4040 An Act relating to medical treatments; creating the
4141 Continuity of Care Act of 2022; creating certain
4242 standards for medical practitioners; granting certain
4343 immunities to physicians in certain situ ations;
4444 providing for codification; providing an effective
4545 date; and declaring an emergency.

5050 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
5151 SECTION 1. NEW LAW A new section of law to be codified
5252 in the Oklahoma Statutes as Section 3310 of Title 63, unless there
5353 is created a duplication in numbering, reads as follows:
5454 A. This act shall be known and may be cited as the "Continuity
5555 of Care Act of 2022".
5656 B. If a patient loses access to his or her pr actitioner who
5757 manages his or her controlled medications and necessary
5858 prescriptions and seeks a continuance of the services or medications
5959 being previously provided from a new primary care practitioner, an
6060 emergency room, an urgent care setting, or some other practitioner
6161 who is licensed and regi stered to prescribe controlled medications
6262 in this state, the practitioner shall make a good -faith effort to

8989 preserve the previous dosage and regimen and to make timely
9090 referrals necessary to ensure the patient's c ontinued care.
9191 These referrals may include, but are not limited to:
9292 1. Mental health medication management;
9393 2. Pain medication management; and
9494 3. New primary care practition er.
9595 C. A practitioner providing prescriptions to ensure the
9696 continuity of care to a patient shall be protected from adverse
9797 regulatory action or prosecution of crimes involving prescriptions
9898 for ninety (90) days from the date of the first visit of the patient
9999 when the practitioner is continuing previous doses and regimens for
100100 the patient. Previous dosages and regimens for medications included
101101 in the central repository database may be proven by accessing the
102102 central repository when electronic or phy sical records are
103103 unavailable and documentation is necessary.
104104 SECTION 2. This act shall become effective July 1, 2022.
105105 SECTION 3. It being immediately necessary for the preservation
106106 of the public peace, health or safety, an emergency is hereby
107107 declared to exist, by reas on whereof this act shall take effect and
108108 be in full force from and after its passage and approval.
