2862 SECTION 1. AMENDATORY 47 O.S. 2021, Section 6-101, is

4098 B. 1. No person shall operate a Class A commercial motor
4199 vehicle unless the person is eighteen (18) years of age or older and

45103 permitted to operate motor vehicles in Classes A, B, C and D, except

63144 4. No person under twenty-one (21) years of age shall be
64145 licensed to operate any motor veh icle which is required to be
65146 placarded for hazardous materials pursuant to 49 C.F.R., Part 172 ,
66147 subpart F, except as provided in subsection F of this section;
67148 provided, a person eighteen (18) years of age or older may be
68149 licensed to operate a farm vehicle which is required to be placarded
69150 for hazardous materials pursuant to 49 C.F.R., Part 172, sub part F,
70151 except as provided in subsection F of this section.

72152 5. A person at least seventeen (17) years of age who
73153 successfully completes all examinations required by law may be
74154 issued by the Department:

76155 a. a restricted Class A commercial license which shal l
77156 grant to the licensee the privilege to operate a Class

79158 purposes or a Class D motor vehicle, or

93195 may exercise the privilege thereby granted upon all street s and

96197 D. No person shall operate a motorcycle or mo tor-driven cycle
97198 without having a valid Class A, B, C or D license with a motorcycle
98199 endorsement. Except as otherwise provided by law, any new applicant
99200 for an original driver lic ense shall be required to successfully
100201 complete a written examination, visio n examination and driving
101202 examination for a motorcycle as prescribed by the Department of
102203 Public Safety, and a certified state-approved motorcycle basic rider
103204 course approved by t he Department if the applicant is seventeen (17)
104205 years of age or younger to b e eligible for a motorcycle endorsement
105206 thereon. The written examination and driving examination for a
106207 motorcycle shall be waived by the Department of Public Safety upon
107208 verification that the person has successfully completed a certified
108209 Motorcycle Safety Foundation rider course approved by the
109210 Department.

116242 approved motorcycle basic rider course approved by the Departme nt if
117243 the person is seventeen (17) years of age or younger to be eligible

133258 to Section 6-212 of this title to operate a Class A, B or C
134259 commercial motor vehicle upon the public highways solely for the
135260 purpose of behind-the-wheel training in accordance with rules

139263 as provided in Section 6 -115 of this title of o ne hundred eighty

142292 may be suspended, revoked, canceled, denied or disqualified at the
143293 discretion of the Department for violat ion of the restrictions, for
144294 failing to give the required or correct informat ion on the
145295 application or for violation of any traffic laws of this state
146296 pertaining to the operation of a motor vehicle. Except as otherwise
147297 provided, the lawful possessor of a commercial learner permit who
148298 has been issued a commercial learner permit fo r a minimum of
149299 fourteen (14) days may have the restriction requiring an
150300 accompanying driver removed by satisfactorily completing a driver’s
151301 examination; provided, the removal of a restriction shall not
152302 authorize the operation of a Class A, B or C commercia l motor
153303 vehicle if such operation is otherwise prohibited by law.

155304 3. No person shall ap ply for and the Department shall not issue
156305 an original Class A, B or C driver license until the person has been
157306 issued a commercial learner permit and held the permit for at least
158307 fourteen (14) days. Any person who currently holds a Class B or C
159308 license and who wishes to apply for another class of commercial
160309 driver license shall be required to apply for a commercial learner
161310 permit and to hold the permit for at least fo urteen (14) days before
162311 applying for the Class A or B license, as applicable. Any person
163312 who currently holds a Class A, B or C license and who wishes to add
164313 an endorsement or remo ve a restriction for which a skills
165314 examination is required shall be require d to apply for a commercial

166341 learner permit and to hold the permit for at least fourteen ( 14)
167342 days before applying for the endorsement.

169343 4. A commercial learner permit shall be issu ed by the
170344 Department as a separate and unique document which shall be valid
171345 only in conjunction with a valid Oklahoma driver license or
172346 provisional driver license pu rsuant to Section 6-212 of this title,
173347 both of which shall be in the possession of the pers on to whom they
174348 have been issued whenever that person is operating a commer cial
175349 motor vehicle as provided in this subsection.

177350 5. After one renewal of a commercial l earner permit, as
178351 provided in paragraph 2 of this subsection, a commercial permit
179352 shall not be renewed again. Any person who has held a commercial
180353 learner permit for the initial issuance period and one renewal
181-period shall not be eligible for and the Depa rtment shall not issue ENR. H. B. NO. 3421 Page 5
354+period shall not be eligible for and the Depa rtment shall not issue
182355 another renewal of the permit; provided, the person may reapply for
183356 a new commercial learner permit, as provided for in this subsection.

