AS INTRODUCED 
 
An Act relating to medical treatments; creating the 
Continuity of Care Act of 2022; creating certain 
standards for medical practitioners; granting certain 
immunities to physicians in certain situ ations; 
providing for codification; providing an effective 
date; and declaring an emergency. 
 
 
 
 
BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA: 
SECTION 1.     NEW LAW    A new section of law to be codified 
in the Oklahoma Statutes as Section 3310 of Title 63, unless there 
is created a duplication in numbering, reads as follows: 
A.  This act shall be known and may be cited as the "Continuity 
of Care Act of 2022". 
B.  If a patient loses access to his or her pr actitioner who 
manages his or her controlled medications and necessary 
prescriptions and seeks a continuance of the services or medications 
being previously provided from a new primary care practitioner, an 
emergency room, an urgent care setting, or some other practitioner 
who is licensed and regi stered to prescribe controlled medications 
in this state, the practitioner shall make a good -faith effort to

preserve the previous dosage and regimen and to make timely 
referrals necessary to ensure the patient's c ontinued care. 
These referrals may include, but are not limited to: 
1.  Mental health medication management; 
2.  Pain medication management; and 
3.  New primary care practition er. 
C.  A practitioner providing prescriptions to ensure the 
continuity of care to a patient shall be protected from adverse 
regulatory action or prosecution of crimes involving prescriptions 
for ninety (90) days from the date of the first visit of the patient 
when the practitioner is continuing previous doses and regimens for 
the patient.  Previous dosages and regimens for medications included 
in the central repository database may be proven by accessing the 
central repository when electronic or phy sical records are 
unavailable and documentation is necessary. 
SECTION 2.  This act shall become effective July 1, 2022. 
SECTION 3.  It being immediately necessary for the preservation 
of the public peace, health or safety, an emergency is hereby 
declared to exist, by reas on whereof this act shall take effect and 
be in full force from and after its passage and approval.
