AS INTRODUCED 
 
An Act relating to professions and occu pations; 
amending 59 O.S. 2021, Section 858 -724, which relates 
to the Oklahoma Certified Real Estat e Appraisers Act; 
authorizing use of discove ry; and providing an 
effective date. 
 
 
 
 
 
BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA: 
SECTION 1.     AMENDATORY     59 O.S. 2021, Section 858 -724, is 
amended to read as follows: 
Section 858-724. A.  Before suspending or revoking any 
certification, the Real Estate Appraiser Board shall notify the 
appraiser in writing of any charges made at least thirty (30) days 
prior to the date set fo r the hearing and shall af ford the appraiser 
an opportunity to be heard in person or by counsel. 
B.  In any proceeding in which the Board is required to serve an 
order on an individual, the Board may send such material to the 
individual's address of record with the Board.  If the o rder is 
returned with a notation by the United States Postal S ervice 
indicating that it is undeliverable for any reason, and the records

of the Board indicate that the Board has not received any change of 
address since the order w as sent, as required by th e rules of the 
Board, the order and any subsequent material re lating to the same 
matter sent to the most recent address on file with the Board shall 
be deemed by the court as having been legally served for all 
purposes.  The writt en notice may be served pe rsonally or by 
registered or certified mail to the last -known business and/or 
residence address of the appraiser. 
C.  The Board shall have the power to subpoena and issue 
subpoenas duces tecum and to bring before it any person in this 
state, or to take tes timony by deposition, in the same manner as 
prescribed by law in judicial proceedings in the courts of this 
state. 
D.  In every case requiring the exe rcise of adjudicative 
authority, the Board s hall provide that discovery be conducted 
pursuant to the provisions of the Oklahoma Discovery Code, Sections 
3224 through 3237 of Title 12 of the Oklahoma Statutes. 
SECTION 2.  This act shall become effective November 1, 2022.
