4040 An Act relating to prisons and reformatories;
4141 creating the Oklahoma Community Corrections
4242 Modernization Council; stating duties and purpose of

4646 and vice-chair; providing meeting requirements;
4747 stating what constitutes a quorum; making meetings
4848 subject to the Oklahoma Open Meeting Act; providing
4949 for travel reimbursement; providing ad ministrative

5252 for codification; and provi ding an effective date .

5858 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
5959 SECTION 1. NEW LAW A new section of law to be codified
6060 in the Oklahoma Statutes as Section 1801 of Title 22, unless there
6161 is created a duplication in numbering, reads as follows:
6262 A. There is hereby created the Oklahoma Community Corrections
6363 Modernization Council, hereinafter referred to as the "Council".
6464 The Council shall:
6565 1. Study and identify appropriate individuals to be placed in
6666 community corrections programs;

9393 2. Review current processes and assessment instruments
9494 currently in use;
9595 3. Study and make recom mendations for establishing a community
9696 corrections program in each judicial district of the state;
9797 4. Study and make recommendations for establ ishing community
9898 corrections boards within each judicial district of the state;
9999 5. Study and identify respo nsibilities of community corrections
100100 programs which shall include, but not be limited to, oversight of
101101 felony supervision, alternative court programs , workforce
102102 evaluations, assessments, and drug-testing procedures;
103103 6. Study and make recom mendations regarding the collection of
104104 supervision fees by district attorneys; and
105105 7. Study, identify, and make recommendations on establishing,
106106 developing, and improving community corrections programs with the
107107 cooperation and assistance of state and local agencies.
108108 B. The Council shall be comprised of thirteen (13) members, to
109109 be selected as follows:
110110 1. The Director of the Oklahoma Department of Corrections, or
111111 designee;
112112 2. A district attorney for a county or d istrict with a
113113 population of five hundred thousand (500,000) or more as deter mined
114114 by the latest Federal Decennial Census, to be selected by the
115115 Oklahoma District Attorneys Council, or designee;

142142 3. A district attorney f or a county or district with a
143143 population of five hundred thousand (500,000) or less as determined
144144 by the latest Federal Decennial Census, to be selected by the
145145 Oklahoma District Attorneys Council, or designee;
146146 4. A chief of police of a municipality with a population of
147147 three hundred fifty thousand (350,000) or more as determined by the
148148 latest Federal Decennial Cens us, to be selected by the Oklahoma
149149 Association of Chiefs of Police, or designee;
150150 5. A chief of police of a municipality with a population of
151151 three hundred fifty thousand (350,00 0) or less as determined by the
152152 latest Federal Decennial Census, to be selecte d by the Oklahoma
153153 Association of Chiefs of Police, or designee;
154154 6. A sheriff of a county with a population of fifty thousand
155155 (50,000) or more as determined by the latest Federal Decennial
156156 Census, to be selected by the Oklahoma Sheriffs ' Association, or
157157 designee;
158158 7. A sheriff of a county with a population of fifty thousand
159159 (50,000) or less as determined by the latest Federal Decennial
160160 Census, to be selected by the Oklahoma Sherif fs' Association, or
161161 designee;
162162 8. A public defender of a county with a population o f three
163163 hundred fifty thousand (350,000) or more as determined by the latest
164164 Federal Decennial Census, to be selected by the Administrativ e
165165 Director of the Courts, or design ee;

192192 9. The Executive Director of the Oklahoma Indigent Defense
193193 System, or designee;
194194 10. Two members of the Oklahoma House of Representatives , to be
195195 appointed by the Speaker of the Oklahoma House of Representatives;
196196 and
197197 11. Two members of the Oklahoma Stat e Senate, to be appointed
198198 by the President Pro Tempore of the Oklahoma State Senate.
199199 D. The Council shall hold an organizational meeting not later
200200 than December 1, 2022, and shall select from its membership a chair
201201 and vice-chair. The Council shall elect any other officers during
202202 the first meeting and upon a vac ancy in any office.
203203 E. The chair shall call the first meeting and all subsequent
204204 meetings shall be made at the call of the chair. The Council may
205205 meet as often as may be required in order to perf orm the duties
206206 imposed upon it.
207207 F. A quorum of the Council shall be required to approve any
208208 final action and recommendation of the Council. For purposes of
209209 this section, seven members of the Council shall constitute a
210210 quorum.
211211 G. The meetings of the Coun cil shall be subject to the Oklahoma
212212 Open Meeting Act.
213213 H. The members of the Council shall receive no compensation,
214214 but travel reimbursement may be provided by their respective

241241 organizations within the limits provided for state employees in the
242242 State Travel Reimbursement Act.
243243 I. Administrative support for the Council shall be provided by
244244 the Department of Corrections .
245245 J. The Council shall submit a report of its findings and
246246 recommendations annually by December 31, 20 23, and the same day each
247247 year thereafter to the Governor, the President Pro Tempore of the
248248 Oklahoma State Senate and the Speaker of the Oklahoma House of
249249 Representatives.
250250 SECTION 2. This act shall become effective November 1, 2022.
