BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA: SECTION 1. NEW LAW A new section of law not to be codified in the Oklahoma Statutes reads as follows: The Oklahoma Legislature finds that persons who have been incarcerated may find it difficult to secure employment unless they have reliable methods of transportation both to and from work. The Legislature finds that it is desirable publi c policy and in furtherance of an essential governmental function to provide a means by which such persons, as further provided by this act, may make HB3372 HFLR Page 2 BOLD FACE denotes Committee Amendments. 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 positive contribution s in the economy, demonstrate the ability to perform well and consistently in employment environments, contribute to their own sense of well-being and self-worth and to provide financial support for family members. The Legislature finds that making surplus state vehicles available through the program created pursuant to the provisions of this act constitutes an effect ive means to promote the well-being of the persons identifi ed in this act and through the use of selected nonprofit entities in the selection process and monitoring the use of such vehicles the State of Oklahoma is likely to b enefit from the payment of in come taxes based on compensation paid to these persons, sale s taxes on purchases made with their disposable income, motor fuel taxes, and any number of other state or local taxes that are derived from the economic activity of p ersons who might not other wise be in a position to make such contributions to the state o r local economies. SECTION 2. NEW LAW A new section of law to be codified in the Oklahoma Statutes as Section 62.10 of Title 74, unless there is created a duplication in numbering, read s as follows: The Office of Management and Ente rprise Services (OMES) shall promulgate rules and any necessary procedures to develop a program allowing for the distribution of state surplus vehicles to certain nonprofit organizations in this state. Eligible nonprofit organizations shall be those that offer assistance to certain persons recently released from prisons in this state. The program shall include , but not be limited to, the following specifications: 1. The OMES shall establish set criteria regarding which state surplus vehicles qualify for distribution in the program . In making the determination, the OMES may consider the actual market value of the surplus vehicle, roadworthiness of the vehicle, type of vehicle, the number of surplus vehicles the state has in inventory, or other relevant considerations. 2. Eligible nonprofit organizations may make an application to the OMES for available surplus vehicles that meet the criteria for distribution under thi s section. 3. Former prisoner eligibility for the program shall be based upon a screening process devel oped by the nonprofit organization or by the nonprofit in conjunction with OMES. Considerations for the eligibility of a former prisoner for the program shall include, but not be limited to, the nature of the cri me in which the person was convicted, if the sentence was served, and an evaluation need based on the income of the person. However, no person convicted of a violent crime or a sex crime shall be el igible for the program. 4. Upon a receiving a new conviction, persons who qualified for the program and receive d a vehicle through the program shall forfeit any rights to the vehicle received from the program. The OMES shall have discretion in determining the method for which surplus vehicles shall be distributed under this section. OMES may transfer the title of the surplus vehicle to the nonprofit organization or may consider a lease arrangement with the nonprofit. However, if a lease arra ngement is determined to be the means of distribution, lease payments shall be below the market value of similar vehicles. SECTION 3.
