Supp. 2020, Section 4258), which relates to the Ethics Commission Fund; clarifying language; requiring collections in excess of certain annual amount be deposited to certain revolving fund; creating the Ethics Commission Online Filing Revolving Fund; pla cing fund with the Ethics Commission; establishing fund characteristics; requiring collections in excess of certain annual amount be deposited to certain fund; authorizing the budgeting and expenditure of funds for certain purposes; establishing expenditur e procedures; providing for codification; providing an effective date; and declaring an emergency. SUBJECT: Ethics Commission BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA: SECTION 1. AMENDATORY 74 O.S. 2011, Section 4258, as last amended by Section 1, Chapter 440, O.S.L. 2019 (74 O.S. Supp. 2020, Section 4258), is amended to read as follows: Section 4258. A. There is hereby created in the State Treasury a revolving fund for the Ethics Commission to be designated th e "Ethics Commission Fund". The Ethics Commission Fund shall be a continuing fund, not subject to fiscal year limitations , and deposits to the fund shall consist of the first One Hundred Fifty ENR. H. B. NO. 2897 Page 2 Thousand Dollars ($150,000.00) of fees received by the Commiss ion each fiscal year. Fees collected each fiscal year in excess of One Hundred Fifty Thousand Dollars ($150,000.00) shall be placed to the credit of the General Revenue Fund Ethics Commission Online Filing Revolving Fund created pursuant to Section 2 of t his act. B. All monies accruing to the credit of the Ethics Commission Fund are hereby appropriated and may be budgeted and expended by the Commission for any expenses incurred in the implementation of its duties as provided by law. Expenditures from th e fund shall be made upon warrants issued by the State Treasurer against claims filed as prescribed by law with the Director of the Office of Management and Enterprise Services for approval and payment. SECTION 2. NEW LAW A new sec tion of law to be codified in the Oklahoma Statutes as Section 4258.2 of Title 74, unless there is created a duplication in numbering, reads as follows: A. There is hereby created in the State Treasury a revolving fund for the Ethics Commission to be des ignated the "Ethics Commission Online Filing Revolving Fund". The fund shall be a continuing fund, not subject to fiscal year limitations, and deposits to the fund shall consist of the first Two Hundred Thousand Dollars ($200,000.00) of monies designated for deposit to the fund pursuant to the provisions of Section 4258 of Title 74 of the Oklahoma Statutes each fiscal year and all monies appropriated to the fund pursuant to an act of the Legislature. B. Monies designated for deposit to the fund in exce ss of Two Hundred Thousand Dollars ($200,000.00) each fiscal year shall be placed to the credit of the General Revenue Fund. All monies accruing to the credit of said fund are hereby appropriated and may be budgeted and expended by the Commission for the purpose of: 1. Developing, maintaining and administering the Commission's online filing system; and 2. The payment of fees and charges to other state agencies for information technology services. Expenditures from said fund shall be made upon warran ts issued by the State Treasurer against claims filed as prescribed by law with the Director of the Office of Management and Enterprise Services for approval and payment. It being immediately necessary for the preservation of the public peace, health or safety, an emergency is hereby declared to exist, by reason whereof this act shall take effect and be in full force from and after its passage and approva l.
