33164 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:

35165 SECTION 1. AMENDATORY 63 O .S. 2021, Section 427.3, is
36166 amended to read as follows:

38167 Section 427.3 A. There is hereby created the Oklahoma Med ical
39168 Marijuana Authority within the State Department of Health which
40169 shall address issues related to the m edical marijuana program in
41170 Oklahoma including, but not limited to, the issuance of patient
42171 licenses and medical mar ijuana business licenses, and the
43172 dispensing, cultivating, processing, testing, transporting, storage,

44199 research, and the use of and sale of medical marijuana pursuant t o
45200 the Oklahoma Medical Marijuana and Patient Protection Act .

47201 B. The Department shall provide support staff to perform
48202 designated duties of the Authority . The Department shall also
49203 provide office space for meetings of the Autho rity.

51204 C. The Department Authority shall implement the provisions of
52205 the Oklahoma Medical Marijuana and Patient Protection Act
53206 consistently with the v oter-approved State Question No. 788,
54207 Initiative Petition No. 412, subje ct to the provisions o f the
55208 Oklahoma Medical Marijuana and Patient Protection Act.

57209 D. The Department Authority shall exercise its respective
58210 powers and perform its respective duties a nd functions as specified
59211 in the Oklahoma Medical Marijuana and Patient Protection Act and
60212 this title including, but not limited to, the following:

62213 1. Determine steps the state shall take, whether administrative
63214 or legislative in nature, to ensure that re search on marijuana and
64215 marijuana products is being conducted for public purposes, including
65216 the advancement of:
66-
67217 a. public health policy and public safety p olicy,
68-
69218 b. agronomic and horticultural best practices, an d
70-
71219 c. medical and pharmacopoeia best practice s;

73220 2. Contract with third-party vendors and other governmental
74221 entities in order to carry out the respect ive duties and functions

78250 3. Upon complaint or upon its own motion and upon a completed
79251 investigation, levy fines as prescribed i n applicable laws, rules,
80252 and regulations and suspend, revoke, or not renew licenses pursuant
81253 to applicable laws, rules, and regulations;

83254 4. Issue subpoenas for the appearance or production of persons,
84255 records, and things in connection with disciplinary or contested
85256 cases considered by the Department Authority;

87257 5. Apply for injunctive or declaratory rel ief to enforce the
88258 provisions of applicable laws, rules , and regulations;

90259 6. Inspect and examine all licensed premises of medical
91-marijuana businesses, research facilities , education facilities, and ENR. H. B. NO. 3208 Page 3
260+marijuana businesses, research facilities , education facilities , and
92261 waste disposal facilities in which medical marijuana is cultivated,
93262 manufactured, sold, stored, transported, tested , distributed, or
94263 disposed of;

96264 7. Upon action by the federal government by which the
97265 production, sale, and use of marijuana in Oklahoma does not vi olate
98266 federal law, work with the Oklahoma State B anking Department and the
99267 State Treasurer to develop good practice s and standards for banking
100268 and finance for medical marijuana businesses;

102269 8. Establish internal control pr ocedures for licenses including
103270 accounting procedures, reporting procedures , and personnel policies;

105297 9. Establish a fee schedule and collect fees f or performing
106298 background checks as t he Commissioner Authority deems appropriate.
107299 The fees charged pursuant to this paragraph shall not exceed the
108300 actual cost incurred for each background che ck;

110301 10. Establish a fee schedule and collect fees for material
111302 changes requested by the licensee; and

113303 11. Establish regulations , which require a medical marijuana
114304 business to submit information to the Oklahoma Medical Marijuana
115305 Authority, deemed reasonably necessary to assist the Authority in
116306 the prevention of diversion of medical marijuana by a license d
117307 medical marijuana business . Such information required by the
118308 Authority may include, but shall not be li mited to:

120309 a. the square footage of the licensed p remises,

122310 b. a diagram of the licensed premises,

124311 c. the number and type of lights at the licensed medi cal
125312 marijuana commercial grower business,

127313 d. the number, type, and production capacity of equipment
128314 located at the medical marijuana processing facility,

130315 e. the names, addresses, and telephone numbers of
131316 employees or agents of a medical marijuana business,

133317 f. employment manuals and standard operating procedures
134318 for the medical marijuana business, and

136319 g. any other information as the Authority reasonably
137320 deems necessary; and

139347 12. Declare and establish a moratorium on processing and
140348 issuing new medical marijuana business licenses pursuant to Section
141349 427.14 of this title for an amount of time the Authority deems
142350 necessary.

144351 SECTION 2. NEW LAW A new section of law to be codified
145352 in the Oklahoma Statutes as Section 427.14a of Title 63, unless
146353 there is created a duplication in numbering, re ads as follows:

148354 A. Beginning August 1, 2022, and ending August 1, 2024, the
149355 Oklahoma Medical Marijuana Authori ty shall, based on the number of
150356 current medical marijuana business licenses for dispensaries,
151357 processors, and commercial growers, declare and establish a
152358 moratorium on processing and issuing new medical marijuana business
153359 licenses for dispensaries, processors, and commercial growers. The
154360 Executive Director of the Authority shall be authorized to te rminate
155361 the moratorium at any time prior to August 1, 2024, if the Execu tive
156362 Director determines that all pending licensing reviews, inspections,
157363 or investigations have been co mpleted by the Authority.

159364 B. The provisions of this section shall not apply to the
160365 renewal of a medical marijuana business license for a dispensary,
161366 processor, or commercial grower under the provisions of Section
162367 427.14 of Title 63 of the Oklahoma Statutes or to the issuance of a
163368 medical marijuana business license necessitated by a change in the
164369 ownership or location of a medical marijuana dispensary, medical
165370 marijuana processor, or medical marijuana commerci al grower;

166397 provided, however, the Authority shall be authorized to deny the
167398 request for issuance of a medical marijuana business license due to
168399 a change in ownership if the licensee is subject to any disciplinary
169400 action that may necessitate the revocation, suspension, or
170401 nonrenewal of the medical marijuana business license .

172402 C. The Authority shall review and process applications for
173403 medical marijuana business license s for dispensaries, processors,
174404 and commercial growers if applications were received on or before
175405 August 1, 2022.

177406 D. The Authority shall promulgate rules as necessary to
178407 implement the provisions of this section.

408+SECTION 3. This act shall become effective July 1, 2022.
409+SECTION 4. It being immediately necessary for the preservation
410+of the public peace, health or safety, an emergency is hereby

412+be in full force from and after its passage and app roval.
