58	61		BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
59	62		SECTION 1. AMENDATORY 21 O.S. 2021, Section 1290.4, is

100	104		CONSTRUING AUTHORITY OF LICENSE

102	106		A. The authority to carry a concealed or unconcealed handgun
103	107		pursuant to a valid handgun license firearm as authorized by the
104	108		provisions of the Oklahoma Self -Defense Act shall not be c onstrued
105	109		to authorize any person to:
106	110		1. Carry or possess any weapon other than an authorized pistol
107	111		firearm as defined by the provis ions of Section 1290.2 Sections
108	112		1289.3, 1289.4, or 1289.5 of this title;
109	113		2. Carry or possess any pistol firearm in any manner or in any
110	114		place otherwise prohibited by law;
111	115		3. Carry or possess any prohibit ed ammunition or any illegal,
112	116		imitation or homemade pistol firearm in violation of state law;
113	117		4. Carry or possess any pistol firearm when the person is
114	118		prohibited by state or federal law from carrying or possessing any
115	119		firearm; or
116	120		5. Point, discharge or use the pistol firearm in any manner not
117	121		otherwise authorized by law.

144	149		B. The availability of a license ability to carry a firearm
145	150		pursuant to the provisions of the Oklahoma Self -Defense Act shall
146	151		not be construed to prohibit the lawful transport or carryi ng of a
147	152		handgun or pistol firearm in a vehicle or on or about the person
148	153		whether concealed or unconcealed, loaded or unloaded, and without a
149	154		valid handgun license as permitted by law.
150	155		SECTION 3. AMENDATORY 21 O.S. 2021, Section 12 90.8, is
151	156		amended to read as follows:

156	161		A. Except as otherwise prohibited by law, an eligible person
157	162		shall have authority to carry a concealed or unconceale d handgun
158	163		firearm in this state when:
159	164		1. The person has been issued a handg un license from the
160	165		Oklahoma State Burea u of Investigation pursuant to the provisions of
161	166		the Oklahoma Self-Defense Act, provided the person is in compliance
162	167		with the provisions of the Okla homa Self-Defense Act, and the
163	168		license has not expired or been subse quently suspended or revoked ;
164	169		or
165	170		2. The person is twenty-one (21) years of age or older, and is
166	171		either:
167	172		a. active military, or

194	200		b. a member of the Reserve or National Guard to include
195	201		Drill Status Guard and Reserve, Active Guard Reserves
196	202		or Military Technicians,
197	203		and presents a valid military ide ntification card that shall be
198	204		considered a valid handgun license issued authorized pursuant to the
199	205		Oklahoma Self-Defense Act provisions of Section 1272 of this titl e.
200	206		B. A person in possession of a valid state photo identification
201	207		card, driver license, or valid handgun license or who meets the
202	208		criteria and presents a valid military identification card as
203	209		provided for in this section and is in compliance with the
204	210		provisions of the Oklahoma Self-Defense Act shall be a uthorized to
205	211		carry such concealed or unc oncealed handgun firearm while scouting
206	212		as it relates to hunting or fishing or while hunting or fishing.
207	213		C. The person shall be required to have possession of his o r
208	214		her valid handgun license or, a valid military identification card
209	215		as provided for qualif ied persons in this section and, a valid
210	216		driver license, or state photo identification card at all times when
211	217		in possession of an authorized pistol a firearm. The person shall
212	218		display the either a valid handgun license or, a valid military
213	219		identification card, a valid driver license, or a valid s tate photo
214	220		identification card as provided for quali fied persons in this
215	221		section on demand of a law enforcement officer; pr ovided, however,
216	222		that in the absence of reasonable and articulable suspicion of other
217	223		criminal activity, an individual carrying an unconcealed or

244	251		concealed handgun firearm shall not be disarmed or physically
245	252		restrained unless the individual fails to displa y a one of the
246	253		following:
247	254		1. A valid handgun license or a;
248	255		2. A valid military identificat ion card;
249	256		3. A valid driver license; or
250	257		4. A valid state pho to identification card,
251	258		as provided for qualified persons in this section in response to
252	259		that demand. Any violation of the provisions of this subsection may
253	260		be punishable as a criminal offense as authorized by Section 1272 of
254	261		this title or pursuant to any other applicable provision of law.
255	262		Upon the arrest of any person for a violation of the provisions
256	263		of this subsection, the person may show proof to the court that a
257	264		valid handgun license and the other required, a valid military
258	265		identification card, a valid driver license, or a valid sta te photo
259	266		identification card has been issued to such person and the pe rson
260	267		may state any reason why the valid handgun license, a valid military
261	268		identification card, valid driver license, or valid state photo
262	269		identification card as provided for qualified persons in this
263	270		section or the other required ide ntification was not carried by the
264	271		person as required by the Oklahoma Self -Defense Act. The court
265	272		shall dismiss an alleged violation of Section 1272 of this title
266	273		upon payment of court costs, if proof of a valid handgun license and
267	274		other required, a valid military identification card, a valid driver

