5552 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLA HOMA:
5653 SECTION 1. AMENDATORY 70 O.S. 2021, Section 2603, is
5754 amended to read as follows:
5855 Section 2603. A. Except as otherwise provided for in
5956 subsection B of this section and elsewhere in this section, to be
6057 eligible to participate in the Oklahoma Higher Lea rning Access
6158 Program and to qualify for an award which include s payment of an
6259 amount equivalent to resident tuition or other tuition pursuant to
6360 Section 2604 of this title for the first semester or other academic
6461 unit of postsecondary enrollment, a student shall:
62+1. Be a resident of this state or be enrolled in a sc hool
63+district located in this state that serves students who reside in

92-1. Be a resident of this state or be enrolled in a sc hool
93-district located in this state that serves students who reside in
9490 both this state and an adjacent state pursuant to a contract as
9591 authorized in Section 5 -117.1 of this title;
9692 2. Be a United States citizen or lawfully present in the United
9793 States. A student who is not a United States citizen or lawfully
9894 present in the United States shall not be eligible to participate in
9995 the Oklahoma Higher Learning Access Program and to qualify for an
10096 award notwithstanding the provisions of Section 3242 of this title .
10197 The provisions of this paragraph shall not apply to any student who
10298 was enrolled in the Oklahoma Higher Learning Access Program prior to
10399 the end of the 2006-2007 school year;
104100 3. Have a record of satisfactory compliance with agreements
105101 executed pursuant to Section 2605 of this title;
106102 4. a. have graduated within the previous three (3) years
107103 from a high school accredited by the State Board of
108104 Education, or the Oklahoma School of Science and
109105 Mathematics with a minimum 2.5 cumulative grade point
110106 average on a 4.0 scale for all work attempted in
111107 grades nine through twelve,
112108 b. have graduated within the previous three (3) years
113109 from a high school not accredited by the State Bo ard
114110 of Education with a mi nimum 2.5 cumulative grade point
115111 average on a 4.0 scale for al l work attempted in
112+grades nine through twelve and have achieved a

143-grades nine through twelve and have achieved a
144139 composite score of 22 or higher on the ACT test or a
145140 composite score of 1110 or higher on the SAT , or
146141 c. have satisfactorily completed within t he previous
147142 three (3) years an edu cational program that was
148143 provided through a means other than a public or
149144 private school and have achieved a composite score of
150145 22 or higher on the ACT test or a composite score of
151146 1110 or higher on the SAT ;
152147 5. Have completed the curricular requirements for admission to
153148 an institution within The Oklahoma State System of Higher Education
154149 and one additional unit or set of competencies in a course that
155150 meets college admission requir ements; or have completed the core
156151 curriculum and is seeking admission to an institution overseen by
157152 the State Board of Career an d Technology Education . The curriculum
158153 requirements for admission to an institution within The Oklahoma
159154 State System of Highe r Education shall include two units or sets o f
160155 competencies in foreign or non -English language or techno logy
161156 courses that meet the college admission requirements and one unit or
162157 set of competencies of a fine arts course. Students shall also have
163158 attained a 2.5 grade point average in the core curricu lum courses.
164159 Students who attended a high school which did not offer all the core
165160 curriculum courses or students who were educated by other means a nd
166161 were not offered all the core curriculum courses shall be allo wed to
162+satisfy this curriculum requirement b y participating in a program

194-satisfy this curriculum requirement b y participating in a program
195189 approved by the State Regents for remediation of high sc hool
196190 curricular deficiencies;
197191 6. Have satisfied admission sta ndards as determined by the
198192 Oklahoma State Regents for Higher Education for first -time-entering
199193 students for the appropriate type of institution, or, if attending a
200194 private institution, have sat isfied admission standards as
201195 determined by the private instit ution. No student participating in
202196 the Oklahoma Higher Learning Access Program shall be admitted into
203197 an institution of higher education by special admission standards ;
204198 7. Have secured admissi on to, and enrolled in, an institu tion
205199 which is a member of Th e Oklahoma State System of Higher Education,
206200 a postsecondary vocat ional-technical program offered by a technology
207201 center school that meets the requirements to be eligib le for federal
208202 student financial aid, or a private instituti on of higher learning
209203 located within this state and accredited pursuant to Section 4103 of
210204 this title; and
211205 8. a. have established financi al need according to the
212206 provisions of subsection D of Sect ion 2605 of this
213207 title and standards and provisions promulga ted by the
214208 Oklahoma State Regents for Higher Education,
215209 b. if the student was adopted between birth and twelve
216210 (12) years of age while in the permanent custody of
217211 the Department of Human Services, in the court-ordered
212+custody of a licensed private nonprofi t child-placing

