63 | 58 | SECTION 1. AMENDATORY 63 O.S. 2021, Section 1-706a, is | |

107 | 103 | D. A hospital may establish visitation policies that limit or | |
108 | 104 | restrict visitation when: | |
109 | 105 | 1. The presence of visitors would be medically or | |
110 | 106 | therapeutically contraindicated in the b est clinical judgment of | |
111 | 107 | health care professionals; however, a diagnosis of COVID-19 alone | |
112 | 108 | shall not constitute a medical or therapeu tic cause for visitation | |
113 | 109 | rights to be removed; | |
114 | 110 | 2. The presence of visitors would interfere with the care of or | |
115 | 111 | rights of any patient; | |
116 | 112 | 3. Visitors are engaging in disruptive, threatening or violent | |
117 | 113 | behavior toward any staff member, patient or other v isitor; or | |
118 | 114 | 4. Visitors are noncompl iant with hospital policy. | |

152 | 149 | visitation hours; provided, the policies allow for a compassionate | |
153 | 150 | exemption process for twenty-four-hour visitation in end-of-life | |
154 | 151 | scenarios. | |
155 | 152 | G. Nothing in this section shall be construed to require a | |
156 | 153 | hospital to allow a visitor to enter an operating room, isolation | |
157 | 154 | room, isolation unit , behavioral health setting or other typically | |
158 | 155 | restricted area or to remain present during the administration of | |
159 | 156 | emergency care in critical situations . Nothing in this section | |
160 | 157 | shall be construed to require a hospital to allo w a visitor access | |
161 | 158 | beyond the rooms, units or wards in which the p atient the visitor is | |
162 | 159 | visiting is receiving care or beyond general common areas in the | |
163 | 160 | hospital. | |
164 | 161 | G. H. The rights specified in this section may not be | |
165 | 162 | terminated, suspended or waived by the ho spital, the State | |
166 | 163 | Department of Health or any governmental entit y, notwithstanding | |
167 | 164 | declarations of emergency declared by the Governor or the | |
168 | 165 | Legislature. No hospital licensed pursuant to Section 1-702 of | |