500896 Sections 6-101 through 6-309 of this title; provided, that no such
501897 rules applicable to the issuance or renewal of REAL ID Noncompliant
502898 Driver Licenses shall create more stringent standards than such
503899 rules applicable as of January 1, 2017, unless directly related to a
504900 specific change in statutory law concerning standards for REAL ID
505901 Noncompliant Driver Licenses. Applications, upon forms approved by
506902 the Department of Public Safety, for such licenses shall be handled,
507903 in accordance with the provisions of subsection G of this section,
508904 by the motor license agents; provided, the Department of P ublic
509905 Safety is authorized to assume these duties in any county of this
510906 state. Each motor license agent accepting applica tions for driver
511907 licenses shall receive Six Dollars ($6.00) for a 4-year REAL ID

1011+computerized images may obtain them through OLETS or through NLETS.

1044+T. No person may hold more than one state-issued or territory-
1045+issued REAL ID Compliant Driver License or REAL ID Compliant
1046+Identification Card from Oklahoma or any other state or terr itory.
1047+The Department shall not issue a RE AL ID Compliant Driver License to
1048+a person who has been previously issued a REAL ID Compliant Driver
1049+License or REAL ID Compliant Identification Card until such license
1050+or identification card has been surrendered to the Department by the
1051+applicant. The Department may promulgate rules related to the
1052+issuance of replacement REAL ID Compliant Driver Licenses in the
1053+event of loss or theft.
1054+U. Upon the effective date of this act Beginning May 24, 2021,
1055+and ending on April 30, 2023, in addition to the amounts p rovided in
1056+subsection Q of this section, a motor license agent shall receive
1057+Five Dollars ($5.00) for each processed app lication for a REAL ID
1058+Compliant 4-year Driver License and Ten Dollars ($10.00) for each
1059+processed application for a REAL ID Compliant 8 -year Driver License.

1156+SECTION 5. AMENDATORY 47 O.S. 2021, Section 6 -101, is
1157+amended to read as foll ows:
1158+Section 6-101. A. No person, except those hereinafter
1159+expressly exempted in Sections 6-102 and 6-102.1 of this title,
1160+shall operate any motor vehicle upon a highway in t his state unless
1161+the person has a valid Oklahoma driver license for the class of
1162+vehicle being operated under the provisions of this title. No

1206+3. No person shall operate a Class C co mmercial motor vehicle
1207+unless the person is eighteen (18) years of age or older and holds a
1208+valid Class C commercial license, except as provided in subsection F
1209+of this section. Any person holding a valid Class C commercial
1210+license shall be permitted to o perate motor vehicles in Clas ses C
1211+and D, except as provided for in paragraph 4 of this subsecti on.
1212+4. No person under twenty-one (21) years of age shall be
1213+licensed to operate any motor vehicle which is required to be
1214+placarded for hazardous materials pu rsuant to 49 C.F.R., Part 172 ,
1215+subpart F, except as provided in subsection F of this section;
1216+provided, a person eighteen (18) years of age or older may be
1217+licensed to operate a farm vehicle which is required to be placarded

1246+5. A person at least seventeen (17) years of age who

1249+a. a restricted Class A commercial license which shal l
1250+grant to the licensee the privilege to operate a Class
1251+A or Class B commercial motor vehicle for harvest
1252+purposes or a Class D motor vehicle, or
1253+b. a restricted Class B commercial license which shall
1254+grant to the licensee the privilege to operate a Class
1255+B commercial motor vehicle for harvest purposes or a
1256+Class D motor vehicle.
1257+6. No person shall operate a Class D motor vehicle unless the
1258+person is sixteen (16) years of age or older and holds a valid Class
1259+D license, except as provided for in Section 6 -102 or 6-105 of this
1260+title. Any person holding a valid Class D lic ense shall be
1261+permitted to operate motor vehicles in Class D only.
1262+C. Any person issued a driver license pursuant to this section
1263+may exercise the privilege th ereby granted upon all street s and
1264+highways in this state.
1265+D. No person shall operate a motorcy cle or motor-driven cycle
1266+without having a valid Class A, B, C or D license with a motorcycle
1267+endorsement. Except as otherwise provided by law, any new applica nt

