14	45		An Act relating to agriculture; amending 2 O.S. 2011,
15	46		Sections 5-3.2, as last amended by Section 1, Chapter
16	47		123, O.S.L. 2015 and 5-3.4, as amended by Section 3,
17	48		Chapter 123, O.S.L. 2015 (2 O.S. Supp. 20 20, Sections
18	49		5-3.2 and 5-3.4), which relate to the Oklahoma
19	50		Agriculture Enhancement and Diversification Program;
20	51		modifying categories within the Program; eliminating
21	52		authority to allocate certain funds on a match ing
22	53		basis; modifying preference for grant recipients;
23	54		prohibiting consideration of certain applications;
24	55		specifying certain materials shall be subject to the
25	56		Oklahoma Open Records Act; eliminating authority to
26	57		hold certain executive sessions; providing certain
27	58		exemptions; and providing an effective date.

32	63		BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:

34	64		SECTION 1. AMENDATORY 2 O.S. 2011, Section 5 -3.2, as
35	65		last amended by Section 1, Chapter 123, O.S.L. 2015 (2 O.S. Supp.
36	66		2020, Section 5-3.2), is amended to read as follows:

38		-	Section 5-3.2 A. The State Board of Agriculture is hereby

42	97		B. The purpose of the Oklahoma Agricultu re Enhancement and
43	98		Diversification Program is to promote and encourage the interests of
44	99		agriculture through the allocation of funds, by grant or loan, to
45	100		individuals, cooperatives and other agricultura l entities to:

47	101		1. Develop new or expanded uses of agri cultural products;

49	102		2. Develop new or expanded benefits of agricultural events;

51	103		3. Increase agricultural productivity;

53	104		4. Provide added value to agricultural products or events;

55	105		5. Benefit the agricultural producer; and

57	106		6. Benefit the agricultural inte rests of Oklahoma this state.

59	107		C. The Program shall consist of the following categories:

61	108		1. Cooperative marketing Value-added agriculture grants and
62	109		loans for entities or individuals intending to work together to
63	110		develop or establish production, processin g or marketing of
64	111		agricultural products. The purpose of this category is to provide
65	112		funding for promoting productivity, providing added value to
66	113		agricultural products, stimulating and fostering agricu ltural
67	114		diversification and encouraging processing innov ations;

69	115		2. Marketing and utilization grants and loans to assist in the
70	116		development or implementation of sound domestic or foreign marketing
71	117		plans for Oklahoma agricultural products, by -products, or new and
72	118		better uses for existing agricultural products th rough the financing
73	119		of marketing feasibility studies, business plans, and test
74	120		marketing;

78	150		nontraditional crops, livestock, agritourism, or on-farm, value-

82	153		grants and loans for agricultural business creation or expansion, or
83	154		research which will likely lead to a marketable agricultural product
84	155		through the focusing of research efforts on uses and processing of
85	156		Oklahoma agricultural products and by -products, including but not

88	158		a. focused research which enhances the value of an
89	159		agricultural product or by-product,

95	162		d. projects that are driven by an entrepreneur or the

101	166		5. Veteran or young farme r grants or loans for veterans and
102	167		young farmers that are engaged or will be engaged in expansion or
103	168		creation of events that benefit and further the public interest in
104	169		agriculture an agricultural busin ess.

110	200		SECTION 2. AMENDATORY 2 O.S. 2011, Section 5 -3.4, as
111	201		amended by Section 3, Chapter 123, O.S .L. 2015 (2 O.S. Supp. 2020,

114		-	Section 5-3.4 A. The Oklahoma Department of Agriculture, Food,
115		-	and Forestry shall require eligible applicants to submit

122	210		Agriculture. Applications for grant or loan funds shall be approved
123	211		or denied by the Departm ent in accordance with criteria promulgated
124	212		by the State Board of Agriculture pursuant to the Oklahoma
125	213		Agriculture Enhancement and Diversification Program.

127	214		C. The State Board of Agriculture may also allocate monies from
128	215		the fund to eligible applicants on a matching basis.

130	216		D. Grant or loan funds may be made available to eligible
131	217		applicants pursuant to evaluation by the Department based on the

148	255		e. proposals demonstrate a high probability of rapid

151	257		f. projects demonstrate a shared commitment for funding
152	258		from other private or public sources or from the
153	259		applicant,

155	260		g. proposals center efforts on nonurban locales,

157	261		h. principals are individuals, a group of individuals, an
158	262		individual on behalf of a group, or corporations which
159	263		meet the criteria set forth in Section 951 of Tit le 18
160	264		of the Oklahoma Statutes, to market a product or
161	265		formulate or implement a marketing plan for
162	266		agricultural products which have not been marketed
163	267		through existing marketing cooperatives produced or
164	268		processed in Oklahoma ,

166	269		i. proposals contain the potential to create additional
167	270		income for the farm unit,

182	307		b. proposals which are ai med solely at business expansion
183	308		or creation without re gard to agricultural products
184	309		utilization,

186	310		c. research or marketing plans that cannot reasonably be
187	311		expected to result in a viable commercial application,
188	312		or that are or have been duplicated by other r esearch
189	313		efforts, or

191	314		d. proposals for agricultural event s that do not result
192	315		in expansion of the event or encourage additional
193	316		public interest in the event , or

195	317		e. proposals for growing or any other aspect of medical
196	318		marijuana.

198	319		E. D. 1. Any information submitted to or compiled by the
199	320		Department with respect t o the marketing plans, financial
200	321		statements, trade secrets, research concepts, methods or products,

204	352		pursuant to the Oklahoma Agriculture Enhancement and Diversification
205	353		Program shall not be disclosed pursuant to the Oklahoma Open Records
206	354		Act or in public hearings an d shall be kept confidential, except to
207	355		the extent that the person or entity which provided such information
208	356		or which is the subject of such information consents to disclosure.

210	357		2. Executive sessions may be held to discuss such materials i f
211	358		deemed necessary by the Board In the event that an independent group
212	359		of reviewers is used to analyze and recommend projects for approval
213	360		by the Board, any meeting of such group shall be exempt from the
214	361		Oklahoma Open Meeting Act.
