50	50	support for the Council; directing the Council to
51	51	submit report to certain state officials; providing
52	52	for codification; and provi ding an effective date .

58	58	BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
59	59	SECTION 1. NEW LAW A new section of law to be codified
60	60	in the Oklahoma Statutes as Section 1801 of Title 22, unless there
61	61	is created a duplication in numbering, reads as follows:
62	62	A. There is hereby created the Oklahoma Community Corrections
63	63	Modernization Council, hereinafter referred to as the "Council".
64	64	The Council shall:
65	65	1. Study and identify appropriate individuals to be placed in
66	66	community corrections programs;

93	93	2. Review current processes and assessment instruments
94	94	currently in use;
95	95	3. Study and make recom mendations for establishing a community
96	96	corrections program in each judicial district of the state;
97	97	4. Study and make recommendations for establ ishing community
98	98	corrections boards within each judicial district of the state;
99	99	5. Study and identify respo nsibilities of community corrections
100	100	programs which shall include, but not be limited to, oversight of
101	101	felony supervision, alternative court programs , workforce
102	102	evaluations, assessments, and drug-testing procedures;
103	103	6. Study and make recom mendations regarding the collection of
104	104	supervision fees by district attorneys; and
105	105	7. Study, identify, and make recommendations on establishing,
106	106	developing, and improving community corrections programs with the
107	107	cooperation and assistance of state and local agencies.
108	108	B. The Council shall be comprised of thirteen (13) members, to
109	109	be selected as follows:
110	110	1. The Director of the Oklahoma Department of Corrections, or
111	111	designee;
112	112	2. A district attorney for a county or d istrict with a
113	113	population of five hundred thousand (500,000) or more as deter mined
114	114	by the latest Federal Decennial Census, to be selected by the
115	115	Oklahoma District Attorneys Council, or designee;

143	143	population of five hundred thousand (500,000) or less as determined
144	144	by the latest Federal Decennial Census, to be selected by the
145	145	Oklahoma District Attorneys Council, or designee;
146	146	4. A chief of police of a municipality with a population of
147	147	three hundred fifty thousand (350,000) or more as determined by the
148	148	latest Federal Decennial Cens us, to be selected by the Oklahoma
149	149	Association of Chiefs of Police, or designee;
150	150	5. A chief of police of a municipality with a population of
151	151	three hundred fifty thousand (350,00 0) or less as determined by the
152	152	latest Federal Decennial Census, to be selecte d by the Oklahoma
153	153	Association of Chiefs of Police, or designee;
154	154	6. A sheriff of a county with a population of fifty thousand
155	155	(50,000) or more as determined by the latest Federal Decennial
156	156	Census, to be selected by the Oklahoma Sheriffs ' Association, or
157	157	designee;
158	158	7. A sheriff of a county with a population of fifty thousand
159	159	(50,000) or less as determined by the latest Federal Decennial
160	160	Census, to be selected by the Oklahoma Sherif fs' Association, or
161	161	designee;
162	162	8. A public defender of a county with a population o f three
163	163	hundred fifty thousand (350,000) or more as determined by the latest
164	164	Federal Decennial Census, to be selected by the Administrativ e
165	165	Director of the Courts, or design ee;

192	192	9. The Executive Director of the Oklahoma Indigent Defense
193	193	System, or designee;
194	194	10. Two members of the Oklahoma House of Representatives , to be
195	195	appointed by the Speaker of the Oklahoma House of Representatives;
196	196	and
197	197	11. Two members of the Oklahoma Stat e Senate, to be appointed
198	198	by the President Pro Tempore of the Oklahoma State Senate.
199	199	D. The Council shall hold an organizational meeting not later
200	200	than December 1, 2022, and shall select from its membership a chair
201	201	and vice-chair. The Council shall elect any other officers during
202	202	the first meeting and upon a vac ancy in any office.
203	203	E. The chair shall call the first meeting and all subsequent
204	204	meetings shall be made at the call of the chair. The Council may
205	205	meet as often as may be required in order to perf orm the duties
206	206	imposed upon it.
207	207	F. A quorum of the Council shall be required to approve any
208	208	final action and recommendation of the Council. For purposes of
209	209	this section, seven members of the Council shall constitute a
210	210	quorum.
211	211	G. The meetings of the Coun cil shall be subject to the Oklahoma
212	212	Open Meeting Act.
213	213	H. The members of the Council shall receive no compensation,
214	214	but travel reimbursement may be provided by their respective

242	242	State Travel Reimbursement Act.
243	243	I. Administrative support for the Council shall be provided by
244	244	the Department of Corrections .
245	245	J. The Council shall submit a report of its findings and
246	246	recommendations annually by December 31, 20 23, and the same day each
247	247	year thereafter to the Governor, the President Pro Tempore of the
248	248	Oklahoma State Senate and the Speaker of the Oklahoma House of
249	249	Representatives.
250	250	SECTION 2. This act shall become effective November 1, 2022.
