4040 An Act relating to professions and occu pations;

5050 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
5151 SECTION 1. AMENDATORY 59 O.S. 2021, Section 858 -724, is
5252 amended to read as follows:
5353 Section 858-724. A. Before suspending or revoking any
5454 certification, the Real Estate Appraiser Board shall notify the
5555 appraiser in writing of any charges made at least thirty (30) days
5656 prior to the date set fo r the hearing and shall af ford the appraiser
5757 an opportunity to be heard in person or by counsel.
5858 B. In any proceeding in which the Board is required to serve an
5959 order on an individual, the Board may send such material to the
6060 individual's address of record with the Board. If the o rder is
6161 returned with a notation by the United States Postal S ervice
6262 indicating that it is undeliverable for any reason, and the records

8989 of the Board indicate that the Board has not received any change of
9090 address since the order w as sent, as required by th e rules of the
9191 Board, the order and any subsequent material re lating to the same
9292 matter sent to the most recent address on file with the Board shall
9393 be deemed by the court as having been legally served for all
9494 purposes. The writt en notice may be served pe rsonally or by
9595 registered or certified mail to the last -known business and/or
9696 residence address of the appraiser.
9797 C. The Board shall have the power to subpoena and issue
9898 subpoenas duces tecum and to bring before it any person in this
9999 state, or to take tes timony by deposition, in the same manner as
100100 prescribed by law in judicial proceedings in the courts of this
101101 state.
102102 D. In every case requiring the exe rcise of adjudicative
103103 authority, the Board s hall provide that discovery be conducted
104104 pursuant to the provisions of the Oklahoma Discovery Code, Sections
105105 3224 through 3237 of Title 12 of the Oklahoma Statutes.
106106 SECTION 2. This act shall become effective November 1, 2022.
