40	43		An Act relating to motor vehicles; amending 47 O.S.
41	44		2021, Section 596.11, which relates to dealer
42	45		prohibited acts; prohibiting dealers from charging
43	46		certain fees; and providing an effective date .

50	53		BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
51	54		SECTION 1. AMENDATORY 47 O.S. 2021, Section 596.11, is
52	55		amended to read as follows:
53	56		Section 596.11 A. A dealer shall not do any of the following:
54	57		1. If a transient c ustomer requests service work on a
55	58		recreational vehicle of a line -make that the dealer is authorized to
56	59		display and sell, fail to perform any warranty service work
57	60		authorized by a warrantor in a reasonably competent a nd timely
58	61		manner if failure to make suc h repairs would result in a safety
59	62		related issue or might render the recreational vehicle unusable;
60	63		2. Make a fraudulent warranty claim to a warranto r; or
61	64		3. Misrepresent the terms of any warranty; or
62		-	4. Charge consumers predelivery inspection (PD I) fees.

	92	+	4. Charge consumers predelivery inspection (PD I) fees.
89	93		B. A dealer shall indemnify a warrantor for any money paid or
90	94		costs incurred by a warrantor in connection with a claim or cause of
91	95		action asserted agains t the warrantor to the ext ent that payment or
92	96		costs incurred are based on the negligence or intenti onal misconduct
93	97		of the dealer. A dealer shall not limit the obligation to indemnify
94	98		described in this subsection by agreement with the warrantor. The
95	99		warrantor shall provide a deale r with a copy of any claim or
96	100		complaint in which an allegation described in this subsection is
97	101		made within ten (10) days after receiving the claim or complaint.
98	102		SECTION 2. This act shall become effective November 1, 2022.
