38	101		BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:

40	102		SECTION 1. AMENDATORY 26 O.S. 2021, Section 14 -105, is
41	103		amended to read as follows:

43	104		Section 14-105. A. Any registered voter may apply for an
44	105		absentee ballot in person at the county election board, by United
45	106		States mail, by telegraph, by facsimile device as defined in Sec tion

74	158		number, the voter shall not be eligible to apply for an absentee
75	159		ballot by means of electronic communicat ion but may apply for an
76	160		absentee ballot pursuant to subsection C of this section.

78	161		4. Identifying information such as birth date and
79	162		identification number shall not be modified online in an existing
80	163		voter registration except as provided in Section 4 -109.4 of this

85	167		criteria provided in Section 7-115.1 of this title shall be required

153	302		SECTION 4. AMENDATORY 26 O.S. 2021, Section 14-115, is

156	304		Section 14-115. A. If the secretary of a cou nty election board
157	305		receives a request from an incapacitated elector confined to a
158	306		nursing facility, as defined in Section 1 -1902 of Title 63 of the
159	307		Oklahoma Statutes, or a veterans center established pursuant to
160	308		Title 72 of the Oklahoma Statutes within the county of the
161	309		jurisdiction of the secretary, and such request satisfies the
162	310		requirements for matching of name, birth date, and identification
163	311		number established pursuant to Section 14 -105 of this title, the
164	312		secretary shall cause to be implemented the following procedures:

166	313		1. On the Thursday, Friday, Satu rday or Monday preceding the
167	314		election, the absentee vot ing board shall deliver to each registered
168	315		voter who is confined to a nursing facility, as defined in Section
169	316		1-1902 of Title 63 of the Oklahoma Statutes, or a veterans center
170	317		established pursuant to T itle 72 of the Oklahoma Statutes and who
171	318		requested ballots for an incapacitated voter the ballots and
172	319		materials as may be necessary to vote same.

174	320		2. The voter must mark the ballots in the manner hereinbefore
175	321		provided in the presence of the absentee voting board, but in such a
176	322		manner as to make it impossible f or any person other than the voter
177	323		to ascertain how the ballots are marked. Insofar as is possible,

181	352		3. The voter shall then seal the ballots in the plain opaque
182	353		envelope and shall seal the plain opaque envelope in the envelope
183	354		bearing an affidavit. The voter must complete the affidavit, and
184	355		the signature of the voter on same must be witnessed by both members
185	356		of the absentee voting board.

187	357		4. The envelope bearing an affidavit then must be sealed in the
188	358		return envelope, which shall be returned by the absentee voting
189	359		board to the secretary of the county election board on the same day
190	360		the affidavit was exec uted.

192	361		5. Ballots cast in such manner shall be counted in the same
193	362		manner as regular mail absentee ballots.

195	363		B. The voter may request the assistance of the absentee voting
196	364		board members to mark a ballot, complete the affidavit or seal t he
197	365		envelopes as described in this section.

199	366		C. 1. An administrator or empl oyee of a nursing facility or
200	367		veterans center who attemp ts to coerce or influence the vote of a
201	368		person residing in or confined to that facility shall be deemed to
202	369		be in violation of Section 16-109 of this title.

335	613		F. This act does not preclude a covered voter from voting unde r
336	614		the provisions of Se ction 14-101 et seq. of Title 26 of the Oklahoma
337	615		Statutes this title.

339	616		SECTION 8. This act shall become effective July 1, 2022.

341	617		SECTION 9. It being immediately nece ssary for the preservation
342	618		of the public peace, health or safety, an emergency is hereby
343	619		declared to exist, by reason whereof this act shall ta ke effect and
344		-	be in full force from and after its passage and approval.

	710	+	BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOM A:
	711	+	SECTION 10. AMENDATORY 26 O.S. 2021, Section 14 -105, is
	712	+	amended to read as follows:
	713	+	Section 14-105. A. Any registered voter may apply for an
	714	+	absentee ballot in person at the county election boa rd, by United
	715	+	States mail, by telegraph, by facsimile device as defined in Sec tion
	716	+	1862 of Title 21 of the Oklahoma Statutes o r by a means of
	717	+	electronic communication d esignated by the Secretary of the State
	718	+	Election Board. The Secretary of the State Elec tion Board shall
	719	+	prescribe a form to be used for the application, although any
	720	+	application setting forth substantially the sam e facts shall be
	721	+	valid.

	748	+	B. 1. A registered voter applying for an absentee ballot by
	749	+	means of electronic communication shall provide his or her name,
	750	+	birth date, and an identification number.
	751	+	2. The identification number provided must match the
	752	+	identification number on the voter registration in order to apply
	753	+	for an absentee ballot pursuant to this subsection .
	754	+	3. If the name, birth date, or identification number provided
	755	+	does not match the voter registrat ion, the voter shall be informed
	756	+	that the county election board is unable to find the registration
	757	+	with the provided information and that the voter should contact the
	758	+	county election board to resolve the issue.
	759	+	4. If the voter does not have a birth date or identification
	760	+	number on his or her voter registration and wants to use electronic
	761	+	communication to apply for an absentee ballot, the voter shall
	762	+	complete a new voter registration to include such birth date and
	763	+	identification number.
	764	+	5. Identifying information such as birth date and
	765	+	identification number shall not be modified online in an existing
	766	+	voter registration, except as provided in Section 4 -109.4 of this
	767	+	title. A voter who does not have an identification number on his or
	768	+	her voter registration may apply for absentee ballots pursuant to
	769	+	subsection C of this section.
	770	+	6. No later than January 1, 2023, a registered voter applying
	771	+	for an absentee ballot pursuant to this subsection who meets the
	772	+

	801	+	C. 1. A registered voter applying for an absentee ballot in

	806	+	3. If the voter registration did not include an identification
	807	+	number, no identification number shall be required on the absentee
	808	+	ballot application.
	809	+	4. If the voter does not recall which identification number he
	810	+	or she included on the voter r egistration, the voter may provide
	811	+	multiple identification numbers, at least one of which must match
	812	+	the identification number on the voter registration if the voter
	813	+	registration included an identification number.
	814	+	5. If the voter registration do es not have an identification
	815	+	number, then the absentee ballot application shall be accepted
	816	+	without a match of an identification number.
	817	+	D. For purposes of this section, "identification number" means
	818	+	a number submitted on the registration application pursuant to
	819	+	paragraph 3 of subsection A of Section 4-112 of this title.
	820	+	SECTION 11. This act shall become effective July 1, 2022.
