41	41	prohibiting discrimination bas ed on vaccination
42	42	status; providing exemptions; defining terms;

50	50	BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
51	51	SECTION 1. NEW LAW A new section of law to be codified
52	52	in the Oklahoma Statutes as Section 1461 of Title 25, unless there
53	53	is created a duplication in numbering, reads as follows:
54	54	A. It is an unlawful discriminatory practice for:
55	55	1. The state or any of its political subdivisions or any entity
56	56	receiving state funding in any form, including grants and property
57	57	tax exemptions, to refuse, withhold from, or deny to a person any
58	58	local, state, or federal funds, services, goods, facilities,
59	59	advantages, privileges, licensing, educational opportunities, health
60	60	care access, or employment opportunities based on a person's
61	61	vaccination status;

88	88	2. An employer to refuse employment to a person, to bar a
89	89	person from employment, or to discriminate against a person in
90	90	compensation or in a term, condition, or privilege of employment
91	91	based on the person's vaccination status;
92	92	3. A public accommodation to exclude, limit, refuse to serve,
93	93	or otherwise discriminate against an individual based on th e
94	94	individual's vaccination status; or
95	95	4. An entity listed in this subsection to implement an immunity
96	96	passport system.
97	97	B. An entity governed by subsection A of this section shall not
98	98	unlawfully discriminate as long as any vaccination policy set forth
99	99	includes exemptions for individuals to decline t o be vaccinated
100	100	based on medical or religious grounds.
101	101	C. As used in this section:
102	102	1. "Immunity passport" means a document, digital record, or
103	103	software application indicating that a person is immune to a
104	104	disease, either through vaccination or infection and recovery ; and
105	105	2. "Vaccination status" means an indication of whether a person
106	106	has received one or more doses of a vaccine.
107	107	SECTION 2. It being immediately necessary for the preservati on
108	108	of the public peace, health or safety, an emergency is hereby
