5050 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
5151 SECTION 1. AMENDATORY 82 O.S. 2021, Section 1085.30 , is
5252 amended to read as follows:
5353 Section 1085.30 A. 1. In order to effectuate a comprehensive
5454 program to assist in the prevention, control and abatement of
5555 pollution of the waters of this state, and in order to e stablish
5656 state standards which comply wit h the Federal Water Pollution
5757 Control Act as amended, the Oklahoma Water Resources Board
5858 Department of Environmental Quality is authorized to promulgate
5959 rules to be known as "Oklahoma Water Quality Standards " which
6060 establish classifications of uses of wate rs of the state, criteria
6161 to maintain and protect such classifications, and other standards or
6262 policies pertaining to the quality of such waters.

8989 2. The Oklahoma Water Quality Standards shall, at a minimum, be
9090 designed to maintain and protect the quality of the waters of the
9191 state.
9292 3. Wherever the Environmental Quality Board finds it is
9393 practical and in the public int erest to do so, the rules may be
9494 amended to upgrade and improve progressively the quality of waters
9595 of the state.
9696 4. a. The Board may also amend Oklahoma Water Quality
9797 Standards to downgrade a designated u se of any waters
9898 of this state which is not an exi sting use, may
9999 establish subcategories of a use or may provide for
100100 less stringent criteria or other provisions thereof
101101 only in those limited circumstances permissible un der
102102 the Federal Water Pollution Contr ol Act as amended or
103103 federal rules which implement the act.
104104 b. The Board may amend the Oklahoma Water Quality
105105 Standards to downgrade a desi gnated use, establish
106106 subcategories of a use or may provide for less
107107 stringent criteria or other provisions thereof o nly to
108108 the extent as will maintain or improve the existing
109109 uses and the water quality of the water affected;
110110 provided, however, the Board shall not modify the
111111 Oklahoma Water Quality Standards applicable to scenic
112112 river areas as such areas are described by Section

140140 establish a subcategory of a use or provide for less
141141 stringent criteria or other provisions thereof.
142142 5. The Board shall propose any necessary rules to allow for the
143143 development of nutrient tradin g programs by state environmental
144144 agencies no later than November 1, 2026.
145145 B. 1. Prior to adopting such standards o r any amendment
146146 thereof, the Board shall conduct public hearings thereon . Notice of
147147 such hearing shall be published in accordance with the
148148 Administrative Procedures Act and shall be mai led at least twenty
149149 (20) days before such public hearing to the chief executive of each
150150 municipality and county in the area affected and shall be mailed to
151151 all affected holders of permits obtained pursuant to the Oklahoma
152152 Environmental Code, and such other persons that have requested
153153 notice of hearings on such sta ndard modifications.
154154 2. If adoption or amendment of a classification to a lower or
155155 downgraded classification is proposed because treatment controls
156156 required of the current or a higher or upgraded classification would
157157 result in substantial and widespread s ocial and economic impact, the
158158 Board shall, in addition to any hearing re quired by subsection B of
159159 this section, conduct a public meeting within a cen tral location
160160 within the area to be affected . The Board shall cause notice of
161161 such additional public meeting to be published for at least two (2)

188188 consecutive weeks in a newspaper of general circulation published in
189189 the county or counties in the area affec ted.
190190 C. 1. The Oklahoma Water Quality Stand ards, their accompanying
191191 use support assessment protocols, anti -degradation policy and
192192 implementation, and policies general ly affecting Oklahoma W ater
193193 Quality Standards appli cation and implementation including , but not
194194 limited to, mixing zones, low flows a nd variances or any
195195 modification or change thereof shall be promulgated by the Board in
196196 compliance with the Admi nistrative Procedures Act and shal l be
197197 enforced by all state a gencies within the scope of their
198198 jurisdiction. All use support assessment protoc ols promulgated by
199199 the Board shall be consistent with state and federal law and
200200 guidance specifically related to beneficial use support
201201 determinations as set forth in Section 305(b) of the Federal Water
202202 Pollution Control Act, where applicable.
203203 2. In promulgating Oklahoma Water Quality Standards or making
204204 any modification or change thereof, the Board shall announce a
205205 reasonable time for persons disc harging waste into the water s of the
206206 state to comply with such ne w or modified standards unless such
207207 discharges create an actual or potential hazard to public health.
208208 3. Any discharge in accord with such standards of the Board and
209209 in compliance with rules , requirements and wasteload allocations
210210 established by the Depar tment of Environmental Quality and with

237237 rules promulgated by other state environmental agencies shall not be
238238 deemed to be pollution.
239239 4. Notwithstanding the implementation jurisdiction provid ed to
240240 the Board in paragraph 1 of subsection C of this section, t he
241241 Department of Environmental Quality shall have jurisdiction to
242242 develop and utilize policies and requirements, as provided in
243243 paragraph 22 of subsection B of Section 1 -3-101 of Title 27A of the
244244 Oklahoma Statutes.
245245 SECTION 2. AMENDATORY 82 O.S. 2021, Section 1085.30a, is
246246 amended to read as follows:
247247 Section 1085.30a. Oklahoma Water Quality S tandards, promulgated
248248 by the Oklahoma Water Resources Board Department of Environmental
249249 Quality, shall designate:
250250 1. Watersheds that are nutri ent-limited; and
251251 2. Groundwaters that are nutrient -vulnerable.
252252 SECTION 3. This act shall become effective November 1, 2022.
