55 | 52 | | BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLA HOMA: |

56 | 53 | | SECTION 1. AMENDATORY 70 O.S. 2021, Section 2603, is |
---|
57 | 54 | | amended to read as follows: |
---|
58 | 55 | | Section 2603. A. Except as otherwise provided for in |
---|
59 | 56 | | subsection B of this section and elsewhere in this section, to be |
---|
60 | 57 | | eligible to participate in the Oklahoma Higher Lea rning Access |
---|
61 | 58 | | Program and to qualify for an award which include s payment of an |
---|
62 | 59 | | amount equivalent to resident tuition or other tuition pursuant to |
---|
63 | 60 | | Section 2604 of this title for the first semester or other academic |
---|
64 | 61 | | unit of postsecondary enrollment, a student shall: |
---|
94 | 90 | | both this state and an adjacent state pursuant to a contract as |
---|
95 | 91 | | authorized in Section 5 -117.1 of this title; |
---|
96 | 92 | | 2. Be a United States citizen or lawfully present in the United |
---|
97 | 93 | | States. A student who is not a United States citizen or lawfully |
---|
98 | 94 | | present in the United States shall not be eligible to participate in |
---|
99 | 95 | | the Oklahoma Higher Learning Access Program and to qualify for an |
---|
100 | 96 | | award notwithstanding the provisions of Section 3242 of this title . |
---|
101 | 97 | | The provisions of this paragraph shall not apply to any student who |
---|
102 | 98 | | was enrolled in the Oklahoma Higher Learning Access Program prior to |
---|
103 | 99 | | the end of the 2006-2007 school year; |
---|
104 | 100 | | 3. Have a record of satisfactory compliance with agreements |
---|
105 | 101 | | executed pursuant to Section 2605 of this title; |
---|
106 | 102 | | 4. a. have graduated within the previous three (3) years |
---|
107 | 103 | | from a high school accredited by the State Board of |
---|
108 | 104 | | Education, or the Oklahoma School of Science and |
---|
109 | 105 | | Mathematics with a minimum 2.5 cumulative grade point |
---|
110 | 106 | | average on a 4.0 scale for all work attempted in |
---|
111 | 107 | | grades nine through twelve, |
---|
112 | 108 | | b. have graduated within the previous three (3) years |
---|
113 | 109 | | from a high school not accredited by the State Bo ard |
---|
114 | 110 | | of Education with a mi nimum 2.5 cumulative grade point |
---|
115 | 111 | | average on a 4.0 scale for al l work attempted in |
---|
144 | 139 | | composite score of 22 or higher on the ACT test or a |
---|
145 | 140 | | composite score of 1110 or higher on the SAT , or |
---|
146 | 141 | | c. have satisfactorily completed within t he previous |

147 | 142 | | three (3) years an edu cational program that was |

148 | 143 | | provided through a means other than a public or |

149 | 144 | | private school and have achieved a composite score of |
---|
150 | 145 | | 22 or higher on the ACT test or a composite score of |
---|