245-custody of a licensed private nonprofi t child-placing
246239 agency, or federally recognized Indian tribe, as
247240 defined by the federal Indian Child Welfare Act, have
248241 established financial need according to the provisions
249242 of paragraph 1 of subs ection E of Section 2605 o f this
250243 title and standards and pro visions promulgated by the
251244 Oklahoma State Regents for Higher Education, or
252245 c. if the student was adopted between thirteen (13) and
253246 seventeen (17) years of age while in the permanent
254247 custody of the Department of Human Servi ces, in the
255248 court-ordered custody of a licensed private nonpro fit
256249 child-placing agency, or federally recognized Indian
257250 tribe, as defined by the federal Indian Child Welfar e
258251 Act, have established financial need according to the
259252 provisions of paragraph 2 of subsection E of Section
260253 2605 of this title and standards and p rovisions
261254 promulgated by the Oklahoma State Regents for Higher
262255 Education.
263256 B. 1. A student shall be eligible to participate in the
264257 Oklahoma Higher Learning Access Prog ram and to qualify for an award
265258 which includes payment of an amount equivalent to reside nt tuition
266259 or other tuition pursuant to Section 2604 of this title for the
267260 first semester or other academic u nit of postsecondary enrollment if
268261 the student meets all of the following criteria:

296288 a. is a child of any person killed after January 1, 2000,
297289 in the line of duty in any branch of the United States
298290 Armed Forces or who died after January 1, 2000, as a
299291 result of an injury sustained while in the line of
300292 duty in any branch of the United States Armed Forces
301293 and the person who wa s killed or died filed an
302294 individual or joint Oklahoma income tax return for the
303295 tax year prior to the year during which the person was
304296 killed or died,
305297 b. is a resident of this state or is enrolle d in a school
306298 district located in this state that serves stu dents
307299 who reside in both thi s state and an adjacent state
308300 pursuant to a contract as authorized in Section 5 -
309301 117.1 of this title,
310302 c. enrolls in an institution within The Oklahoma State
311303 System of Higher Education prior to re aching the age
312304 of twenty-one (21),
313305 d. has satisfied admission standards as determined by the
314306 Oklahoma State Regents for Higher Education for first -
315307 time-entering students for the appropriate type of
316308 institution, or, if attending a private institution,
317309 has satisfied admission standards as de termined by the
318310 private institution. No student participating in the
319311 Oklahoma Higher Learning Access Program shall be

348339 special admission standar ds,
349340 e. has secured admission to, and enrolled in, an
350341 institution which is a member of Th e Oklahoma State
351342 System of Higher Education, a postsecondary
352343 vocational-technical program offered by a techno logy
353344 center school that meets the requirements to be
354345 eligible for federal student fin ancial aid, or a
355346 private institution of higher learning locate d within
356347 this state and accredited pursuant to Section 4103 of
357348 this title, and
358349 f. executes an agreement pursu ant to subsection C of
359350 Section 2605 of this title.
360351 2. A student who is eligible to p articipate in the program
361352 pursuant to this subsection shall no t be required to meet the
362353 eligibility requirements set forth in subsection A of this section.
363354 C. To retain eligibility while pursuing the program of higher
364355 learning in which enrolled, the stude nt shall:
365356 1. Meet the requirement s for retention and degree c ompletion as
366357 established by the institution in which the student is enrolled;
367358 2. Maintain good academic stan ding and satisfactory academic
368359 progress according to standa rds of the Oklahoma State Regents for
369360 Higher Education;

397387 3. Maintain satisfactory academ ic progress as required for
398388 eligibility for federal Title IV student financial aid programs.
399389 The provisions of this paragraph shall become effective for the
400390 2012-2013 school year;
401391 4. Comply with the standards related to mainte nance of
402392 eligibility as promulgated by the Oklahoma State Regents for Higher
403393 Education; and
404394 5. Refrain from conduct that leads to expuls ion or suspension
405395 of more than one semester from an institu tion of higher education.
406396 A student who violates the provis ions of this paragraph shall
407397 permanently lose eligibility for program benefits. The provisions
408398 of this paragraph shall become effective January 1, 2008.
409399 D. The Oklahoma State Regents for Higher Education and the
410400 State Board of Career and Technology Educa tion shall promulgate
411401 rules relating to maintenance of eligibility under the Oklahoma
412402 Higher Learning Access Act by a student.
413403 E. It is the intent of the Legislature that students in the
414404 ninth grade for the 1992-93 school year who are determined to be
415405 eligible Oklahoma Higher Learni ng Access students pursuant to the
416406 Oklahoma Higher Learning Access Act shall be the first students
417407 eligible for benefits from the Oklahoma Higher Learning Access Trust
418408 Fund.
419409 F. The Oklahoma Sta te Regents for Higher Education ar e
420410 authorized to study, devel op and propose criteria for determining

450439 SECTION 2. This act shall become e ffective November 1, 2022.
