4040 An Act relating to vaccine adverse event reporting;
4141 creating a vaccine adverse reaction hotline;
4242 providing reporting requirements; creating penalties;
4343 requiring reporting; providing for codification; and

5050 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
5151 SECTION 1. NEW LAW A new section of law to be codified
5252 in the Oklahoma Statutes as Section 3410 of Title 63, unless there
5353 is created a duplica tion in numbering, reads as follows:
5454 A. The State Department of Health sh all create, manage, and
5555 operate the Oklahoma State Vaccine Adverse Event Reporting System.
5656 This system shall be accompanied by a hotline to be utilized in
5757 reporting.
5858 B. This hotline shall be supported by the State Department of
5959 Health twenty-four (24) hours a day, three hundred sixty-five (365)
6060 days a year, including holidays.
6161 C. All events reported to the hotline shall be entered into the
6262 federal Vaccine Adverse Event Reporting System by the State

8989 Department of Health, no more than fifteen (15) days from the time
9090 of the report.
9191 D. The State Department of Health s hall create a section on
9292 their official website which will link to information about the
9393 Oklahoma State Vaccine Adverse Event Reporting System. The link
9494 shall be displayed on the homepage of the website and shall b e
9595 easily accessible to the general public for use .
9696 E. Upon confirmation that the e vent(s) have been reported to
9797 the federal Vaccine Adverse Event Reporting System, the State
9898 Department of Health shall sen d confirmation to the reporting
9999 individual or the health care professional who reported the event.
100100 F. Any health care professional who is qualified to administer
101101 vaccinations will have a duty to report any adverse events the
102102 individual knows about, or reasonably should have known about , to
103103 the Oklahoma State Vaccine Adverse Event Reporting System. It shall
104104 be the responsibility of the health care professional to inform the
105105 reporting individual of the confirmation. Failure to report an
106106 event or to communicate confirmation shall be considered
107107 unprofessional conduct subject to licensure disciplinary action by
108108 the respective licensure boar d.
109109 G. Any violation of any provision of this section by a health
110110 care provider will result in a penalty to be determined by the State
111111 Department of Health so long as th e penalty is not excessive in
112112 nature.

139139 H. Annually, the State Department of Health shall deliver a
140140 report to members of both chambers of the State Legislature of the
141141 adverse events reported to the hotline at least three (3) weeks
142142 prior to the start of session . There shall be no personal
143143 identifying health information given in this report, as to ensure
144144 the privacy of individuals.
145145 SECTION 2. This act shall become effective November 1, 2022.
