BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA: SECTION 1. AMENDATORY 63 O.S. 2021, Section 1-725.3, is amended to read as follows : Section 1-725.3 A. A health care provider shall make available to the public, in a single do cument, either electronically o r by posting conspicuously on the provider 's website if one exists, the health care prices for at least the twenty most commo n health care services the health care prov ider provides. If the health care provider, in the norma l course of his or her practice , regularly provides fewer than twenty health care services, the health care Req. B. The health care provider shall identify the services by: 1. A Current Procedural Terminology code or other coding system commonly used by the health care provider and accepted as a national standard for billing; and 2. A plain English description. C. The health care provider shall update the document as frequently as the health care provider deems appropriate, but at least annually. D. A health care provider not in complia nce with the Transparency in Health Care Prices Ac t shall be assessed a penalty in the following amounts pursuant to Section 1 -725.4 of this title: 1. One Thousand Dollars ($1,000.00) per month for health care providers with ten or fewer licensed health care profession als at the time the infraction is repor ted; or 2. One Hundred Dollars ($100.00) for each licensed health care professional per month for health care providers with more than ten licensed health care professionals at the time the infraction is reported. This penalty shall not exceed Ten Thousand Dollars ($10,000.00) per month. E. Penalties shall be collected by the State Department of Health and deposited into the Health Carrier Access Payment Req. AMENDATORY 63 O.S. 2021, Section 1-725.4, is amended to read as foll ows: Section 1-725.4 A. A health care facilit y shall make available to the public, in a single document, either electronica lly or by posting conspicuously on its website if o ne exists, the health care prices for at least: 1. The twenty most used diagnosis -related group codes or other codes for inpatient health care services per specialty service line used by the health care f acility for billing; and 2. The twenty most used o utpatient CPT codes or health care services procedure codes per specialty service line used for billing. B. A health care facility shall include with the health care prices provided pursuant to subsection A of this section a plain English description of t he services for which the health c are prices are provided. C. The health care facility shall update the document as frequently as it deems appropriate, but at least annually. D. A health care facility not in compliance with the Transparency in Health Care Prices Act shall be assessed a penalty in the following amounts: Req. Three Hundred Dollars ($300.00) per day for a facility with thirty or fewer beds at the time the infraction is reported ; or 2. Ten Dollars ($10.00) for each bed per day for facilit ies with more than thirty beds at the time the infraction is reported. This penalty shall not exceed Five Thousand Five Hundred Dollars ($5,500.00) per day. E. Penalties shall be collected by the State Department of Health and deposited into the Health Carri er Access Payment Revolving Fund pursuant to Section 7202 of Title 36 of the Oklahoma Statutes.
