1445 An Act relating to agriculture; amending 2 O.S. 2011,
1546 Sections 5-3.2, as last amended by Section 1, Chapter
1647 123, O.S.L. 2015 and 5-3.4, as amended by Section 3,
1748 Chapter 123, O.S.L. 2015 (2 O.S. Supp. 20 20, Sections
1849 5-3.2 and 5-3.4), which relate to the Oklahoma
1950 Agriculture Enhancement and Diversification Program;
2051 modifying categories within the Program; eliminating
2152 authority to allocate certain funds on a match ing
2253 basis; modifying preference for grant recipients;
2354 prohibiting consideration of certain applications;
2455 specifying certain materials shall be subject to the
2556 Oklahoma Open Records Act; eliminating authority to
2657 hold certain executive sessions; providing certain

4297 B. The purpose of the Oklahoma Agricultu re Enhancement and
4398 Diversification Program is to promote and encourage the interests of
4499 agriculture through the allocation of funds, by grant or loan, to
45100 individuals, cooperatives and other agricultura l entities to:

47101 1. Develop new or expanded uses of agri cultural products;

49102 2. Develop new or expanded benefits of agricultural events;

51103 3. Increase agricultural productivity;

53104 4. Provide added value to agricultural products or events;

57106 6. Benefit the agricultural inte rests of Oklahoma this state.

59107 C. The Program shall consist of the following categories:

61108 1. Cooperative marketing Value-added agriculture grants and
62109 loans for entities or individuals intending to work together to
63110 develop or establish production, processin g or marketing of
64111 agricultural products. The purpose of this category is to provide
65112 funding for promoting productivity, providing added value to
66113 agricultural products, stimulating and fostering agricu ltural
67114 diversification and encouraging processing innov ations;

69115 2. Marketing and utilization grants and loans to assist in the
70116 development or implementation of sound domestic or foreign marketing
71117 plans for Oklahoma agricultural products, by -products, or new and
72118 better uses for existing agricultural products th rough the financing
73119 of marketing feasibility studies, business plans, and test

78150 nontraditional crops, livestock, agritourism, or on-farm, value-

102167 young farmers that are engaged or will be engaged in expansion or

163267 through existing marketing cooperatives produced or

198319 E. D. 1. Any information submitted to or compiled by the
199320 Department with respect t o the marketing plans, financial
200321 statements, trade secrets, research concepts, methods or products,

202350 associations, partnerships, agencies, corporat ions, institutions of
203351 higher education, nonprofit rese arch institutions or other entities
204352 pursuant to the Oklahoma Agriculture Enhancement and Diversification
205353 Program shall not be disclosed pursuant to the Oklahoma Open Records
206354 Act or in public hearings an d shall be kept confidential, except to
207355 the extent that the person or entity which provided such information
208356 or which is the subject of such information consents to disclosure.

210357 2. Executive sessions may be held to discuss such materials i f
211358 deemed necessary by the Board In the event that an independent group
212359 of reviewers is used to analyze and recommend projects for approval
213360 by the Board, any meeting of such group shall be exempt from the
214361 Oklahoma Open Meeting Act.

216362 SECTION 3. This act shall become effective November 1, 2021.
