1643 An Act relating to public health; amending 63 O.S.

3055 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:

3256 SECTION 1. AMENDATORY 63 O.S. 2021, Section 1 -2504, is
3357 amended to read as follows:

3558 Section 1-2504. A. Any hospital or health care facility
3659 operating within the state may utilize emergency medical technician,
3760 intermediate emergency medical technician, advanced emergency
3861 medical technician or paramedic, community paramedic or critical
3962 care paramedic personne l for the delivery of emergency medical
4063 patient care within the hospital or health care facility. All

4897 B. Any hospital or health care facili ty operating within the
4998 state may utilize community paramedic personnel for the delivery of
5099 community paramedic services for patients who come to the hospital
51100 or health care facility who reside in this state.

53101 C. While participating in an emergency medical technician,
54102 intermediate emergency medical technician, advanced emergency
55103 medical technician, community paramedic or paramedic training course
56104 approved by the State Department of Health, the student shall be
57105 allowed to perform in the hospital, clinic or p rehospital setting,
58106 while under the direct supervision of a physician, registered nurse,
59107 or licensed emergency medical personnel who are licensed at a level
60108 equal to or above the level of training of the student, or other
61109 allied health preceptor, any of th e skills determined to be
62110 appropriate for the training level of the student by the Departmen t.

64111 D. The student shall be allowed to perform any of the skills
65112 determined to be appropriate by the Department for the training
66113 level of the student while performi ng community paramedic services
67114 under the direct supervision of a physician, registered nurs e or

72145 E. A registered nurse or licensed practical nur se may be used
73146 in the back of an ambulance during an inte rhospital transfer to
74147 supplement the skills of licensed emergency medical personnel. A
75148 registered nurse or licensed practical nurse functioning in this
76149 fashion must be following written orders of a physician or be in
77150 direct radio or telephone contact with a physician.

79151 SECTION 2. NEW LAW A new section of law to be codified
80152 in the Oklahoma Statutes as Section 1-2516.1 of Title 63, unless
81153 there is created a duplication in numberi ng, reads as follows:

83154 A. The governing body of any municipality, public ambulance
84155 service district organized pursuant to Sections 1201 through 1221 of
85156 Title 19 of the Oklahoma Statutes , or emergency medical service
86157 district organized pursuant to S ection 9C of Article X of the
87158 Oklahoma Constitution may elect to enter into agreements with local
88159 first responder agencies, whether governmental or nonprofit , for the
89160 purpose of acquiring assistance with emergency medical respons e.

91161 B. All agreements entered into pursuant to subsection A of this
92162 section shall, at a minimum:

94163 1. Determine the required training necessary in order for first
95164 responders to participate under the agreement;

97165 2. Establish a system for identifying which fi rst responders
98166 are eligible to part icipate under the agreement;

100194 3. Establish a process for verifying the training credentials

103196 4. Establish the level of emergency medical care to be provided

106198 5. Determine which party to the agreement shall provide
107199 compensation, if any, and insurance coverage for participating first
108200 responders;

110201 6. Establish a process for ensuring that participating first
111202 responders are familiar and compliant with app licable operating
112203 procedures and standards of care; and

114204 7. Establish the procedures by whic h participating first
115205 responders shall be notified that their assistance is requ ired.

117206 SECTION 3. This act shall become effective November 1, 2022.
