6257 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
6358 SECTION 1. AMENDATORY 63 O.S. 2021, Section 1-706a, is
6459 amended to read as follows :
6560 Section 1-706a. A. This section shall be known and may be
6661 cited as the "No Patient Left Alone Act ".
6762 B. Subject to the provisions of subsections D and E of this
6863 section, each minor who is admitted to a hospital licen sed pursuant
64+to Section 1-702 of Title 63 of the Oklahoma Statutes this title,
65+including a minor patient hospitalized with CO VID-19, has the right
66+to have a parent, guardian or person standing in loco parentis who

95-to Section 1-702 of Title 63 of the Oklahoma Statutes this title,
96-including a minor patient hospitalized with CO VID-19, has the right
97-to have a parent, guardian or person standing in loco parentis who
9894 shall have the ability to be physically present while the minor
9995 patient is receiving hospital care.
10096 C. Subject to the provisions of subsections D and E of this
10197 section, each adult who is admi tted to a hospital licensed pursuant
10298 to Section 1-702 of Title 63 of the Oklahoma Statutes this title,
10399 including a patient hospitalized with CO VID-19, has the right to
104100 designate a spouse, or at least one family member or caregiver who
105101 shall have the ability t o be physically present while the adult
106102 patient is receiving hospital car e.
107103 D. A hospital may establish visitation policies that limit or
108104 restrict visitation when:
109105 1. The presence of visitors would be medically or
110106 therapeutically contraindicated in the b est clinical judgment of
111107 health care professionals; however, a diagnosis of COVID-19 alone
112108 shall not constitute a medical or therapeu tic cause for visitation
113109 rights to be removed;
114110 2. The presence of visitors would interfere with the care of or
115111 rights of any patient;
116112 3. Visitors are engaging in disruptive, threatening or violent
117113 behavior toward any staff member, patient or other v isitor; or
118114 4. Visitors are noncompl iant with hospital policy.
115+E. A hospital may require visitors to wear personal protective
116+equipment, provided that any such required equipment shall be
117+provided by the hospital . A hospital may require visitors to compl y

145-E. A hospital may require visitors to wear personal protective
146-equipment, provided that any such required equipment shall be
147-provided by the hospital . A hospital may require visitors to c omply
148145 with reasonable safety protocols a nd rules of conduct. The hospital
149146 may revoke visitation rights for failure to comply with this
150147 section.
151148 F. A hospital may enact policies establishing reasonable
152149 visitation hours; provided, the policies allow for a compassionate
153150 exemption process for twenty-four-hour visitation in end-of-life
154151 scenarios.
155152 G. Nothing in this section shall be construed to require a
156153 hospital to allow a visitor to enter an operating room, isolation
157154 room, isolation unit , behavioral health setting or other typically
158155 restricted area or to remain present during the administration of
159156 emergency care in critical situations . Nothing in this section
160157 shall be construed to require a hospital to allo w a visitor access
161158 beyond the rooms, units or wards in which the p atient the visitor is
162159 visiting is receiving care or beyond general common areas in the
163160 hospital.
164161 G. H. The rights specified in this section may not be
165162 terminated, suspended or waived by the ho spital, the State
166163 Department of Health or any governmental entit y, notwithstanding
167164 declarations of emergency declared by the Governor or the
168165 Legislature. No hospital licensed pursuant to Section 1-702 of
166+Title 63 of the Oklahoma Statutes this title shall require a patient
167+to waive the rights specified in this section.

195-Title 63 of the Oklahoma Statutes this title shall require a patient
196-to waive the rights specified in this section.
197195 H. I. Each hospital licensed pursuant to Section 1-702 of Title
198196 63 of the Oklahoma Statutes this title shall post on its website
199197 informational materials developed by the State Department of Health
200198 explaining the rights specified in this section . The State
201199 Department of Health s hall develop such informational materials and
202200 make the materials available to hospitals for thi s purpose.
203201 I. J. Unless expressly required by federal law o r regulation,
204202 the State Department of He alth or any other state agency shall not
205203 take any action agains t a hospital for:
206204 1. Giving a visitor individual acces s to a hospital-controlled
207205 property or location;
208206 2. Failing to protect or otherwise ensure the sa fety or comfort
209207 of a visitor given acces s to a hospital-controlled property or
210208 location;
211209 3. Failing to follow the guidelines of the Centers for Disease
212210 Control and Prevention or other federal gui delines that require or
213211 recommend restricting visitor access all reasonable facility safety
214212 protocols and rules of conduct ; or
215213 4. The acts or omissions of any vi sitor who is given access to
216214 a hospital-controlled property or location.
215+SECTION 2. NEW LAW A new section of law to be codified
216+in the Oklahoma Statutes as Section 1-706b of Title 63, unless there
217+is created a duplication in numbering, reads as follows:

243-SECTION 2. NEW LAW A new section of law to be codified
244-in the Oklahoma Statutes as Section 1-706b of Title 63, unless there
245-is created a duplication in numbering, reads as follows:
246-A. Where a complaint has been made against a hospital for

247246 violating the No Patient Left Alone Act, a complainant may bring a
248247 civil action against the hospital for:
249-1. Injunctive relief to prevent the hospital from further
250-violations of this section;
251-2. Statutory damages in the amount of Two Thousand Five Hun dred
252-Dollars ($2,500.00) for each day that the defendant violated the No
253-Patient Left Alone A ct; and
254-3. Costs and attorney fees .
255-B. A court may not award relief under this section in response
248+a. injunctive relief to prevent the hospital from further
249+violations of this section,
250+b. statutory damages in the amount of Two Thousand Five
251+Hundred Dollars ($2,500.00) for each day that the
252+defendant violated the No Patient Left Alone A ct, and
253+c. costs and attorney fees .
254+2. A court may not award relief under this section in response
256255 to a violation of the No Patient Left Alone Act if the defendant
257256 demonstrates that th e defendant previously paid the full amount of
258257 statutory damages in a previous action for that particular incident
259258 which violated the No Patient Left Alone Act , or if the defendant
260259 demonstrates that the defendant previously settled a civil action
261260 for the same incident that violated the No Patient Left Alone Act.
262-C. A person may bring an action under the No Patient Left Alone
261+3. A person may bring an action under the No Patient Left Alon e
263262 Act not later than one (1) year after the date of the violations of
264263 the No Patient Left Alone Act.
264+4. A defendant of an action under th is section shall be
265+entitled to costs and attorney fees as the court may find
266+appropriate for any unmerited claims.
267+SECTION 3. This act shall become effecti ve July 1, 2022.
