5261 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
5362 SECTION 1. AMENDATORY 59 O.S. 2021, Section 521.3, is
5463 amended to read as follows:
5564 Section 521.3 A. A physician assistant licensed in this state
5665 or licensed or authorized to practice in any other U.S. jurisdict ion
5766 or who is credentialed as a physician assistant by a federal
5867 employer who is responding to a need for medical care created by an
59-emergency or a state or local disaster may render such care that the
60-physician assistant is able to provide.
61-B. A physician assistant so responding who voluntarily and
62-gratuitously, and other than in the ordinary course of employment or
63-practice, renders emergency medical assistance shall not be liable

95+emergency or a state or local disaster may render such care that the
96+physician assistant is able to provide.
97+B. A physician assistant so responding who voluntarily and
98+gratuitously, and other than in the ordinary course of employment or
99+practice, renders emergency medical as sistance shall not be liable
90100 for civil damages for any personal injuries that result from acts or
91101 omissions which may constitute ord inary negligence. The immu nity
92102 granted by this section shall not apply to acts or om issions
93103 constituting gross, willful or wanton negligence.
94104 C. Nothing in the Physician Assistant Act shall limit the
95-activities of a physician assistant in the perform ance of his or her
105+activities of a physician assistant in the perform ance of their
96106 duties if the physician assistant is employed by or under cont ract
97107 with the United States Department of Veterans A ffairs or if the
98108 physician assistant is employed by, under contract with, or
99109 commissioned by one of the uniformed services; prov ided, the
100110 physician assistant m ust be currently licensed in this state or an y
101111 other state or currently credentialed as a physici an assistant by
102112 the United States Department of Veterans Affairs or the applicable
103113 uniformed service. Any physician assistant w ho is employed by or
104114 under contract with the United States Department of Vet erans Affairs
105115 or is employed by, under contract with , or commissioned by one of
106116 the uniformed services and practices outside of such employment,
107117 contract, or commission shall be su bject to the Physician Assistan t
108118 Act while practicing outside of such employ ment, contract, or
109-commission. As used in this subsection, "uniformed services" shall
110-have the same meaning as provided by Tit le 10 of the United States
111-Code.
112-SECTION 2. This act shall become ef fective November 1, 2022.
