4944 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
5045 SECTION 1. AMENDATORY 47 O.S. 2021, Secti on 156.1, is
5146 amended to read as follows:
5247 Section 156.1 A. It shall be unlawful for any state officia l,
5348 officer or employee, except any essential employees approved by the
5449 Governor and those officers or employees authorized in s ubsection B
5550 of this section, to ride to or from the place of residence of the
5651 employee in a state-owned or state-leased automobile, truck or
5752 pickup, except in the performance of the o fficial duty of the
5853 employee, or to use or permit the use of any such aut omobile, truck,
5954 ambulance or pickup for other personal or private purposes . Any
6055 person convicted of violating the provisions of this section shall
6156 be guilty of a misdemeanor and shal l be punished by a fine of not
6257 more than One Hundred Dollars ($100.00) or by imprisonment in the
58+county jail for a period to not exceed thirty (30) days, or by both

90-county jail for a period to not exceed thirty (30) days, or by both
9185 said fine and imprisonment, and in ad dition thereto, shall be
9286 discharged from state employm ent.
9387 B. 1. Any state employee, other than the individuals provided
9488 for in paragraph 2 of this subsect ion and any employee of the
9589 Department of Public Safety who is an e mployee in the Driver License
9690 Examining Division or the Driver Compliance Division or a wrecker
9791 inspector or auditor of the Wrecker Services Division as provid ed
9892 for in paragraph 3 of this subsection, who receives emergency
9993 telephone calls regularly at the residence of the employee when the
10094 employee is not on duty and is regularly called up on to use a
10195 vehicle after normal work hours in response to such emergency calls,
10296 may be permitted to us e a vehicle belonging to th e state to provide
10397 transportation betwee n the residence of the employee and the
10498 assigned place of employment, provided such di stance does not exceed
10599 seventy-five (75) miles in any round trip or is wi thin the county
106100 where the assigned place of employment is located . Provided
107101 further, an employee may be permitted to use a state -owned or state-
108102 leased vehicle to provide temporary tr ansportation between a
109103 specific work location other than the assigned pla ce of employment
110104 and the residence of the employee, if such use shall result in a
111105 monetary saving to the agency, and such authori zation shall not be
112106 subject to the distance or area re strictions provided for in this
113107 paragraph. Authorization for temporary u se of a state-owned or
108+state-leased vehicle for a specific project shall be in writing

141-state-leased vehicle for a specific project shall be in writing
142135 stating the justification for this use and the saving expected to
143136 result. Such authorization sh all be valid for not to exceed sixty
144137 (60) days. Any state entity other t han law enforcement that avail s
145138 itself of this provision shall keep a monthly record of all
146139 participating employees, the number o f emergency calls received and
147140 the number of times tha t a state vehicle was used in the performance
148141 of such emergency calls.
149142 2. Any employee of the Departme nt of Public Safety, Oklahoma
150143 Department of Corrections, Oklahoma State Bureau of Narcotics and
151144 Dangerous Drugs Control, Oklahoma State Bureau of Investi gation,
152145 Alcoholic Beverage Laws Enforcement Commission, Oklahoma Horse
153146 Racing Commission, Oklahoma Depa rtment of Agriculture, Food, and
154147 Forestry, Office of the Inspector General within the Department of
155148 Human Services or Office of the State Fire Marshal, w ho is a law
156149 enforcement officer or criminalist, Public Information office r,
157150 Special Investigator or Ass istant Director of the Oklahoma State
158151 Bureau of Investigation, CLE ET-certified Investigator for a s tate
159152 board, or any employee of a district attorney who is a law
160153 enforcement officer, or any CLEET-certified employee of the Okl ahoma
161154 Tourism and Recreation Department may be permitted to use a state -
162155 owned or state-leased vehicle to provide transportation b etween the
163156 residence of the employee and the assig ned place of employment and
164157 between the residence and any location other than the assigned place

194186 3. Any employee of the Department of Public Safety who i s an
195187 employee in the Driver License Examining Division, an employee of
196188 the Driver Compliance Division, a wrecker inspector or auditor of
197189 the Wrecker Services Division, or a noncommissioned pilot may be
198190 permitted, as determined by the Commissioner, to use a state-owned
199191 or state-leased vehicle to provide transportation between the
200192 residence of the employee and the assigned place of employment and
201193 between the residence and any location other than the assigned pl ace
202194 of employment to which the employee travels i n the performance of
203195 the official duty of the employee.
204196 4. The Director, department heads and other essential employees
205197 of the Department of Wildlife Conservation, as authorized by the
206198 Wildlife Conservation Commission, may be permitted to use a state -
207199 owned or state-leased vehicle to provide transportation between the
208200 residence of the employee and the assigned place of employment and
209201 between the residence and any location other than the assigned place
210202 of employment to which the employee travels in the perf ormance of
211203 the official duty of the employee.
212204 5. The Director, department head s, emergency responders and
213205 other essential employees of the Department of Corrections, as
214206 authorized by the Director, may be per mitted to use a state -owned or
215207 state-leased vehicle to provide transportation between the residence

247238 C. The principal administrator of the state agency with which
248239 the employee is employed shall so designate the status of the
249240 employee in writing or provide a copy of the temporary autho rization
250241 to the Governor, the President Pro Te mpore of the Senate and the
251242 Speaker of the House of Representatives . Such employee status
252243 report shall also be provided to the State Fleet Manager of the
253244 Division of Fleet Management if the motor vehicle for e mergency use
254245 is provided by said Division.
255246 SECTION 2. This act shall become effective November 1, 2022.
