4040 An Act relating to medical price transparency;
4141 amending 63 O.S. 2021, Section 1-725.3, which relates

4343 penalties; providing for the allocation of penalties ;

4545 to health care facility price transparency; creating
4646 penalties; providing for the allocation of penalties;

5454 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
5555 SECTION 1. AMENDATORY 63 O.S. 2021, Section 1-725.3, is
5656 amended to read as follows :
5757 Section 1-725.3 A. A health care provider shall make available
5858 to the public, in a single do cument, either electronically o r by
5959 posting conspicuously on the provider 's website if one exists, the
6060 health care prices for at least the twenty most commo n health care
6161 services the health care prov ider provides. If the health care
6262 provider, in the norma l course of his or her practice , regularly
6363 provides fewer than twenty health care services, the health care

9090 provider shall make available the health care pr ices for the health
9191 care services the provi der most commonly provides.
9292 B. The health care provider shall identify the services by:
9393 1. A Current Procedural Terminology code or other coding system
9494 commonly used by the health care provider and accepted as a national
9595 standard for billing; and
9696 2. A plain English description.
9797 C. The health care provider shall update the document as
9898 frequently as the health care provider deems appropriate, but at
9999 least annually.
100100 D. A health care provider not in complia nce with the
101101 Transparency in Health Care Prices Ac t shall be assessed a penalty
102102 in the following amounts pursuant to Section 1 -725.4 of this title:
103103 1. One Thousand Dollars ($1,000.00) per month for health care
104104 providers with ten or fewer licensed health care profession als at
105105 the time the infraction is repor ted; or
106106 2. One Hundred Dollars ($100.00) for each licensed health care
107107 professional per month for health care providers with more than ten
108108 licensed health care professionals at the time the infraction is
109109 reported. This penalty shall not exceed Ten Thousand Dollars
110110 ($10,000.00) per month.
111111 E. Penalties shall be collected by the State Department of
112112 Health and deposited into the Health Carrier Access Payment

141141 SECTION 2. AMENDATORY 63 O.S. 2021, Section 1-725.4, is
142142 amended to read as foll ows:
143143 Section 1-725.4 A. A health care facilit y shall make available
144144 to the public, in a single document, either electronica lly or by
145145 posting conspicuously on its website if o ne exists, the health care
146146 prices for at least:
147147 1. The twenty most used diagnosis -related group codes or other
148148 codes for inpatient health care services per specialty service line
149149 used by the health care f acility for billing; and
150150 2. The twenty most used o utpatient CPT codes or health care
151151 services procedure codes per specialty service line used for
152152 billing.
153153 B. A health care facility shall include with the health care
154154 prices provided pursuant to subsection A of this section a plain
155155 English description of t he services for which the health c are prices
156156 are provided.
157157 C. The health care facility shall update the document as
158158 frequently as it deems appropriate, but at least annually.
159159 D. A health care facility not in compliance with the
160160 Transparency in Health Care Prices Act shall be assessed a penalty

188188 1. Three Hundred Dollars ($300.00) per day for a facility with
189189 thirty or fewer beds at the time the infraction is reported ; or
190190 2. Ten Dollars ($10.00) for each bed per day for facilit ies
191191 with more than thirty beds at the time the infraction is reported.
192192 This penalty shall not exceed Five Thousand Five Hundred Dollars
193193 ($5,500.00) per day.
194194 E. Penalties shall be collected by the State Department of
195195 Health and deposited into the Health Carri er Access Payment
196196 Revolving Fund pursuant to Section 7202 of Title 36 of the Oklahoma
197197 Statutes.
198198 SECTION 3. This act shall become effective November 1, 2022.
