41	41	amending 63 O.S. 2021, Section 1-725.3, which relates
42	42	to health care provider price transparency; creating
43	43	penalties; providing for the allocation of penalties ;
44	44	amending 63 O.S. 2021, Section 1-725.4, which relates
45	45	to health care facility price transparency; creating
46	46	penalties; providing for the allocation of penalties;

54	54	BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
55	55	SECTION 1. AMENDATORY 63 O.S. 2021, Section 1-725.3, is
56	56	amended to read as follows :
57	57	Section 1-725.3 A. A health care provider shall make available
58	58	to the public, in a single do cument, either electronically o r by
59	59	posting conspicuously on the provider 's website if one exists, the
60	60	health care prices for at least the twenty most commo n health care
61	61	services the health care prov ider provides. If the health care
62	62	provider, in the norma l course of his or her practice , regularly
63	63	provides fewer than twenty health care services, the health care

90	90	provider shall make available the health care pr ices for the health
91	91	care services the provi der most commonly provides.
92	92	B. The health care provider shall identify the services by:
93	93	1. A Current Procedural Terminology code or other coding system
94	94	commonly used by the health care provider and accepted as a national
95	95	standard for billing; and
96	96	2. A plain English description.
97	97	C. The health care provider shall update the document as
98	98	frequently as the health care provider deems appropriate, but at
99	99	least annually.
100	100	D. A health care provider not in complia nce with the
101	101	Transparency in Health Care Prices Ac t shall be assessed a penalty
102	102	in the following amounts pursuant to Section 1 -725.4 of this title:
103	103	1. One Thousand Dollars ($1,000.00) per month for health care
104	104	providers with ten or fewer licensed health care profession als at
105	105	the time the infraction is repor ted; or
106	106	2. One Hundred Dollars ($100.00) for each licensed health care
107	107	professional per month for health care providers with more than ten
108	108	licensed health care professionals at the time the infraction is
109	109	reported. This penalty shall not exceed Ten Thousand Dollars
110	110	($10,000.00) per month.
111	111	E. Penalties shall be collected by the State Department of
112	112	Health and deposited into the Health Carrier Access Payment

141	141	SECTION 2. AMENDATORY 63 O.S. 2021, Section 1-725.4, is
142	142	amended to read as foll ows:
143	143	Section 1-725.4 A. A health care facilit y shall make available
144	144	to the public, in a single document, either electronica lly or by
145	145	posting conspicuously on its website if o ne exists, the health care
146	146	prices for at least:
147	147	1. The twenty most used diagnosis -related group codes or other
148	148	codes for inpatient health care services per specialty service line
149	149	used by the health care f acility for billing; and
150	150	2. The twenty most used o utpatient CPT codes or health care
151	151	services procedure codes per specialty service line used for
152	152	billing.
153	153	B. A health care facility shall include with the health care
154	154	prices provided pursuant to subsection A of this section a plain
155	155	English description of t he services for which the health c are prices
156	156	are provided.
157	157	C. The health care facility shall update the document as
158	158	frequently as it deems appropriate, but at least annually.
159	159	D. A health care facility not in compliance with the
160	160	Transparency in Health Care Prices Act shall be assessed a penalty
161	161	in the following amounts:

188	188	1. Three Hundred Dollars ($300.00) per day for a facility with
189	189	thirty or fewer beds at the time the infraction is reported ; or
190	190	2. Ten Dollars ($10.00) for each bed per day for facilit ies
191	191	with more than thirty beds at the time the infraction is reported.
192	192	This penalty shall not exceed Five Thousand Five Hundred Dollars
193	193	($5,500.00) per day.
194	194	E. Penalties shall be collected by the State Department of
195	195	Health and deposited into the Health Carri er Access Payment
196	196	Revolving Fund pursuant to Section 7202 of Title 36 of the Oklahoma
197	197	Statutes.
198	198	SECTION 3. This act shall become effective November 1, 2022.
