22	47		Commission Online Filing Revolving Fund; pla cing fund
23	48		with the Ethics Commission; establishing fund
24	49		characteristics; requiring collections in excess of
25	50		certain annual amount be deposited to certain fund;
26	51		authorizing the budgeting and expenditure of funds
27	52		for certain purposes; establishing expenditur e

36	60		BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:

38	61		SECTION 1. AMENDATORY 74 O.S. 2011, Section 4258, as
39	62		last amended by Section 1, Chapter 440, O.S.L. 2019 (74 O.S. Supp.
40	63		2020, Section 4258), is amended to read as follows:

42	64		Section 4258. A. There is hereby created in the State Treasury
43	65		a revolving fund for the Ethics Commission to be designated the
44	66		"Ethics Commission Fund". The Ethics Commission Fund shall be a
45	67		continuing fund, not subject to fiscal year limitations , and

	94	+	deposits to the fund shall consist of the first One Hundred Fifty
47	95		Thousand Dollars ($150,000.00) of fees received by the Commission
48	96		each fiscal year. Fees c ollected each fiscal year in excess of One
49	97		Hundred Fifty Thousand Dollars ($150,000.00) shall be placed to the
50	98		credit of the General Revenue Fund Ethics Commission Online Filing
51	99		Revolving Fund created pursuant to Section 2 of this act .

53	100		B. All monies accru ing to the credit of the Ethics Commission
54	101		Fund are hereby appropriated and may be budgeted and expended by the
55	102		Commission for any expenses incurred in the implementation of its
56	103		duties as provided by law. Expenditures from the fund shall be made
57	104		upon warrants issued by the State Treasurer against claims filed as
58	105		prescribed by law with the Director of the Office of Management and
59	106		Enterprise Services for approval and payment.

61	107		SECTION 2. NEW LAW A new section of law to be codified
62	108		in the Oklahoma Statutes as Section 4258.2 of Title 74, unless there
63	109		is created a duplication in numbering, reads as follows:

65	110		A. There is hereby created in the State Treasury a revolving
66	111		fund for the Ethics Commission to be designated the "Ethics
67	112		Commission Online Filing Revolving Fund". The fund shall be a
68	113		continuing fund, not subject to fiscal year limitations, and
69	114		deposits to the fund shall consist of the first Two Hundred Thousand
70	115		Dollars ($200,000.00) of monies designated for deposit to the fund
71	116		pursuant to the provisions of Section 4258 of Title 74 of the

72	143		Oklahoma Statutes each fiscal year and all monies appropriated to
73	144		the fund pursuant to an act of the Legislature.

75	145		B. Monies designated for deposit to the fund in excess of Two
76	146		Hundred Thousand Dollar s ($200,000.00) each fiscal year shall be
77	147		placed to the credit of the General Revenue Fund. All monies
78	148		accruing to the credit of said fund are hereby appropriated and may
79	149		be budgeted and expended by the Commission for the purpose of:

81	150		1. Developing, maint aining and administering the Commission's
82	151		online filing system; and

84	152		2. The payment of fees and charges to other state agencies for
85	153		information technology services.

87	154		Expenditures from said fund shall be made upon warrants issued by
88	155		the State Treasurer aga inst claims filed as prescribed by law with
89	156		the Director of the Office of Management and Enterprise Services for
90	157		approval and payment.

92	158		SECTION 3. This act shall become effective July 1, 2021.

94	159		SECTION 4. It being immediatel y necessary for the preservation
95	160		of the public peace, health or safety, an emergency is hereby
96	161		declared to exist, by reason whereof this act shall take effect and
97	162		be in full force from and after its passage and approval.
