be paid by the state agency for which the real
127320 property is to be sold from funds a vailable to the state agency for
128321 such expenditure. All monies received from the sale or disposal of

129348 the property, except those monies necessary to pay the expenses
130349 incurred pursuant to this section, shall be deposited in the
131350 Maintenance of State Buildings Revolving Fund unless otherwise
132351 provided by law.

134352 4. The Office of Management and Enterprise Services may dismiss
135353 from consideration any appraisal found to be incomplete or flawed.

137354 C. Unless otherwise provided by law, the Office of Management
138355 and Enterprise Services shall review and approve state agency real
139356 property transactions. A state agency shall not lease or acquire
140357 real property, or lease, dispose of or transfer state -owned real
141358 property until the Office provides notice of transaction approval to
142359 the state agency. Prior to approval, a state agency shall provide
143360 documents to the Office and provide reference to statutory or other
144361 legal authority of the state agency to lease or acquire real
145362 property, or lease, dispose of or transfer state -owned real
146363 property. If the state agency intends to lease or acquire real
147364 property, the state agency shall state the intended use of the real
148365 property, and shall provide the Office with required telework
149366 documentation. Within thirty (30) days of receipt, the Office shall
150367 provide notice of transaction approval or disapproval to the state
151368 agency.

153369 D. The provisions of this section shall not apply to the lease
154370 of office space or real property subject to supervision of the
155371 Commissioners of the Land Office or district bo ards of education.

157398 E. 1. The Office of Management and Enterprise Services shall
158399 maintain a comprehensive inventory of state -owned real property and
159400 its use excluding property of the public schools and property
160401 subject to the jurisdiction of the Commissio ners of the Land Office.

162402 2. Each state agency shall, within thirty (30) days of the
163403 closing date for lands newly acquired, provide to the Office a list
164404 of records, deeds, abstracts and other title instruments showing the
165405 description of and relating to any and all such lands or interests
166406 therein.

168407 3. The provisions of paragraph 2 of this subsection shall apply
169408 to all lands of public trusts having a state agency as the primary
170409 beneficiary, but shall not apply to lands of municipalities,
171410 counties, school dist ricts, or agencies thereof, or Department of
172411 Transportation rights -of-way.

174412 4. A state agency that sells or otherwise disposes of land
175413 shall notify the Office within thirty (30) days of the disposition
176414 closing date.

178415 F. This section shall not be construed to authorize any state
179416 agency, not otherwise authorized by law, to sell, lease, or
180417 otherwise dispose of any real property owned by the state.

182418 G. The Office of Management and Enterprise Services and the
183419 Secretary of the Commissioners of the Land Office , or designee, as
184420 provided in subsection L of this section may provide services to

188449 H. The Director of the Office of Management and Enterprise
189450 Services shall, pursuant to the Administrat ive Procedures Act,
190451 promulgate rules to effect procedures necessary to the fulfillment
191452 of its responsibilities under this section.

193453 I. The Oklahoma Ordnance Works Authority and its lands, and the
194454 Northeast Oklahoma Public Facilities Authority, the Oklahoma
195-Historical Society, the Oklahoma Department of Transportation and,
196-the Oklahoma Turnpike Authority , and the Department of Wildlife
197-managed lands shall be exempt from the application of this section.
198-The Grand River Dam Authority and its lands shall be exempt from the
199-application of this section for any real property disposed of prior
200-to November 1, 2006.
201-
455+Historical Society, the Oklahoma Department of Transportation and
456+the Oklahoma Turnpike Authority , shall be exempt from the
457+application of this section. The Grand River Dam Authority and its
458+lands shall be exempt from the application of this section for any
459+real property disposed of prior to November 1, 2006.
202460 J. Unless otherwise provided for by law, the procedures
203461 established pursuant to this section for the sale or exchange of
204462 real estate or personal property as authorized pursuant to Sections
205463 2222 and 2223 of Title 74 of the Oklahoma Statutes shall be followed
206464 unless the sale is to an entity of state government.

208465 K. The Director of the Office of Management and Enterprise
209466 Services shall contract with experts, professionals or consultants
210467 as necessary to perform the duties of the Office. Selections shall
211468 be made using the qualifications -based procedures established in
212469 Section 62 of this title , and the rules promulgated by the Director
213470 for the selection of construction managers and design consultants.

215497 L. 1. No state agency shall sell, lease, exchange, or
216498 otherwise dispose of such real property subject to its jurisdiction,
217499 or lease, purchase or otherwise acquire real property subject to its
218500 jurisdiction, until such agency or the Office of Management and
219501 Enterprise Services acting on the agency's behalf has presented to
220502 the Secretary of the Commissioners of the Land Office , or designee,
221503 all information collected pursuant to subparagraph a of paragraph 2
222504 of subsection B of this section, and provided the Secre tary of the
223505 Commissioners of the Land Office or designee a twenty -calendar-day
224506 period to provide a proposal for the acquisition or disposal of
225507 applicable real property.

227508 2. The Secretary of the Commissioners of the Land Office or
228509 designee may decline to pr ovide such a proposal, provided such
229510 notice of decline is communicated to the Office of Management and
230511 Enterprise Services in written or electronic form. Upon the
231512 reception of such notice of decline by the Office of Management and
232513 Enterprise Services, the twenty-calendar-day period otherwise
233-required by this subsection shall be deemed to have expired.