1352+to Section 6-212 of this title to operate a Cl ass A, B or C
1353+commercial motor vehicle upon the public highways solely for the
1354+purpose of behind-the-wheel training in accordance with rules
1355+promulgated by the Department.
1356+2. This commercial learner permit shall be issued for a period
1357+as provided in Secti on 6-115 of this title of o ne hundred eighty
1358+(180) days, which may be renewed one time for an ad ditional one
1359+hundred eighty (180) days; provided, such commercial learner permit
1360+may be suspended, revoked, canceled, denied or disqualified at the
1361+discretion of the Department for violat ion of the restrictions, for
1362+failing to give the required or correct information on the
1363+application or for violation of any traffic laws of this stat e
1364+pertaining to the operation of a motor vehicle. Except as otherwise
1365+provided, the lawful possessor of a commercial learner permit who
1366+has been issued a commercial learner pe rmit for a minimum of

1395+examination; provided, the removal of a restriction shall not

1397+vehicle if such operation is otherwise prohibited by law.
1398+3. No person shall apply for and the Department shall not issue
1399+an original Class A, B or C driver license until the person has been
1400+issued a commercial learner permit and held the p ermit for at least
1401+fourteen (14) days. Any person who currently holds a Class B or C
1402+license and who wishes to apply for another class of commercial
1403+driver license shall be required to apply for a commercial learner
1404+permit and to hold the permit for at le ast fourteen (14) days before
1405+applying for the Class A or B license, as applicab le. Any person
1406+who currently holds a Class A, B or C license and who wishes to add
1407+an endorsement or remo ve a restriction for which a skills
1408+examination is required shall be r equired to apply for a commer cial
1409+learner permit and to hold the permit for at least fourteen (14)
1410+days before applying for the endorsement.
1411+4. A commercial learner permit shall be issu ed by the
1412+Department as a separate and unique document which shall be valid
1413+only in conjunction wit h a valid Oklahoma driver license or
1414+provisional driver license pursuant to Section 6-212 of this title,
1415+both of which shall be in the possession of the pers on to whom they

1444+5. After one renewal of a commercial learner permit, as
1445+provided in paragraph 2 of this subsection, a c ommercial permit
1446+shall not be renewed again. Any person who has held a commercial
1447+learner permit for the initial issuance period and one renewal
1448+period shall not be eligible f or and the Department shall not issue
1449+another renewal of the permit; provided, t he person may reapply for
1450+a new commercial learner permit, as provided for in this subsection.
1451+G. 1. For purposes of this title:
1452+a. "REAL ID Compliant Driver License" or "Identification
1453+Card" means a driver license or identification card
1454+issued by the State of Oklahoma that has b een
1455+certified by the United States Department of Homeland
1456+Security (USDHS) as compliant with the requirements of
1457+the REAL ID Act of 2005, Public Law No. 109-13. A
1458+REAL ID Compliant Driver License or Identification
1459+Card and the process through which it is issued
1460+incorporate a variety of security measures designed to
1461+protect the integrity and trustworthiness of the
1462+license or card. A REAL ID Compliant Driver License
1463+or Identification Card will be clearly marked on the
1464+face indicating that it is a compliant document, and

1496+compliant with the requirements of the REAL ID Act. A
1497+REAL ID Noncompliant Driver License or Identification
1498+Card will be clearly marked on the face indicating
1499+that it is not compliant with the federal REAL ID Act
1500+and is not acceptable for official federal purposes.
1501+The driver license or identification card will have a
1502+unique design or color indicator that clearly
1503+distinguishes it from a compliant license or card.
1504+2. Original Driver License and Identification Card Issuance:
1505+a. Application for an original REAL ID Compliant or REAL
1506+ID Noncompliant Driver License or Identifi cation Card
1507+shall be made to the Department of Public Safety.
1508+b. Department of Public Safety employees shall perform
1509+all document recognition and other requirem ents needed
1510+for approval of an original REAL ID Compli ant or REAL
1511+ID Noncompliant Driver License or Identification Card
1512+application.
1513+c. Upon approval of an original REAL ID Compliant or REAL
1514+ID Noncompliant Driver License or Identification Card

1751+I. The fee charged for any failed examination shall be Four
1752+Dollars ($4.00) for any license classification. Notwithstanding the
1753+provisions of Section 1104 of this title, all monies collected from
1754+such examination fees pursuant to the pro visions of this subsection
1755+shall be deposited in the General Re venue Fund of this state.
1756+J. In addition to any fee charged pursuant to the provisions of
1757+subsection H of this section, the fee charged for the issuance or
1758+renewal of a REAL ID Noncompliant Dr iver License shall be in
1759+accordance with the following schedule ; provided, that any applicant
1760+who has a CDL Learner Permit shall be charged only the replacement
1761+fee for the issuance of the license:

