25112 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLA HOMA:

27113 SECTION 1. AMENDATORY 10A O.S. 2021, Section 2-8-224, is
28114 amended to read as follows:

30115 Section 2-8-224. A. It is unlawful for a person who is under
31116 twenty-one (21) years of age to purchase, receive, or have in his or
32117 her possession a tobacco product, nicotine product or vapor product,
33118 or to present or offer to any person any purported proof of age
34119 which is false or fraudulent, for the purpose of purchasing or
35120 receiving any tobacco product , nicotine product or vapor product.
36121 It shall not be unlawful for an employe e under twenty-one (21) years
37122 of age to handle tobacco products, nicotine products or vapor
38123 products when required in the performance o f the employee's duties.

40150 B. When a person violates subsection A of this section, the
41151 Alcoholic Beverage Laws Enforcement (ABLE) Commission shall impose
42152 an administrative fine:

44153 1. Not to exceed One Hundred Dollars ($100.00) for a first
45154 offense; and

47155 2. Not to exceed Two Hundred Dollars ($200.00) for a second or
48156 subsequent offense within a one-year period following the first
49157 offense.

51158 Upon failure of the individu al to pay the administrative fine
52159 within ninety (90) days of the day of the fine, the ABLE Commis sion
53160 shall notify the Department of Public Safety, and the Department
54161 shall suspend or not issue a driver license to the individual until
55162 proof of payment has been furnished to the Department of Public
56163 Safety require the violator to complete an education o r tobacco use
57164 cessation program approved by the State Department of Health.

59165 C. The ABLE Commission shall establish rules to provide for
60166 notification to a parent or guardian of any minor cited for a
61167 violation of this section.

63168 D. Cities and towns may enac t and municipal police o fficers may
64169 enforce ordinances prohibiting and penalizing conduct under
65170 provisions of this section , but the provisions of such ordinances
66171 shall be the same as provided for in this section, and the
67172 enforcement provisions under such o rdinances shall not be m ore
68173 stringent than those of this section.

70200 E. For the purposes of this section, the term "vapor products"
71201 shall have the same meaning as provided in th e Prevention of Youth
72202 Access to Tobacco Act.
