33	164		BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:

35	165		SECTION 1. AMENDATORY 63 O .S. 2021, Section 427.3, is
36	166		amended to read as follows:

38	167		Section 427.3 A. There is hereby created the Oklahoma Med ical
39	168		Marijuana Authority within the State Department of Health which
40	169		shall address issues related to the m edical marijuana program in
41	170		Oklahoma including, but not limited to, the issuance of patient
42	171		licenses and medical mar ijuana business licenses, and the
43	172		dispensing, cultivating, processing, testing, transporting, storage,

47	201		B. The Department shall provide support staff to perform
48	202		designated duties of the Authority . The Department shall also
49	203		provide office space for meetings of the Autho rity.

51	204		C. The Department Authority shall implement the provisions of
52	205		the Oklahoma Medical Marijuana and Patient Protection Act
53	206		consistently with the v oter-approved State Question No. 788,
54	207		Initiative Petition No. 412, subje ct to the provisions o f the
55	208		Oklahoma Medical Marijuana and Patient Protection Act.

57	209		D. The Department Authority shall exercise its respective
58	210		powers and perform its respective duties a nd functions as specified
59	211		in the Oklahoma Medical Marijuana and Patient Protection Act and
60	212		this title including, but not limited to, the following:
61		-
62	213		1. Determine steps the state shall take, whether administrative
63	214		or legislative in nature, to ensure that re search on marijuana and
64	215		marijuana products is being conducted for public purposes, including
65	216		the advancement of:
66		-
67	217		a. public health policy and public safety p olicy,
68		-
69	218		b. agronomic and horticultural best practices, an d
70		-
71	219		c. medical and pharmacopoeia best practice s;
72		-
73	220		2. Contract with third-party vendors and other governmental
74	221		entities in order to carry out the respect ive duties and functions

78	250		3. Upon complaint or upon its own motion and upon a completed
79	251		investigation, levy fines as prescribed i n applicable laws, rules,
80	252		and regulations and suspend, revoke, or not renew licenses pursuant
81	253		to applicable laws, rules, and regulations;

83	254		4. Issue subpoenas for the appearance or production of persons,
84	255		records, and things in connection with disciplinary or contested
85	256		cases considered by the Department Authority;

87	257		5. Apply for injunctive or declaratory rel ief to enforce the
88	258		provisions of applicable laws, rules , and regulations;

90	259		6. Inspect and examine all licensed premises of medical

	260	+	marijuana businesses, research facilities , education facilities , and
92	261		waste disposal facilities in which medical marijuana is cultivated,
93	262		manufactured, sold, stored, transported, tested , distributed, or
94	263		disposed of;

96	264		7. Upon action by the federal government by which the
97	265		production, sale, and use of marijuana in Oklahoma does not vi olate
98	266		federal law, work with the Oklahoma State B anking Department and the
99	267		State Treasurer to develop good practice s and standards for banking
100	268		and finance for medical marijuana businesses;

102	269		8. Establish internal control pr ocedures for licenses including
103	270		accounting procedures, reporting procedures , and personnel policies;

106	298		background checks as t he Commissioner Authority deems appropriate.
107	299		The fees charged pursuant to this paragraph shall not exceed the
108	300		actual cost incurred for each background che ck;

111	302		changes requested by the licensee; and

113	303		11. Establish regulations , which require a medical marijuana
114	304		business to submit information to the Oklahoma Medical Marijuana
115	305		Authority, deemed reasonably necessary to assist the Authority in
116	306		the prevention of diversion of medical marijuana by a license d
117	307		medical marijuana business . Such information required by the
118	308		Authority may include, but shall not be li mited to:

120	309		a. the square footage of the licensed p remises,
121		-
122	310		b. a diagram of the licensed premises,
123		-
124	311		c. the number and type of lights at the licensed medi cal
125	312		marijuana commercial grower business,
126		-
127	313		d. the number, type, and production capacity of equipment
128	314		located at the medical marijuana processing facility,

130	315		e. the names, addresses, and telephone numbers of
131	316		employees or agents of a medical marijuana business,
132		-
133	317		f. employment manuals and standard operating procedures
134	318		for the medical marijuana business, and

136	319		g. any other information as the Authority reasonably
137	320		deems necessary; and

139	347		12. Declare and establish a moratorium on processing and
140	348		issuing new medical marijuana business licenses pursuant to Section
141	349		427.14 of this title for an amount of time the Authority deems
142	350		necessary.

144	351		SECTION 2. NEW LAW A new section of law to be codified
145	352		in the Oklahoma Statutes as Section 427.14a of Title 63, unless
146	353		there is created a duplication in numbering, re ads as follows:
147		-
148	354		A. Beginning August 1, 2022, and ending August 1, 2024, the
149	355		Oklahoma Medical Marijuana Authori ty shall, based on the number of
150	356		current medical marijuana business licenses for dispensaries,
151	357		processors, and commercial growers, declare and establish a
152	358		moratorium on processing and issuing new medical marijuana business
153	359		licenses for dispensaries, processors, and commercial growers. The
154	360		Executive Director of the Authority shall be authorized to te rminate
155	361		the moratorium at any time prior to August 1, 2024, if the Execu tive
156	362		Director determines that all pending licensing reviews, inspections,
157	363		or investigations have been co mpleted by the Authority.

159	364		B. The provisions of this section shall not apply to the
160	365		renewal of a medical marijuana business license for a dispensary,
161	366		processor, or commercial grower under the provisions of Section
162	367		427.14 of Title 63 of the Oklahoma Statutes or to the issuance of a
163	368		medical marijuana business license necessitated by a change in the
164	369		ownership or location of a medical marijuana dispensary, medical
165	370		marijuana processor, or medical marijuana commerci al grower;

167	398		request for issuance of a medical marijuana business license due to
168	399		a change in ownership if the licensee is subject to any disciplinary
169	400		action that may necessitate the revocation, suspension, or
170	401		nonrenewal of the medical marijuana business license .

172	402		C. The Authority shall review and process applications for
173	403		medical marijuana business license s for dispensaries, processors,
174	404		and commercial growers if applications were received on or before
175	405		August 1, 2022.

177	406		D. The Authority shall promulgate rules as necessary to
178	407		implement the provisions of this section.

	408	+	SECTION 3. This act shall become effective July 1, 2022.
	409	+	SECTION 4. It being immediately necessary for the preservation
	410	+	of the public peace, health or safety, an emergency is hereby
	411	+	declared to exist, by reason whereof thi s act shall take effect and
	412	+	be in full force from and after its passage and app roval.
