No. 8739 Page 1 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 STATE OF OKLAHOMA 2nd Session of the 58th Legislature (2022) HOUSE BILL 3291 By: Humphrey AS INTRODUCED An Act relating to prisons and reformatories; creating the Oklahoma Community Corrections Modernization Council; stating duties and purpose of the Council; stating membership of the Council; requiring organizational meeting to be held by certain date; providing for the selection of a chair and vice-chair; providing meeting requirements; stating what constitutes a quorum; making meetings subject to the Oklahoma Open Meeting Act; providing for travel reimbursement; providing ad ministrative support for the Council; directing the Council to submit report to certain state officials; providing for codification; and provi ding an effective date . BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA: SECTION 1. NEW LAW A new section of law to be codified in the Oklahoma Statutes as Section 1801 of Title 22, unless there is created a duplication in numbering, reads as follows: A. There is hereby created the Oklahoma Community Corrections Modernization Council, hereinafter referred to as the "Council". The Council shall: 1. Review current processes and assessment instruments currently in use; 3. Study and make recom mendations for establishing a community corrections program in each judicial district of the state; 4. Study and make recommendations for establ ishing community corrections boards within each judicial district of the state; 5. Study and identify respo nsibilities of community corrections programs which shall include, but not be limited to, oversight of felony supervision, alternative court programs , workforce evaluations, assessments, and drug-testing procedures; 6. Study and make recom mendations regarding the collection of supervision fees by district attorneys; and 7. Study, identify, and make recommendations on establishing, developing, and improving community corrections programs with the cooperation and assistance of state and local agencies. B. The Council shall be comprised of thirteen (13) members, to be selected as follows: 1. The Director of the Oklahoma Department of Corrections, or designee; 2. A district attorney for a county or d istrict with a population of five hundred thousand (500,000) or more as deter mined by the latest Federal Decennial Census, to be selected by the Oklahoma District Attorneys Council, or designee; Req. A district attorney f or a county or district with a population of five hundred thousand (500,000) or less as determined by the latest Federal Decennial Census, to be selected by the Oklahoma District Attorneys Council, or designee; 4. A chief of police of a municipality with a population of three hundred fifty thousand (350,000) or more as determined by the latest Federal Decennial Cens us, to be selected by the Oklahoma Association of Chiefs of Police, or designee; 5. A chief of police of a municipality with a population of three hundred fifty thousand (350,00 0) or less as determined by the latest Federal Decennial Census, to be selecte d by the Oklahoma Association of Chiefs of Police, or designee; 6. A sheriff of a county with a population of fifty thousand (50,000) or more as determined by the latest Federal Decennial Census, to be selected by the Oklahoma Sheriffs ' Association, or designee; 7. A sheriff of a county with a population of fifty thousand (50,000) or less as determined by the latest Federal Decennial Census, to be selected by the Oklahoma Sherif fs' Association, or designee; 8. A public defender of a county with a population o f three hundred fifty thousand (350,000) or more as determined by the latest Federal Decennial Census, to be selected by the Administrativ e Director of the Courts, or design ee; Req. Two members of the Oklahoma House of Representatives , to be appointed by the Speaker of the Oklahoma House of Representatives; and 11. Two members of the Oklahoma Stat e Senate, to be appointed by the President Pro Tempore of the Oklahoma State Senate. D. The Council shall hold an organizational meeting not later than December 1, 2022, and shall select from its membership a chair and vice-chair. The Council shall elect any other officers during the first meeting and upon a vac ancy in any office. E. The chair shall call the first meeting and all subsequent meetings shall be made at the call of the chair. The Council may meet as often as may be required in order to perf orm the duties imposed upon it. F. A quorum of the Council shall be required to approve any final action and recommendation of the Council. For purposes of this section, seven members of the Council shall constitute a quorum. G. The meetings of the Coun cil shall be subject to the Oklahoma Open Meeting Act. H. The members of the Council shall receive no compensation, but travel reimbursement may be provided by their respective Req. Administrative support for the Council shall be provided by the Department of Corrections . J. The Council shall submit a report of its findings and recommendations annually by December 31, 20 23, and the same day each year thereafter to the Governor, the President Pro Tempore of the Oklahoma State Senate and the Speaker of the Oklahoma House of Representatives.
