An Act relating to professions and occupations; 
amending 59 O.S. 2021, Section 521.3, which relates 
to the Physician Assistant Act; limiting scope of act 
with respect to certain physician assistants; 
imposing requirements on physician assistants; 
providing for applicability of Physician Assistant 
Act based upon performance of certain services; 
defining term; and providing an effective date. 
 
 
 
 
BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA: 
SECTION 1.     AMENDATORY     59 O.S. 2021, Section 521.3, is 
amended to read as follows: 
Section 521.3 A.  A physician assistant licensed in this state 
or licensed or authorized to practice in a ny other U.S. jurisdict ion 
or who is credentialed as a physician assistant by a federal 
employer who is responding to a need for medical care created by an 
emergency or a state or local disaster may render such care that the 
physician assistant is able to provide. 
B.  A physician assistant so responding who voluntarily and 
gratuitously, and other than in the ordinary course of employment or 
practice, renders emergency medical assistance shall not be liable

for civil damages for any personal injuries that re sult from acts or 
omissions which may constitute ord inary negligence.  The immu nity 
granted by this section shall not apply to acts or om issions 
constituting gross, w illful or wanton negligence. 
C.  Nothing in the Physician Assistant Act shall limit the 
activities of a physician assistant in the perform ance of his or her 
duties if the physician assistant is employed by or under cont ract 
with the United States Department of Veterans Affairs or if the 
physician assistant is employed by, under contract with, o r 
commissioned by one of the uniformed services; prov ided, the 
physician assistant m ust be currently licensed in this state or an y 
other state or currently credentialed as a physician assistant by 
the United States Department of Veterans Affairs or the app licable 
uniformed service.  Any physician assistant w ho is employed by or 
under contract with the United States Department of Vet erans Affairs 
or is employed by, under con tract with, or commissioned by one of 
the uniformed services and practices outside of such employment, 
contract, or commission shall be su bject to the Physician Assistan t 
Act while practicing outside of such employ ment, contract, or 
commission.  As used in this subsection, "uniformed services" shall 
have the same meaning as provided by Tit le 10 of the United States 
Code. 
SECTION 2.  This act shall become ef fective November 1, 2022.
