14851 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
14952 SECTION 1. NEW LAW A new section of law to be co dified
15053 in the Oklahoma Statutes as Section 30 of Title 30, unless there is
15154 created a duplication in numbering, reads as follows:
15255 A. As used in this act:
15356 1. "Full guardianship" means a relationship where a person has
15457 been appointed by a court to serve as the guardian of an
15558 incapacitated person to ensure that the essential requirements for
15659 the health and safety of the person are met, to manage the estate or
15760 financial resources of the person, or both;
15861 2. "Gravely disabled" means a condition in which a person,
15962 because of a mental disorder, is unable to provide for his or her
16063 basic personal needs for foo d, clothing, or shelter;

18791 3. "Inpatient mental health treatment" means a treatment
18892 service offered or provided for a continuous peri od of more than
18993 twenty-four (24) hours in residence after admission to a mental
19094 health or substance abuse treatment facility for the purpose of
19195 observation, evaluation, or treatment; and
19296 4. "Ward" means a person over whom a guardian is appointed and
19397 a person over whose property a g uardian or conservator is appointed.
19498 B. A guardian who has full guardianship and who has obtained an
19599 order by a court for inpatient mental health treatment for the ward
196100 may apply for an order requiring either municipal or county
197101 officials to retrieve and deliver the gravely disabled ward to an
198102 inpatient treatment facility when one of the following criteria are
199103 met:
200104 1. The ward is unable to utilize the means available to provide
201105 for his or her basic personal needs regarding food, clothing, or
202106 shelter. Considerations that shall be made when making this
203107 evaluation include, but shall not be limited to, the following:
204108 a. whether lab examinations reveal signs of malnutrition
205109 or dehydration,
206110 b. whether there is observed, do cumented behavior showing
207111 an inability to consume adequate amounts of food or
208112 water due to a mental illness,

235140 c. whether there is a history of public nudity or an
236141 inadvertent exhibiti onism which has been observed and
237142 documented and is due to a men tal illness,
238143 d. the existence of physical evidence of exposure to the
239144 environment due to mental illness symptoms which
240145 prevent the ward from wearing adequate c lothing,
241146 e. whether there is observed behavior and symptoms of a
242147 mental illness which prevents the ward from utilizing
243148 or obtaining adequate shelt er,
244149 f. the existence of a repeated and recent history of
245150 failure to maintain adequate shelter in the community
246151 due to behaviors and symptoms of a mental illness, or
247152 g. evidence of a failure to maintain a shelter in a
248153 manner that is safe to live in, due to symptoms of a
249154 mental illness;
250155 2. The ward is unable to voluntarily request and receive
251156 assistance for his or her basic personal needs; or
252157 3. The ward is unable to survive safely without involuntary
253158 detention and does not have the help of family members, friends, or
254159 others to provide the person's basic personal needs regarding food,
255160 clothing, or shelter.
256161 C. No person shall be presumed to be incompetent because the
257162 person has been evaluated or treated f or a mental disorder,

286192 SECTION 2. This act shall become effective November 1, 2022.