294	302		license, or valid state photo identification card is shown to the
295	303		court within ten (10) days of the arrest of the person. The court
296	304		shall report a dismissal of a charge to the Bureau for consideration
297	305		of administrative proceedings a gainst the licensee.
298	306		D. It shall be unlawful for a ny person to fail or refuse to
299	307		identify the fact that the person is in actual possession of a
300	308		concealed or unconcealed firearm pursuant to the authority of the
301	309		Oklahoma Self-Defense Act during the course o f any arrest,
302	310		detainment, or routine traffic stop. Said The identification to the
303	311		law enforcement officer shall be required upon the demand of the law
304	312		enforcement officer. No person shall be required to identify
305	313		himself or herself as a handgun licensee o r as lawfully in
306	314		possession of any other firearm if the law enforcement officer does
307	315		not demand the information. No person shall be required to identify
308	316		himself or herself as a handgun licensee in possession of a firearm
309	317		when no handgun firearm is in the possession of the person or in any
310	318		vehicle in which the person is driving or is a passenger. Any
311	319		violator of the provisions of this subsection may be issued a
312	320		citation for an amount not exceeding One Hundred Dollars ($100.00).
313	321		E. Any law enforcement offi cer coming in contact with a person
314	322		whose handgun license is suspended, or revoked, or expired, or who
315	323		is in possession of a handgun license which has not been lawfully
316	324		issued to that person, shall confiscate the license and return it to
317	325		the Oklahoma State Bureau of Investigation for appropriate

344	353		administrative proceedings against the licensee whe n the license is
345	354		no longer needed as evidence in any criminal proceeding.
346	355		F. Nothing in this section shall be construed to authorize a
347	356		law enforcement officer to i nspect any weapon properly concealed or
348	357		unconcealed without probable cause that a crime has been committed.
349	358		SECTION 4. AMENDATORY 21 O.S. 2021, Section 1290.24, is
350	359		amended to read as follows:

354	363		A. The state or any political subdivision of the state, as
355	364		defined in Section 152 of Title 51 of the Oklahoma Statutes, and its
356	365		officers, agents and employees shall not be immune from subject to
357	366		liability resulting or arising from:
358	367		1. Failure to prevent the licensin g of an individual for whom
359	368		the receipt of the lice nse is unlawful pursuant to the provisions of
360	369		the Oklahoma Self-Defense Act or any other provision of law of this
361	370		state;
362	371		2. Any action or misconduct with a firearm committed by a
363	372		person pursuant to the pr ovisions of the Oklahoma Self-Defense Act
364	373		or by any person who obtains a firearm;
365	374		3. Any injury to any person during a handgun firearm training
366	375		course conducted by a firearms instructor certified by the Council
367	376		on Law Enforcement Ed ucation and Training to conduct training under
368	377		the Oklahoma Self-Defense Act, or injury from any misfire or

395	405		malfunction of any handgun firearm on a training course firing range
396	406		supervised by a certified firearms instructor under the provisions
397	407		of the Oklahoma Self -Defense Act, or any injury resulting from
398	408		carrying a concealed or unconcealed handgun firearm pursuant to a
399	409		handgun license any firearms training; and
400	410		4. Any action or finding pursuant to a hearing conducted in
401	411		accordance with the Administrative Procedures Act as requi red in the
402	412		Oklahoma Self-Defense Act.
403	413		B. Firearms instructors certified by the Council on Law
404	414		Enforcement Education and Training to conduct training for the
405	415		Oklahoma Self-Defense Act shall not be immune from subject to
406	416		liability to third persons resulting or arising from any claim based
407	417		on an act or omission of a trainee.
408	418		C. The provisions of this sub section shall not apply to claims
409	419		pursuant to the Administrative Workers ' Compensation Act.