1843+L. A commercial learner permit may be ren ewed one time for a
1844+period of one hundred eighty (180) days. The cost for the renewed
1845+permit shall be the same as for the original permit.
1846+M. Notwithstanding the provisions of Section 1104 of this
1847+title, of each fee charged pursuant to the provisions of subsections
1848+J, K and L of this section:
1849+1. Five Dollars and fifty cents ($5.50) of a 4-year license or
1850+Eleven Dollars ($11.00) of an 8-year license shall be deposited to
1851+the Trauma Care Assistance Revolving Fund created in Section 1-
1852+2530.9 of Title 63 of the Oklahoma Statutes ;
1853+2. Six Dollars and seventy-five cents ($6.75) of a 4-year
1854+license or Thirteen Dollars and fifty cen ts ($13.50) of an 8-year
1855+license shall be deposited to the Dep artment of Public Safety
1856+Computer Imaging System Revolving Fund to be u sed solely for the
1857+purpose of administration and maintenance of the computerized
1858+imaging system of the Department;
1859+3. Ten Dollars ($10.00) of a 4-year license or Twenty Dollars
1860+($20.00) of an 8-year license shall be deposited to the Department
1861+of Public Safety Revolving Fund for all original or renewal
1862+issuances of licenses; and

1902+P. No person who has been honora bly discharged from act ive

1906+Forces of the United States to b e a disabled veteran i n receipt of
1907+compensation at the one-hundred-percent rate for a permanent
1908+disability sustained through military action or accident resulting
1909+from disease contracted while in such active service and registered
1910+with the veterans registr y created by the Oklah oma Department of
1911+Veterans Affairs shall be charged a fee for the issuance,
1912+replacement or renewal of an Oklahoma driver license; provided, that

1943+section, the Department of Public Safety and the Oklahoma Tax
1944+Commission are authorized to promulgate rules for the issuance and
1945+renewal of driver licenses authori zed pursuant to the provisions of
1946+Sections 6-101 through 6-309 of this title; provided, that no such
1947+rules applicable to the issuance or renewal of REAL I D Noncompliant
1948+Driver Licenses shall create more stringent standards than such
1949+rules applicable as of January 1, 2017, unless directly related to a
1950+specific change in statutory law concerning standards for REAL ID
1951+Noncompliant Driver Licenses. Application s, upon forms approved by
1952+the Department of Public Safety, for such licenses sha ll be handled,
1953+in accordance with the provisions of subsection G of this section,
1954+by the motor license agents; provided, the Department of Public
1955+Safety is authorized to assume these duties in any county of this
1956+state. Each motor license agent accepting a pplications for driver
1957+licenses shall receive Six Dollars ($6.00) for a 4-year REAL ID
1958+Noncompliant Driver License or Twelve Dollars ($12.00) for an 8-year
1959+REAL ID Noncompliant Driver License or Ten Dollars ($10.00) for a 4-
1960+year REAL ID Compliant Driver Li cense or Twenty Dollars ($20.00) for
1961+an 8-year REAL ID Compliant Driver License to be deducted from the
1962+total collected for each license or renewal application accepted .

1994+driver license to be deducted from the daily motor license agent
1995+receipts. The fees received by the motor license agent, authorized
1996+by this subsection, shall be used for operating expenses.
1997+R. Notwithstanding the provisions of Section 1104 of this title
1998+and subsection Q of this section and except as provided in
1999+subsections H and M of this section, the first Sixt y Thousand
2000+Dollars ($60,000.00) of all monies collected pursuant to this
2001+section shall be paid by the Oklahoma Tax Commission to the State
2002+Treasurer to be deposited in the General Revenue Fund of the State
2003+Treasury.
5412004 The next Five Hundred Thousand Dollars ( $500,000.00) of monies
5422005 collected pursuant to this section shall be paid by the Tax
5432006 Commission to the State Treasurer to be deposited each fiscal year
5442007 under the provisions of this section to the credit of the Department
5452008 of Public Safety Restricted Revolving Fund for the purpose of t he
5462009 Statewide Law Enforcement Communications System. All other monies
5472010 collected in excess of Five Hundred Sixty Thousand Dollars
