41	41	amending 59 O.S. 2021, Section 858 -724, which relates
42	42	to the Oklahoma Certified Real Estat e Appraisers Act;

50	50	BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
51	51	SECTION 1. AMENDATORY 59 O.S. 2021, Section 858 -724, is
52	52	amended to read as follows:
53	53	Section 858-724. A. Before suspending or revoking any
54	54	certification, the Real Estate Appraiser Board shall notify the
55	55	appraiser in writing of any charges made at least thirty (30) days
56	56	prior to the date set fo r the hearing and shall af ford the appraiser
57	57	an opportunity to be heard in person or by counsel.
58	58	B. In any proceeding in which the Board is required to serve an
59	59	order on an individual, the Board may send such material to the
60	60	individual's address of record with the Board. If the o rder is
61	61	returned with a notation by the United States Postal S ervice
62	62	indicating that it is undeliverable for any reason, and the records

89	89	of the Board indicate that the Board has not received any change of
90	90	address since the order w as sent, as required by th e rules of the
91	91	Board, the order and any subsequent material re lating to the same
92	92	matter sent to the most recent address on file with the Board shall
93	93	be deemed by the court as having been legally served for all
94	94	purposes. The writt en notice may be served pe rsonally or by
95	95	registered or certified mail to the last -known business and/or
96	96	residence address of the appraiser.
97	97	C. The Board shall have the power to subpoena and issue
98	98	subpoenas duces tecum and to bring before it any person in this
99	99	state, or to take tes timony by deposition, in the same manner as
100	100	prescribed by law in judicial proceedings in the courts of this
101	101	state.
102	102	D. In every case requiring the exe rcise of adjudicative
103	103	authority, the Board s hall provide that discovery be conducted
104	104	pursuant to the provisions of the Oklahoma Discovery Code, Sections
105	105	3224 through 3237 of Title 12 of the Oklahoma Statutes.
106	106	SECTION 2. This act shall become effective November 1, 2022.
