56 | 65 | | BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA: |

57 | 66 | | SECTION 1. AMENDATORY 11 O.S. 2021, Section 22-110, is |
---|
58 | 67 | | amended to read as fol lows: |

59 | 68 | | Section 22-110. A. The municipal governing body may regulate |
---|
60 | 69 | | or prohibit riots, assau lts, batteries, petty larceny, disturbances |
---|
61 | 70 | | or disorderly assemblies, and immoral or indecent shows, exhibitions |
---|
62 | | - | or concerts, in any street, house or place in the municipality; and |
---|
63 | | - | may regulate, punish, and prevent the discharge of firearms, |
---|
64 | | - | rockets, powder, fireworks, or other dangerously combustible |
---|
65 | | - | material in the streets, lots, grou nds, alleys or about, or in the |
---|

94 | 104 | | otherwise, as provided for in Section 1289.24 of Title 21 of the |

95 | 105 | | Oklahoma Statutes. |
---|
96 | 106 | | B. No municipality shall regulate by order, resolution, |
---|
97 | 107 | | ordinance, regulation, or other legi slation prohibiting the |
---|
98 | 108 | | transport of fireworks, in their unopened original packaging in a |
---|
99 | 109 | | motor vehicle within the municipal limits. No municipality shall |
---|
100 | 110 | | adopt or continue in effect resolutions, ordinances, or regulations |
---|
101 | 111 | | prohibiting the transport of fir eworks in their unopened ori ginal |
---|
102 | 112 | | packaging by a motor vehicle. Local orders, resolutions, |
---|
103 | 113 | | ordinances, regulations, or legislation in violation of this section |
---|
104 | 114 | | are void and unenforceable. |
---|
105 | 115 | | SECTION 2. AMENDATORY 21 O.S. 2021, Section 1321.4, is |
---|
106 | 116 | | amended to read as follows: |

107 | 117 | | Section 1321.4 A. The Governor during the existen ce of a state |
---|
108 | 118 | | of emergency, by proclamation, may, in the area described by the |
---|
109 | 119 | | proclamation, which proclamation shall not cover any part or portion |
---|
110 | 120 | | of the state not affected by public disorde r, disaster, or riot at |
---|
111 | 121 | | the time the proclamation is issued, proh ibit: |
---|
141 | 152 | | 2. A designated numb er of persons, as designated by the |
---|
142 | 153 | | Governor, from assembling or gathering on the public streets, parks, |
---|
143 | 154 | | or other open areas of this state, either public or private; |
---|
144 | 155 | | 3. The manufacture, transfer, use, possession or transportati on |
---|
145 | 156 | | of a molotov cocktail or any other device, instrument or object |
---|
146 | 157 | | designed to explode or pro duce uncontained combustion ; provided, |
---|
147 | 158 | | however, this shall not include explosives or combustibles that are |
---|
148 | 159 | | components used specifically by and for the manufacture of firearm |
---|
149 | 160 | | ammunition; |
---|
150 | 161 | | 4. The transporting, possessing or using of gasol ine, kerosene, |
---|
151 | 162 | | or combustible, flammable, or explosive li quids or materials in a |
---|
153 | 164 | | this shall not apply to the use of said liquids or materials in |
---|
154 | 165 | | connection with the normal operation of motor vehicles, normal home |
---|
155 | 166 | | use or legitimate commercial use or explosives or flammable |
---|
156 | 167 | | materials that are comp onents used specifically by and for the |
---|
157 | 168 | | manufacture of firearm ammunition; |
---|
158 | 169 | | 5. The sale, purchase or dispensing of alcoholic be verages; |
---|
159 | 170 | | 6. The sale, purchase or dispensing of other commodities o r |
---|
160 | 171 | | goods, as the Governor reason ably believes should be prohibited to |
---|
191 | 203 | | 8. Such other activities as the Governor reasonably believes |
---|
192 | 204 | | should be prohibited to help preserve and maintain life, h ealth, |
---|
193 | 205 | | property or the public peace. |
---|
194 | 206 | | B. Notwithstanding th is section or any other law of this state, |
---|
195 | 207 | | neither the Governor nor any official of a municipal or state entity |
---|
196 | 208 | | shall prohibit: |
---|
197 | 209 | | 1. Prohibit or suspend the sale, ownership, possession, |
---|
198 | 210 | | transportation, carrying, transfer and storage of firearms, |
---|
199 | 211 | | ammunition and ammunition accessories during a declared state of |
---|
200 | 212 | | emergency, that are otherwise legal un der state law; or |
---|
201 | 213 | | 2. Prohibit or restrict the business or operations of a |
---|
202 | 214 | | firearms or ammunition manufac turer, distributor, wholesaler, |
---|
203 | 215 | | supplier, retailer, or a gun range. |
---|
204 | 216 | | C. In imposing the restrictions provided for by the Oklahoma |
---|
205 | 217 | | Riot Control and Preve ntion Act, the Governor may impose them for |
---|
206 | 218 | | such times, upon such conditions, with such exceptions and i n such |
---|
207 | 219 | | areas of this state the Governor from time to time deems necessary. |
---|
208 | 220 | | D. Any individual aggrieved by a violation of subsection B of |
---|
209 | 221 | | this section may seek relief in an acti on at law or in equity for |
---|
210 | 222 | | redress against any person who subjects such individ ual or causes |
---|
241 | 254 | | of this section may bring an action for t he return of such firearm |
---|
242 | 255 | | or ammunition in the district court of the county in which that |
---|
243 | 256 | | individual resides or in which suc h firearm or ammunition is |
---|
244 | 257 | | located. In any action or proceeding to enforce the provisions of |
---|
245 | 258 | | this section, the court shall award th e prevailing plaintiff costs |
---|
246 | 259 | | and reasonable attorney fees. |
---|
247 | 260 | | SECTION 3. This act shall become effective November 1, 2022. |
