4049 An Act relating to firearms; amending 11 O.S. 2021,
4150 Section 22-110, which relates to the power of

5665 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
5766 SECTION 1. AMENDATORY 11 O.S. 2021, Section 22-110, is
5867 amended to read as fol lows:
5968 Section 22-110. A. The municipal governing body may regulate
6069 or prohibit riots, assau lts, batteries, petty larceny, disturbances
6170 or disorderly assemblies, and immoral or indecent shows, exhibitions
62-or concerts, in any street, house or place in the municipality; and
63-may regulate, punish, and prevent the discharge of firearms,
64-rockets, powder, fireworks, or other dangerously combustible
65-material in the streets, lots, grou nds, alleys or about, or in the

98+or concerts, in any street, house or place in the municipality; and
99+may regulate, punish, and prevent the discharge of firearms,
100+rockets, powder, fireworks, or other dangerously combustible
101+material in the streets, lots, grou nds, alleys or about, or in the
92102 vicinity of any buildings. The governing body ma y also regulate the
93103 carrying of firearms or other deadly weapons, concealed or
94104 otherwise, as provided for in Section 1289.24 of Title 21 of the
95105 Oklahoma Statutes.
96106 B. No municipality shall regulate by order, resolution,
97107 ordinance, regulation, or other legi slation prohibiting the
98108 transport of fireworks, in their unopened original packaging in a
99109 motor vehicle within the municipal limits. No municipality shall
100110 adopt or continue in effect resolutions, ordinances, or regulations
101111 prohibiting the transport of fir eworks in their unopened ori ginal
102112 packaging by a motor vehicle. Local orders, resolutions,
103113 ordinances, regulations, or legislation in violation of this section
104114 are void and unenforceable.
105115 SECTION 2. AMENDATORY 21 O.S. 2021, Section 1321.4, is
106116 amended to read as follows:
107117 Section 1321.4 A. The Governor during the existen ce of a state
108118 of emergency, by proclamation, may, in the area described by the
109119 proclamation, which proclamation shall not cover any part or portion
110120 of the state not affected by public disorde r, disaster, or riot at
111121 the time the proclamation is issued, proh ibit:

113-parks or at any other public place during the hours declared by the

149+1. Any person being on the public streets, or in the public

141152 2. A designated numb er of persons, as designated by the
142153 Governor, from assembling or gathering on the public streets, parks,
143154 or other open areas of this state, either public or private;
144155 3. The manufacture, transfer, use, possession or transportati on
145156 of a molotov cocktail or any other device, instrument or object
146157 designed to explode or pro duce uncontained combustion ; provided,
147158 however, this shall not include explosives or combustibles that are
148159 components used specifically by and for the manufacture of firearm
149160 ammunition;
150161 4. The transporting, possessing or using of gasol ine, kerosene,
151162 or combustible, flammable, or explosive li quids or materials in a
152-glass or uncapped container of a ny kind except; provided, however,

153164 this shall not apply to the use of said liquids or materials in
154165 connection with the normal operation of motor vehicles, normal home
155166 use or legitimate commercial use or explosives or flammable
156167 materials that are comp onents used specifically by and for the

158169 5. The sale, purchase or dispensing of alcoholic be verages;
159170 6. The sale, purchase or dispensing of other commodities o r
160171 goods, as the Governor reason ably believes should be prohibited to
161-help preserve and maintain life, health, property or the public
162-peace;
163-7. The use of certain streets, highways or publ ic ways by the

199+help preserve and maintain life, health, property or the public
200+peace;
201+7. The use of certain streets, highways or publ ic ways by the
202+public; and
191203 8. Such other activities as the Governor reasonably believes
192204 should be prohibited to help preserve and maintain life, h ealth,
193205 property or the public peace.
194206 B. Notwithstanding th is section or any other law of this state,
195207 neither the Governor nor any official of a municipal or state entity
196208 shall prohibit:
197209 1. Prohibit or suspend the sale, ownership, possession,
198210 transportation, carrying, transfer and storage of firearms,
199211 ammunition and ammunition accessories during a declared state of
200212 emergency, that are otherwise legal un der state law; or
201213 2. Prohibit or restrict the business or operations of a
202214 firearms or ammunition manufac turer, distributor, wholesaler,
203215 supplier, retailer, or a gun range.
204216 C. In imposing the restrictions provided for by the Oklahoma
205217 Riot Control and Preve ntion Act, the Governor may impose them for
206218 such times, upon such conditions, with such exceptions and i n such
207219 areas of this state the Governor from time to time deems necessary.
208220 D. Any individual aggrieved by a violation of subsection B of
209221 this section may seek relief in an acti on at law or in equity for
210222 redress against any person who subjects such individ ual or causes
211-such individual to be subjected to an a ction prohibited by
212-subsection B of this section. In addition to an y other remedy at
213-law or in equity, an individual aggrie ved by the seizure or
214-confiscation of a firearm or ammunition in violation of s ubsection B

250+such individual to be subjected to an a ction prohibited by
251+subsection B of this section. In addition to an y other remedy at
252+law or in equity, an individual aggrie ved by the seizure or
253+confiscation of a firearm or ammunition in violation of s ubsection B
241254 of this section may bring an action for t he return of such firearm
242255 or ammunition in the district court of the county in which that
243256 individual resides or in which suc h firearm or ammunition is
244257 located. In any action or proceeding to enforce the provisions of
245258 this section, the court shall award th e prevailing plaintiff costs
246259 and reasonable attorney fees.
247260 SECTION 3. This act shall become effective November 1, 2022.