---|
152 | 147 | | 5. Have completed the curricular requirements for admission to |
---|
153 | 148 | | an institution within The Oklahoma State System of Higher Education |
---|
154 | 149 | | and one additional unit or set of competencies in a course that |
---|
155 | 150 | | meets college admission requir ements; or have completed the core |
---|
156 | 151 | | curriculum and is seeking admission to an institution overseen by |
---|
157 | 152 | | the State Board of Career an d Technology Education . The curriculum |
---|
158 | 153 | | requirements for admission to an institution within The Oklahoma |
---|
159 | 154 | | State System of Highe r Education shall include two units or sets o f |
---|
160 | 155 | | competencies in foreign or non -English language or techno logy |
---|
161 | 156 | | courses that meet the college admission requirements and one unit or |
---|
162 | 157 | | set of competencies of a fine arts course. Students shall also have |
---|
163 | 158 | | attained a 2.5 grade point average in the core curricu lum courses. |
---|
164 | 159 | | Students who attended a high school which did not offer all the core |
---|
165 | 160 | | curriculum courses or students who were educated by other means a nd |
---|
166 | 161 | | were not offered all the core curriculum courses shall be allo wed to |
---|
195 | 189 | | approved by the State Regents for remediation of high sc hool |
---|
196 | 190 | | curricular deficiencies; |
---|
197 | 191 | | 6. Have satisfied admission sta ndards as determined by the |
---|
198 | 192 | | Oklahoma State Regents for Higher Education for first -time-entering |
---|
199 | 193 | | students for the appropriate type of institution, or, if attending a |
---|
200 | 194 | | private institution, have sat isfied admission standards as |
---|
201 | 195 | | determined by the private instit ution. No student participating in |
---|
202 | 196 | | the Oklahoma Higher Learning Access Program shall be admitted into |
---|
203 | 197 | | an institution of higher education by special admission standards ; |
---|
204 | 198 | | 7. Have secured admissi on to, and enrolled in, an institu tion |
---|
205 | 199 | | which is a member of Th e Oklahoma State System of Higher Education, |
---|
206 | 200 | | a postsecondary vocat ional-technical program offered by a technology |
---|
207 | 201 | | center school that meets the requirements to be eligib le for federal |
---|
208 | 202 | | student financial aid, or a private instituti on of higher learning |
---|
209 | 203 | | located within this state and accredited pursuant to Section 4103 of |
---|
210 | 204 | | this title; and |
---|
211 | 205 | | 8. a. have established financi al need according to the |
---|
212 | 206 | | provisions of subsection D of Sect ion 2605 of this |
---|
213 | 207 | | title and standards and provisions promulga ted by the |
---|
214 | 208 | | Oklahoma State Regents for Higher Education, |
---|
215 | 209 | | b. if the student was adopted between birth and twelve |
---|
216 | 210 | | (12) years of age while in the permanent custody of |
---|
217 | 211 | | the Department of Human Services, in the court-ordered |
---|
246 | 239 | | agency, or federally recognized Indian tribe, as |
---|
247 | 240 | | defined by the federal Indian Child Welfare Act, have |
---|

263 | 256 | | B. 1. A student shall be eligible to participate in the |
---|
264 | 257 | | Oklahoma Higher Learning Access Prog ram and to qualify for an award |
---|
265 | 258 | | which includes payment of an amount equivalent to reside nt tuition |
---|
266 | 259 | | or other tuition pursuant to Section 2604 of this title for the |
---|

360 | 351 | | 2. A student who is eligible to p articipate in the program |
---|
361 | 352 | | pursuant to this subsection shall no t be required to meet the |
---|
362 | 353 | | eligibility requirements set forth in subsection A of this section. |
---|
363 | 354 | | C. To retain eligibility while pursuing the program of higher |
---|
364 | 355 | | learning in which enrolled, the stude nt shall: |
---|
365 | 356 | | 1. Meet the requirement s for retention and degree c ompletion as |
---|
366 | 357 | | established by the institution in which the student is enrolled; |
---|
367 | 358 | | 2. Maintain good academic stan ding and satisfactory academic |
---|
368 | 359 | | progress according to standa rds of the Oklahoma State Regents for |
---|
369 | 360 | | Higher Education; |
---|

404 | 394 | | 5. Refrain from conduct that leads to expuls ion or suspension |
---|
405 | 395 | | of more than one semester from an institu tion of higher education. |
---|
406 | 396 | | A student who violates the provis ions of this paragraph shall |
---|
407 | 397 | | permanently lose eligibility for program benefits. The provisions |
---|
408 | 398 | | of this paragraph shall become effective January 1, 2008. |
---|
409 | 399 | | D. The Oklahoma State Regents for Higher Education and the |
---|
410 | 400 | | State Board of Career and Technology Educa tion shall promulgate |
---|
411 | 401 | | rules relating to maintenance of eligibility under the Oklahoma |
---|
412 | 402 | | Higher Learning Access Act by a student. |
---|
413 | 403 | | E. It is the intent of the Legislature that students in the |
---|
414 | 404 | | ninth grade for the 1992-93 school year who are determined to be |
---|
415 | 405 | | eligible Oklahoma Higher Learni ng Access students pursuant to the |
---|
416 | 406 | | Oklahoma Higher Learning Access Act shall be the first students |
---|
417 | 407 | | eligible for benefits from the Oklahoma Higher Learning Access Trust |
---|
418 | 408 | | Fund. |
---|
419 | 409 | | F. The Oklahoma Sta te Regents for Higher Education ar e |
---|
420 | 410 | | authorized to study, devel op and propose criteria for determining |
---|
