AS INTRODUCED 
 
An Act relating to vaccine discrimination; 
prohibiting discrimination bas ed on vaccination 
status; providing exemptions; defining terms; 
providing for codification; and declaring an 
emergency. 
 
 
 
 
 
BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA: 
SECTION 1.     NEW LAW     A new section of law to be codified 
in the Oklahoma Statutes as Section 1461 of Title 25, unless there 
is created a duplication in numbering, reads as follows: 
A.  It is an unlawful discriminatory practice for: 
1.  The state or any of its political subdivisions or any entity 
receiving state funding in any form, including grants and property 
tax exemptions, to refuse, withhold from, or deny to a person any 
local, state, or federal funds, services, goods, facilities, 
advantages, privileges, licensing, educational opportunities, health 
care access, or employment opportunities based on a person's 
vaccination status;

2.  An employer to refuse employment to a person, to bar a 
person from employment, or to discriminate against a person in 
compensation or in a term, condition, or privilege of employment 
based on the person's vaccination status; 
3.  A public accommodation to exclude, limit, refuse to serve, 
or otherwise discriminate against an individual based on th e 
individual's vaccination status; or 
4.  An entity listed in this subsection to implement an immunity 
passport system. 
B.  An entity governed by subsection A of this section shall not 
unlawfully discriminate as long as any vaccination policy set forth 
includes exemptions for individuals to decline t o be vaccinated 
based on medical or religious grounds. 
C.  As used in this section: 
1.  "Immunity passport" means a document, digital record, or 
software application indicating that a person is immune to a 
disease, either through vaccination or infection and recovery ; and 
2.  "Vaccination status" means an indication of whether a person 
has received one or more doses of a vaccine. 
SECTION 2.  It being immediately necessary for the preservati on 
of the public peace, health or safety, an emergency is hereby

declared to exist, b y reason whereof this act shall take effect and 
be in full force from and after its passage an d approval.
