5952 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
6053 SECTION 1. NEW LAW A new section of law not to be
6154 codified in the Oklahoma Statutes reads as follows:
6255 The Oklahoma Legislature finds that persons who have been
6356 incarcerated may find it difficult to secure employment unless they
6457 have reliable methods of transportation both to and from work. The
6558 Legislature finds that it is desirable public policy and in
6659 furtherance of an essential governmental function to provide a means
6760 by which such persons, as further provided by this act, may make
61+positive contribution s in the economy, demonstrate the ability to
62+perform well and consistently in employment environment s, contribute
63+to their own sense of well-being and self-worth and to provide

95-positive contribution s in the economy, demonstrate the ability to
96-perform well and consistently in employment environments, contribute
97-to their own sense of well-being and self-worth and to provide
9890 financial support for family members. The Legislature finds that
9991 making surplus state vehicles available through the program created
10092 pursuant to the provisions of this act constitutes an effect ive
10193 means to promote the well-being of the persons identifi ed in this
10294 act and through the use of selected nonprofit entities in the
10395 selection process and monitoring the use of such vehicles the State
10496 of Oklahoma is likely to benefit from the payment of in come taxes
10597 based on compensation paid to these persons, sale s taxes on
10698 purchases made with their disposable income, motor fuel taxes, and
10799 any number of other state or local taxes that are derived from the
108100 economic activity of persons who might not other wise be in a
109101 position to make such contributions to the state o r local economies.
110102 SECTION 2. NEW LAW A new section of law to be codified
111103 in the Oklahoma Statutes as Section 62.10 of Title 74, unless there
112104 is created a duplication in numbering, read s as follows:
113105 The Office of Management and Ente rprise Services (OMES) shall
114106 promulgate rules and any necessary procedures to develop a program
115107 allowing for the distribution of state surplus vehicles to certain
116108 nonprofit organizations in this state. Eligible nonprofit
117109 organizations shall be those that offer assistance to certain
118110 persons recently released from prisons in this state. The OMES
111+shall coordinate with applying nonprofit organizations and the
112+Department of Corrections, if required, to make the distributions.

146-shall coordinate with applying nonprofit organizations and the
147-Department of Corrections, if required, to make the distributions.
148139 The program shall include , but not be limited to, the following
149140 specifications:
150141 1. The OMES shall establish set criteria regarding which state
151142 surplus vehicles qualify for distribution in the program. In making
152143 the determination, the OMES may consider the actual market value of
153144 the surplus vehicle, roadworthiness of the vehicle, type of vehicle,
154145 the number of surplus vehicles the state has in inventory, or other
155146 relevant considerations.
156147 2. Eligible nonprofit organizations may make an application to
157148 the OMES for available surplus vehicles that meet the criteria for
158149 distribution under thi s section.
159150 3. Former prisoner eligibility for the program shall be based
160151 upon a screening process devel oped by the nonprofit organization or
161152 by the nonprofit in conjunction with OMES. Considerations for the
162153 eligibility of a former prisoner for the program shall include, but
163154 not be limited to, the nature of the cri me in which the person was
164155 convicted, if the sentence was served, and an evaluation need based
165156 on the income of the person. However, no person convicted of a
166157 violent crime or a sex crime shall be el igible for the program.
167158 4. Upon a receiving a new conviction, persons who qualified for
168159 the program and received a v ehicle through the program shall forfeit
169160 any rights to the vehicle received from the program.
161+5. The OMES shall have discretion in determining the method for
162+which surplus vehicles shall be distributed under this section.

197-5. The OMES shall have discretion in determining the method for
198-which surplus vehicles shall be distributed under this section.
199189 OMES may transfer the title of the surplus vehicle to the nonprofit
200190 organization or may consider a lease arrangement with the nonprofit.
201191 However, if a lease arra ngement is determined to be the means of
202192 distribution, lease payments shall be below the market value of
203193 similar vehicles.
204194 SECTION 3. This act shall become effective November 1, 2022.
