50	50	BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
51	51	SECTION 1. AMENDATORY 82 O.S. 2021, Section 1085.30 , is
52	52	amended to read as follows:
53	53	Section 1085.30 A. 1. In order to effectuate a comprehensive
54	54	program to assist in the prevention, control and abatement of
55	55	pollution of the waters of this state, and in order to e stablish
56	56	state standards which comply wit h the Federal Water Pollution
57	57	Control Act as amended, the Oklahoma Water Resources Board
58	58	Department of Environmental Quality is authorized to promulgate
59	59	rules to be known as "Oklahoma Water Quality Standards " which
60	60	establish classifications of uses of wate rs of the state, criteria
61	61	to maintain and protect such classifications, and other standards or
62	62	policies pertaining to the quality of such waters.

89	89	2. The Oklahoma Water Quality Standards shall, at a minimum, be
90	90	designed to maintain and protect the quality of the waters of the
91	91	state.
92	92	3. Wherever the Environmental Quality Board finds it is
93	93	practical and in the public int erest to do so, the rules may be
94	94	amended to upgrade and improve progressively the quality of waters
95	95	of the state.
96	96	4. a. The Board may also amend Oklahoma Water Quality
97	97	Standards to downgrade a designated u se of any waters
98	98	of this state which is not an exi sting use, may
99	99	establish subcategories of a use or may provide for
100	100	less stringent criteria or other provisions thereof
101	101	only in those limited circumstances permissible un der
102	102	the Federal Water Pollution Contr ol Act as amended or
103	103	federal rules which implement the act.
104	104	b. The Board may amend the Oklahoma Water Quality
105	105	Standards to downgrade a desi gnated use, establish
106	106	subcategories of a use or may provide for less
107	107	stringent criteria or other provisions thereof o nly to
108	108	the extent as will maintain or improve the existing
109	109	uses and the water quality of the water affected;
110	110	provided, however, the Board shall not modify the
111	111	Oklahoma Water Quality Standards applicable to scenic
112	112	river areas as such areas are described by Section

140	140	establish a subcategory of a use or provide for less
141	141	stringent criteria or other provisions thereof.
142	142	5. The Board shall propose any necessary rules to allow for the
143	143	development of nutrient tradin g programs by state environmental
144	144	agencies no later than November 1, 2026.
145	145	B. 1. Prior to adopting such standards o r any amendment
146	146	thereof, the Board shall conduct public hearings thereon . Notice of
147	147	such hearing shall be published in accordance with the
148	148	Administrative Procedures Act and shall be mai led at least twenty
149	149	(20) days before such public hearing to the chief executive of each
150	150	municipality and county in the area affected and shall be mailed to
151	151	all affected holders of permits obtained pursuant to the Oklahoma
152	152	Environmental Code, and such other persons that have requested
153	153	notice of hearings on such sta ndard modifications.
154	154	2. If adoption or amendment of a classification to a lower or
155	155	downgraded classification is proposed because treatment controls
156	156	required of the current or a higher or upgraded classification would
157	157	result in substantial and widespread s ocial and economic impact, the
158	158	Board shall, in addition to any hearing re quired by subsection B of
159	159	this section, conduct a public meeting within a cen tral location
160	160	within the area to be affected . The Board shall cause notice of
161	161	such additional public meeting to be published for at least two (2)

188	188	consecutive weeks in a newspaper of general circulation published in
189	189	the county or counties in the area affec ted.
190	190	C. 1. The Oklahoma Water Quality Stand ards, their accompanying
191	191	use support assessment protocols, anti -degradation policy and
192	192	implementation, and policies general ly affecting Oklahoma W ater
193	193	Quality Standards appli cation and implementation including , but not
194	194	limited to, mixing zones, low flows a nd variances or any
195	195	modification or change thereof shall be promulgated by the Board in
196	196	compliance with the Admi nistrative Procedures Act and shal l be
197	197	enforced by all state a gencies within the scope of their
198	198	jurisdiction. All use support assessment protoc ols promulgated by
199	199	the Board shall be consistent with state and federal law and
200	200	guidance specifically related to beneficial use support
201	201	determinations as set forth in Section 305(b) of the Federal Water
202	202	Pollution Control Act, where applicable.
203	203	2. In promulgating Oklahoma Water Quality Standards or making
204	204	any modification or change thereof, the Board shall announce a
205	205	reasonable time for persons disc harging waste into the water s of the
206	206	state to comply with such ne w or modified standards unless such
207	207	discharges create an actual or potential hazard to public health.
208	208	3. Any discharge in accord with such standards of the Board and
209	209	in compliance with rules , requirements and wasteload allocations
210	210	established by the Depar tment of Environmental Quality and with

238	238	deemed to be pollution.
239	239	4. Notwithstanding the implementation jurisdiction provid ed to
240	240	the Board in paragraph 1 of subsection C of this section, t he
241	241	Department of Environmental Quality shall have jurisdiction to
242	242	develop and utilize policies and requirements, as provided in
243	243	paragraph 22 of subsection B of Section 1 -3-101 of Title 27A of the
244	244	Oklahoma Statutes.
245	245	SECTION 2. AMENDATORY 82 O.S. 2021, Section 1085.30a, is
246	246	amended to read as follows:
247	247	Section 1085.30a. Oklahoma Water Quality S tandards, promulgated
248	248	by the Oklahoma Water Resources Board Department of Environmental
249	249	Quality, shall designate:
250	250	1. Watersheds that are nutri ent-limited; and
251	251	2. Groundwaters that are nutrient -vulnerable.
252	252	SECTION 3. This act shall become effective November 1, 2022.
