AS INTRODUCED 
 
An Act relating to vaccine adverse event reporting; 
creating a vaccine adverse reaction hotline; 
providing reporting requirements; creating penalties; 
requiring reporting; providing for codification; and 
providing an effective date. 
 
 
 
 
 
BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA: 
SECTION 1.     NEW LAW     A new section of law to be codified 
in the Oklahoma Statutes as Section 3410 of Title 63, unless there 
is created a duplica tion in numbering, reads as follows: 
A.  The State Department of Health sh all create, manage, and 
operate the Oklahoma State Vaccine Adverse Event Reporting System. 
This system shall be accompanied by a hotline to be utilized in 
reporting. 
B.  This hotline shall be supported by the State Department of 
Health twenty-four (24) hours a day, three hundred sixty-five (365) 
days a year, including holidays. 
C.  All events reported to the hotline shall be entered into the 
federal Vaccine Adverse Event Reporting System by the State

Department of Health, no more than fifteen (15) days from the time 
of the report. 
D.  The State Department of Health s hall create a section on 
their official website which will link to information about the 
Oklahoma State Vaccine Adverse Event Reporting System.  The link 
shall be displayed on the homepage of the website and shall b e 
easily accessible to the general public for use . 
E.  Upon confirmation that the e vent(s) have been reported to 
the federal Vaccine Adverse Event Reporting System, the State 
Department of Health shall sen d confirmation to the reporting 
individual or the health care professional who reported the event. 
F.  Any health care professional who is qualified to administer 
vaccinations will have a duty to report any adverse events the 
individual knows about, or reasonably should have known about , to 
the Oklahoma State Vaccine Adverse Event Reporting System.  It shall 
be the responsibility of the health care professional to inform the 
reporting individual of the confirmation.  Failure to report an 
event or to communicate confirmation shall be considered 
unprofessional conduct subject to licensure disciplinary action by 
the respective licensure boar d. 
G.  Any violation of any provision of this section by a health 
care provider will result in a penalty to be determined by the State 
Department of Health so long as th e penalty is not excessive in 
nature.

H.  Annually, the State Department of Health shall deliver a 
report to members of both chambers of the State Legislature of the 
adverse events reported to the hotline at least three (3) weeks 
prior to the start of session .  There shall be no personal 
identifying health information given in this report, as to ensure 
the privacy of individuals. 
SECTION 2.  This act shall become effective November 1, 2022.