415	425		The Legislature finds as a matter of public policy and fact that
416	426		it is necessary to provide statewide uniform standards for issuing
417	427		licenses to carry carrying concealed or unconcealed handguns
418	428		firearms for lawful self-defense and self-protection, and further
419	429		finds it necessary to occupy the field of regulation of the bearing

446	457		of concealed or unconcealed handguns firearms to ensure that no
447	458		honest, law-abiding citizen who qualifie s pursuant to the provisions
448	459		of the Oklahoma Self -Defense Act is subjectively or arbitrarily
449	460		denied his or her rights. The Legislature does not delegate to the
450	461		Oklahoma State Bureau of Investigation any authority to regulate or
451	462		restrict the issuing of han dgun licenses except as provided by the
452	463		provisions of this act the Oklahoma Self-Defense Act. Subjective or
453	464		arbitrary actions or rules which encumber the issuing process by
454	465		placing burdens on the applicant beyond those requirements detailed
455	466		in the provisions of the Oklahoma Self-Defense Act or which creat e
456	467		restrictions beyond those specified in this act the Oklahoma Self-
457	468		Defense Act are deemed to be in conflict with the intent of this act
458	469		the Oklahoma Self-Defense Act and are hereby prohibited. The
459	470		Oklahoma Self-Defense Act shall be liberally construed to carry out
460	471		the constitutional right to bear arms f or self-defense and self-
461	472		protection. The provisions of the Oklahoma Self -Defense Act are
462	473		cumulative to existing rights to bear arms and nothing in the
463	474		Oklahoma Self-Defense Act shall impair or diminish tho se rights.
464	475		However, the conditions that mandate th e administrative actions
465	476		of license denial, suspension, revocation or an administrative fine
466	477		are intended to protect the health, safety and public welfare of the
467	478		citizens of this state. The restricting con ditions specified in the
468	479		Oklahoma Self-Defense Act generally involve the criminal history,
469	480		mental state, alcohol or substance abuse of the applicant or

497	509		officers, or the ability of the Oklahoma Sta te Bureau of
498	510		Investigation to properly administer the Oklahoma Self-Defense Act.
499	511		The restricting conditions that establish a risk of injury or harm
500	512		to the public are tailored to reduce the risks to the be nefit of the
501	513		citizens of this state.
502	514		SECTION 6. AMENDATORY 21 O.S. 2021, Section 1290.26, is
503	515		amended to read as follows:

505	517		RECIPROCAL AGREEMENT AUTHORITY

507	519		A. The State of Oklahoma shall hereby recognizes recognize any
508	520		valid concealed or unconcealed carry weapons per mit, valid military
509	521		identification card as provided for qualified persons in Section
510	522		1290.8 of this title or license issued by another state, or if th e
511	523		state is a nonpermitting carry state, this state shal l reciprocate
512	524		under the permitting law of that stat e.
513	525		A. B. Any person entering this state in possession of a firearm
514	526		authorized for concea led or unconcealed carry upon the authority and
515	527		license of another state or, a valid military identification card , a
516	528		valid driver license, or a valid state photo identification card, as
517	529		provided for qualified persons in Section 1290.8 of this title , is
518	530		authorized to continue to carry a concealed or unconcealed firear m
519	531		and license in this state; provided , the license from the other
520	532		state or, a valid military identificati on card, a valid driver

548	561		qualified persons in Section 1290.8 of this title , remains valid.
549	562		The firearm must either be c arried unconcealed or concealed, and
550	563		upon coming in contact with any peace officer of this state, t he
551	564		person must disclose the fact that he or she is in possession of a
552	565		concealed or unconcealed firearm pursuant to a val id concealed or
553	566		unconcealed carry weapons permit , license or a valid military
554	567		identification card as prov ided for qualified persons in S ection
555	568		1290.8 of this title issued in another state.
556	569		B. C. Any person entering who enters this state in possession
557	570		of a firearm authorized for concealed carry upon the autho rity of a
558	571		state that is a nonpermitted carry state and the person is in
559	572		compliance with the Oklahoma Self -Defense Act, the person is shall
560	573		be authorized to carry a concealed or unconcealed firearm in th is
561	574		state. The firearm must be carried fully concealed , or unconcealed
562	575		and upon in compliance with the laws of this state. When coming in
563	576		contact with any peace law enforcement officer of this state and
564	577		upon instruction from the law enforcement officer , the person must
565	578		disclose the fact that he or she is in possession of a concealed or
566	579		unconcealed firearm pursuant to the nonpermitting law s of the state
567	580		in which he or she is a legal resident. The person shall present
568	581		proper identification by a valid photo ID as proof that he or she is
569	582		a legal resident in such a non-permitting state. The Department of

596	610		Public Safety shall keep a current lis t of non-permitting states for
597	611		law enforcement officers to confirm that a state is nonper mitting.
598	612		C. D. Any person who is twenty-one (21) years of age or older
599	613		having a valid firearm license from another state may apply for a
600	614		handgun license in this state immediately upon establishing a
601	615		residence residency in this state.
602	616		SECTION 7. This act shall become effective November 1, 2022.
